Approving Modification of Redevelopment Plan: Happy Chef/Holiday
Proposal.
Whereas, the Chanhassen City Council has received from the Chan-
hassen Housing and Redevelopment Authority a duly certified copy of
a resolution of that body dated May 10, 1979, which resolution modifies
the Chanhassen Downtown Redevelopment Plan which was previously
approved by the Chanhassen City Council by its resolutions dated
December 19, 1977 and December 18, 1978.

Whereas, it is desirable and in the public interest that the
Housing and Redevelopment Authority in and for the City of Chanhassen
(herein called the "Local Public Agency") undertake and carry out a
Redevelopment Project identified as Chanhassen Downtown Redevelopment
Project and encompassing the area which is more particularly described
in the above described resolution.
Whereas, in c~nnection with the undertaking of a Redevelopment
Project by the Local Public Agency pursuant to the Minnesota Municipal
Housing and Redevelopment Act, Laws of Minnesota 1947, Chapter 487,
as amended, it is required that said modification of the Redevelopment
Plan be approved by the governing body of the municipality in which
the project is located; and
Whereas, the said Redevelopment Plan, as modified, has been
approved by the Local Public Agency as evidenced by the copy of said
body's duly certified resolution approving said Redevelopment Plan,
which is attached thereto; and
Whereas, the City Planning Commission of the City of Chanhassen,
which is the duly designated and acting official planning body for
the Locality, has submitted to the Governing Body its report and
recommendations respecting said modification to the Redevelopment Plan
and its findings as to compliance with the comprehensive municipal
plan, and the Governing Body has duly considered said report,
recommendations and findings of the planning body.
Now, Therefore, Be It Resolved By the City Council of the City
of Chanhassen:

1.
That the Chanhassen Downtown Redevelopment Plan, dated October 28,
1977 as amended heretofore having been duly reviewed and considered,
is hereby approved and reconfirmed, but with the following
modification:

The tracts of land (hereinafter: the subject property)
described on the attached Housing and Redevelopment Authority
resolution are hereby identified for acquisition by said
Authority and for redevelopment as a combination commercial,
automobile oriented, retail site and park-like gateway
area to the Downtown Redevelopment District.
2. That the method proposed for financing and project as modified
herein having been duly reviewed and considered, is duly approved.
3. That is is hereby found and determined that the objectives of
the Redevelopment Plan cannot be achieved through more extensive
private rehabilitation of the subject property.
4. That it is hereby found and determined that the Redevelopment Plan
for the subject property conforms to the general plan of the
locality as a whole.
5.
That is is hereby found and determined that the Redevelopment Plan
for the subject property will afford maximum opportunity consistent
with the sound needs of the Locality as a whole, for the redevelop-
ment of the area by private enterprise.

6. This Governing Body, to the extent necessary to carry out said
Plan, consents to the use by the Local Public Agency of the tax
increment method of financing in the manner provided in Minnesota
Statutes S462.585 in the Chanhassen Downtown Redevelopment
Project, and hereby pledges itselt (a) to issue general oblication
bonds from time to time to cover budgets approved or to be approved
by said Governing Body for said Redevelopment Project; and (b)
to enter into such written agreements as may be necessary to
effectuate the objectives of the Redevelopment Project and said
method of financing.
Passed and adopted by the Council of the City of Chanhassen this

RESOLUTION ALTERING H.R.A. PLAN
Whereas, the Housing and Redevelopment Authority of Chanhassen,
Minnesota, has previously, by its resolution dated December 18, 1978,
amended its Chanhassen Downtown Redevelopment Plan dated October 28,
1977: and
Whereas, S462.525, subd. 6 of Minnesota Statutes allows the
modification of a redevelopment plan at anytime: and
Whereas, there has been presented to the governing body of the
Authority for its consideration and approval a proposal for the public
acquisition of that portion of the proposed plat of Zamor Addition
which is more particularly described on Exhibit A attached hereto and
made a part hereof, and which proposed plat is now pending before the
City Council of the City of Chanhassen: said acquisition to be for
the purpose of making available for redevelopment a combination
commercial, automobile oriented, retail site and park-like gateway
area to the Downtown Development District; and
Whereas, said proposal was duly transmitted to the planning
agency of the municipality in which the proposed acquisition site is
situated, namely, the City Planning Commission of the City of Chan-
hassen, for its study, and whereas request was made by the Authority
to said p1anning commission for its written opinion of said plan
alter3.tion;
Now, Therefore, Be It Resolved, by the Governing Body of the
Housing and Redevelopment Authority in and for Chanhassen, Minnesota:
1.
That the Chanhassen Downtown Redevelopment Plan dated October 28,
1977, as amended on December 18, 1978, is hereby reconfirmed and
approved with the following modification:
The tracts of land described on Exhibit A attached hereto
and made a part hereof are hereby identified for acquisition
by the Authority and for development as a combination
commercial automobile oriented retail site and park-like
gateway area to the Downtown Redevelopment District.

2.
That the aforesaid plan and project as modified herein will
carry out the purpose and policy of the Municipal Housing and
Redevelopment Act of the State of Minnesota (Laws 1947, Chapter
487 as amended; M.S.A. S462.4ll to 462.711) as set forth in Sl
thereof (M.S.A. S462.4l5) and in the Congressional declaration
of national housing policy contained in the Act of 1949, as
amended.
3. That the said Redevelopment Plan as modified herein, together
with the Proposed Method for Financing the Project, and
Relocation Report, is hereby in all respects approved.
4.
That application is hereby made to the City Council of the
City of Chanhassen, the governing body of the municipality in
which said Project is located, for the approval of said Plan
and Project as modified herein, including the Method of Financing,
and the Executive Director is hereby authorized and directed on
behalf of this Authority to transmit said Plan to said City
Council, together with a copy of this resolution and the written
opinion of the City Planning Commission of the City of Chanhassen,
a statement of the Method for Financing the Project, and a
Relocation Plan and to take such other action as he, the said
Executive Director, may deem necessary and advisable in order to
secure from said City Council its approval of said Plan and
Project. Said City Council is hereby requested to hold a public
hearing on said alteration of the Chanhassen Downtown Redevelop-
ment Plan after giving published notice of the date, time, place
and purpose of such hearing in a newspaper of general circulation
in the City of Chanhassen, such notice to be published once at
least ten days prior to the date of the hearing.
Said City Council is hereby requested to approve said Plan and
Project as modified herein including the Method of Financing,
and to find by resolution that: 1) the land described on Exhibit A
would not be made available for redevelopment without the
financial aid to be sought; 2) the redevelopment plans for the land
described on Exhibit A will afford maximum opportunity, consistent
with the sound needs of the locality as a whole, for the redevelop-
ment of such area by private enterprise; and 3) the redevelopment
plan conforms to a general plan for the development of the locality
as a whole, and further to find by resolution that (i) the said
plan as modified herein will afford maximum opportunity, consis-
tent with the sound needs of the locality as a whole, for the
rehabilitation and redevelopment of the Redevelopment Area by
private enterprise; and (ii) that the Redevelopment Plan conforms
to a general plan for the locality as a whole.
Said Executive Director is hereby authorized and directed to
transmit to the State Planning Officer of the State of Minnesota
and to the State Housing Commission and to the Minnesota State
Planning Agency certified copies of this resolution, and other
papers and documents described or referred to in S8 of said
Municipal Housing and Redevelopment Act (M.S.A. S462.445, Subd. 8).

5.
Said Executive Director is hereby authorized and directed to take
such action as he may deem necessary or advisable for and in
behalf of and in the name of this Authority to expedite approval
of said Plan alteration by the City Council of the City of
Chanhassen and by any and all other authorities, including the
United States Government and any of its agencies and instrumental-
ities.
6. That it is hereby found and determined that the objective of the
redevelopment plan cannot be achieved through more extensive
private rehabilitation of the land described on Exhibit A.
Passed and Adopted this 10th day of May, 1979, by the Housing
and Redevelopment Authority of Chanhassen, Minnesota.

Minnesota, described as follows: .
Beginning at the northeast corner of said Lot Ii thence
southwesterly along the easterly line of said Lot 1 to the
southeast corner of said Lot Ii thence on an assumed bearing
of North 85 degrees 10 minutes 11 seconds West along the
south line of said Lot 1 a distance of 25.76 feet; thence
North 26 degrees 06 minutes 27 seconds East a distance of 62.35
feet; thence North 5 degrees 59 minutes 42 seconds East a
distance of 103.41 feet more or less to the north line of
said Lot 1; thence easterly along the north line of said
Lot 1 to the point of beginning.
Together with the southerly, southeasterly, and easterly twenty-five
(25) feet of Lot 2, Block 1, Zamor Addition, Carver County,
Minnesota.
