Lot 1, Block 1 and Outlot A, Bloomberg Addition BACKGROUND Country Inn Suites, LLC has requested the roadway, drainage and utility easement over Lot 1, Block 1 and Outlot A, Bloomberg Addition be vacated. The easement was granted in 1972 in conjunction with sewer and water Project 72-2. The site plan for Country Inn Suites was approved in 1989. The utilities within the easement were relocated in conjunction with the building construction, however the easement was not vacated. Reason for Request: The property is burdened by a 1975 easement for "public right of way, streets, utilities," etc. "over, under, and across" the property which was improved in 1990 as the Chanhassen Country Suites Hotel. As the attached reduced survey of the property reflects, the easement actually runs under a portion of the building. It is apparent that the city has no intent to use the easement as evidenced by its approval in 1990 of the plans for the hotel to build over the easement.
