" , CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION Date: July 27, 1978 Motion by Councilman Pearson Resolution No. 78-36 Seconded by Councilman Neveaux Resolution Authorizing North State Highway #5 Frontage Road Improve- ment Project No. 78-5C. BE IT RESOLVED by the City Council of the City of Chanhassen, Minnesota, as follows: 1. It is hereby found and determined that notice of hearing on a proposed North State Highway #5 frontage road improvement in the City was duly mailed on July 5, , 1978, and published in the Carver County Herald, the official newspaper of the City, on July 5, 1978 and July 12, 1978, as required by Minnesota Statutes, Chapter 429, and as ordered by resolution of this Council adopted on June 12, , 1978. 2. A public hearing having been held on July 17, 1978, and opportunity having been given at such hearing to all persons to make known their views on said improvement, and this Council being fully advised of the pertinent facts, does hereby order the construction of said improvements as follows: Widening of existing bituminous roadway surface of County Road #16 east of Dakota Avenue, construction and installation of a nine-ton bituminous frontage roadway, 28 feet in width, extending easterly from County Road #16, including excavation, placement of aggregate and bituminous base and wearing courses, installation of concrete curb and gutter, sanitary sewer and watermains and storm sewer facilities, sodding and seeding as necessary, and acquisi- tion of right of way. 3. Said improvement is hereby designated and shall hereafter be referred to as North State Highway #5 Frontage Road Project No. 78-5C. 4. Schoell & Madson, Inc., the consulting engineers for the City, are hereby autho~ized and directed to prepare final plans and specifica- tions for said improvement and to submit them to this Council. 5. The City hereby determines that it is necessary to acquire all property rights which will be needed for the construction and location of the storm sewer mains and related facilities described in Paragraph 2; and that such acquisition is in the public interest and for the public purpose authorized by Minnesota Statutes, ~444.075. -1- e e e . Larson & Mertz, Attorneys at Law, are hereby authorized and directed to proceed with the acquisition of all such property rights by negotiation, contract or condemnation, and are authorized to do all things necessary to secure the right of entry or possession of such property for construction purposes as soon as possible.
