RESOLUTION

Seconded by Councilman Matthews
Resolution Authorizing South Lotus Lake Drainage Improvement Project
No. 78-1.
BE IT RESOLVED by the City Council of the City of Chanhassen, Minnesota,
as follows:
1. It is hereby found and determined that notice of hearing on a
sanitary sewer and water improvement in the City was duly mailed on
May 30, , 1979, and published in the Carver County Herald, the
official newspaper of the City, on May 30 and June 6, 1979, as required
by Minnesota Statutes, Chapter 429, and as ordered by resolution of
this Council.

2. A public hearing having been held on June 11, 1979 and July 2,
1979, and opportunity having been given at such hearing to all persons
to make known their views on said improvement, this Council, being
fully advised of the pertinent facts, does hereby order the construc-
tion of said improvements in accordance with the description thereof
contained in said notice of hearing, and as shown in the feasibility
studies for drainage improvements in the South Lotus Lake area submitted
by the City Engineers under dates of December, 1977, August 21, 1978,
and June 1, 1979.
3. Said improvement is hereby designated and shall hereafter be
referred to as South Lotus Lake Drainage Improvement Project No. 78-1.
4. Schoell & Madson, Inc., the consulting engineers for the City,
are hereby authorized and directed to prepare final plans and specifi-
cations for said improvement and to submit them to this Council for
approval.
5. The City hereby determines that it is necessary to acquire all
property rights which will be needed for the construction and location
of the drainage improvements described in Paragraphs 2 and 3; and that
such acquisition is in the public interest and for thepublic purpose
authorized by Minnesota Statutes, ~444.075.
6. The City Attorney is hereby authorized and directed to proceed
with the acquisition of all such property rights by negotiation, contract
or condemnation, and is authorized to do all things necessary to secure
the right of entry or possession of such property for construction pur-
poses as soon as possible.

7. The City Attorney is hereby authorized and directed to proceed
with pre-construction property appraisals to assist the Council in
evaluating special benefits, if any, to properties proposed to be
assessed for the cost of the improvement pursuant to Chapter 429 of
Minnesota Statutes.
