RESOLUTION

RESOLUTION APPROVING MODIFICATION OF DOWNTOWN
REDEVELOPMENT PLAN.
WHEREAS, the Chanhassen City Council has received from the Chanhassen
Housing and Redevelopment Authority (hereinafter the Authority) a
resolution of that body dated May 10, 1979, which resolution modifies
the Chanhassen Downtown Redevelopment Plan, which was previously
approved by the Chanhassen City Council by its resolutions dated
December 19, 1977 and December 18, 1978; and
WHEREAS, ~462.525(6) of Minnesota Statutes allows the modification of
a redevelopment plan at any time; and

WHEREAS, the above described redevelopment plan identifies Lots 1 and
2, Block 2 of Frontier Development Park, Carver County, Minnesota for
redevelopment as an open space zone serving as a gateway to an auto
oriented retail service zone; and
WHEREAS, the Authority has received from one Lawrence N. Zamor (herein-
after the Developer) a proposal to replat Lots 1 and 2 of Block 2 in
Frontier Development Park, Carver County, Minnesota (hereinafter the
Subject Premises) as Lots 1,2, and 3, Block 1, Zamor Addition, and to
construct upon said Lot 1 a Holiday Stationstore, Inc. combination
automobile fuel station/retail convenience shopping facility, and to
construct upon said Lot 2 a Happy Chef Systems, Inc. restaurant; and
WHEREAS, the Subject Premises are zoned CBD, Central Business District,
under the Chanhassen Zoning Office; and
WHEREAS, said ordinance requires the issuance of a conditional use
permit prior to the initiation of the uses proposed by the Developer;
and
WHEREAS, the Subject Premises lie within the boundaries of the Chanhassen
Downtown Redevelopment District established in the above described re-
development plan; and

WHEREAS, the Authority and the City Council have advised the Developer
that the proposed development would be approved only if a significant
portion of the Subject Premises were to be developed so as to have a
park-like appearance which would project an open space image into the
commercial use area of said Redevelopment District; and

WHEREAS, said condition has the effect of requiring the Developer to
expand the area of the above described development proposal to include
additional land; and
WHEREAS, the Developer has advised the City and the Authority that
such expansion of the development area would render the proposed
development economically unfeasible; and
WHEREAS, the Authority has found that said Lots 1 and 2, Block 2,
Frontier Development Park would, in all probability, not be developed
for open space purposes by private enterprise in the absence of some form
of redevelopment assistance from the Authority and the City of
Chanhassen; and
WHEREAS, the City Planning Commission of the City of Chanhassen, which
is the duly designated and acting official planning body for the City,
has submitted to the City Council its report and recommendation
respecting the proposed modification to the Redevelopment Plan, and the
City Council has duly considered said report, recommendation and
findings of said Planning Commission;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chanhassen:
1. That the above described redevelopment plan be modified as
follows:
a. That the tract of land described on Exhibit A attached hereto
and made a part hereof is hereby identified for acquisition by the
Authority for development as an open space area available for resale at
a cost write-down to one or more private developers provided that said
developers assume by written contract appropriate maintenance duties
as to said open space;
b. That the remaining portion of said Lots 1 and 2, Block 2,
Frontier Development Park be incorporated into the auto-oriented retail
services redevelopment zone more specifically described in the above
described redevelopment plan as approved by the Authority heretofore.

That it is hereby found and determined:
a. That the subject premises would not be available for redevelop-
ment without the financial aid sought by the Developer;
b. That the redevelopment plan for the Subject Premises will afford
maximum opportunity, consistent with the sound needs of the locality as
a whole, for the redevelopment of the redevelopment district by a
private enterprise;

c. That the creation of an open space gateway area to the
subject redevelopment district is essential to the achievement of the
goals of the subject redevelopment plan;
d. That the financial aid sought by the Developer will facilitate
the creation of such an open space gateway area, while minimizing long
term public expenditures in that the continuing obligation to maintain
said gateway area would be borne at private expense by the Developer, his
successors and assigns; and
e. That the redevelopment plan, as modified herein, conforms to
the general plan for the locality as a whole.

EXHIBIT A
That part of Lot 1, Block 1, ZAMOR ADDITION, Carver County,
Minnesota, described as follows:
Beginning at the northeast corner of said Lot 1; thence
southwesterly along the easterly line of said Lot 1 to the
southeast corner of said Lot 1; thence on an assumed bearing
of North 85 degrees 10 minutes 11 seconds West along the
south line of said Lot 1 a distance of 25.76 feet; thence
North 26 degrees 06 minutes 27 seconds East a distance of 62.35
feet; thence North 5 degrees 59 minutes 42 seconds East a
distance of 103.41 feet more or less to the north line of
said Lot 1; thence easterly along the north line of said
Lot 1 to the point of beginning.
Together with the southerly, southeasterly, and easterly twenty-five
(25) feet of Lot 2, Block 1, Zamor Addition, Carver County,
Minnesota.
