".> CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION Date: September 4, 1979 Motion by Councilman Pearson Resolution No. 79-52 Seconded by Councilman Matthews RESOLUTION AUTHORIZING BANDIMERE HEIGHTS SEWER IMPROVEMENT PROJECT 79-3 BE IT RESOLVED by the City Council of the City of Chanhassen, Minnesota, as follows: 1. It is hereby found and determined that notice of hearing on a sanitary sewer improvement in the City was duly mailed on July 23 , 1979, and published in the Carver County Herald, the official newspaper of the City, on August 8 and August 15, 1979, as required by M.S. Chap. 429, and as ordered by resolution of this Council adopted on July 16, 1979. 2. A public hearing having been held on August 20, 1979 and September 4, 1979, and opportunity having been given at such hearing to all persons to make known their views on said improvement, and the Council, having considered the City Engineers' feasibility report of June 5, 1979, and being fully advised of all other pertinent facts, does hereby order the construction of the Lake Riley Sewer Extension, Alternate "A", as described in the notice of public hearing referred to above and consisting of the following: Construction of a trunk sanitary sewer main, including restoration of all disturbed areas and acquisition of sewer easements as necessary, to provide gravity sewer service to the following described premises: a. The West Two Hundred (200) feet of the East Four Hundred (400) feet of that part of Government Lot Four (4) of Section Twenty-four (24), Township One Hundred Sixteen (116) North of Range Twenty-three (23) West, lying North of Lake Riley (9251 and 9261 Kiowa Trail.) b. All lots in Bandimere's Heights. c. All lots in Bandimere Heights 2nd Addition. d. Premises described in Book 131, page 47 (Stockwell) and Book 104, page 203 (McCart), Files of Carver County Recorder (9411 and 9360 Kiowa Trail) . 3. Said improvement is hereby designated and shall hereafter be referred to as "Bandimere Heights Sewer Improvement Project No. 79-3." -1- e e e , . . ; 4. Schoell & Madson, Inc., the consulting engineers for the City, are hereby authorized and directed to prepare final plans and specifications for said improvements and to submit them to this Council. 5. The City hereby determines that it is necessary to acquire all property rights which will be needed for the construction and location of the trunk sanitary sewer main described in paragraph 2; and that such acquisition is in the public interest and for the public purpose authorized by M.S. ~444.075. 6. Larson & Mertz, Attorneys at Law, are hereby authorized and directed to proceed with the acquisition of all such property rights by negotiation, contract or condemnation, and are authorized to do all things necessary to secure the right of entry or possession of such property for construction purposes as soon as possible.
