RATIFICATION OF FIRE DEPARTMENT RELIEF ASSOCIATION DISABILITY AND
RETIREMENT BENEFITS
Recitals:
1. Minnesota Statute Section 69.772, Subdivision 6, requires
ratification by the governing body of the municipality of the
adoption of or any amendment to the articles of incorporation or
bylaws of a fire department relief association which increases or
otherwise affects the retirement coverage provided by or the service
pensions or retirement benefits payable to the special fund of any
relief association.
e 2. The Chanhassen Firemen's Relief Association has proposed certain
amendments of its bylaws to increase or otherwise affect retirement
coverage for its eligible members.
NOW, THEREFORE, BE IT RESOLVED By the City Council of the City of
Chanhassen, as follows:
1. The Firemen's Relief Association is hereby, authorized to amend
Section 1, Subdivision 1, Service Pensions, of Article VIII of the
bylaws of the Association to read:
Section 1. Subdivision 1. Service Pensions.
Upon approval of the application therefor, the sum of $6.00 per
month for each year of service shall be paid to each retired member
of this Association up to a maximum of 30 years of service, during
the remainder of his natural life, provided funds are available in the
Relief Association Special Funds.
2. The Chanhassen Firemen's Relief Association is hereby authorized
to amend Sections 1 and 2 of Article IX of the bylaws of the
Association to read as follows:

section 1. Temporary Disability Benefits.
Upon the approval of the application therefor, any member of
this Association who becomes temporarily physically incapacitated
for active duty in the Fire Department of the City of Chanhassen
because of illness or injury sustained in the performance of such
.

duty and is unable to work for one week or longer shall be paid a
benefit of $5.00 per day for a period no longer than 120 days in any
one fiscal year, providing he is under the care of a physician or
doctor during this period.
Section 2. Permanent Disability Benefits.
If a member of the Association shall become totally and
permanently disabled from performing his duties as a fireman, to
the extent that a medical doctor acceptable to the Board of
Trustees shall so certify that such disability will permanently
prevent the performance of the member's duties with the Chanhassen
Fire Department, the Association shall pay to such member monthly
the sum of $120.00, or $6.00 per month for each year of service,
whichever is the greater, during the period of said total and
permanent disability, provided funds are available in the Relief
Association Special Fund. In the event said disability continues to
the date the member would have qualified for a service pension:as
determined by Subdivision 2 of Section 1 of Article VII, said
member shall be placed on the service pension roll for the
remainder of his natural life. At periodic intervals as directed
by the Board of Trustees an Association member receiving benefits
for total and permanent disability shall submit to an examination
by a medical doctor acceptable to the Board of Trustees to
determine whether said disability continues to exist. If in the
opinion of the examining doctor, the disability of the member
no longer exists, the benefits payable hereunder shall cease.
Failure of a member to submit to any medical examination requested
by the Board of Trustess shall result in denial of a member's
e application for benefits or a termination of benefits.
Adopted by the Council of the City of Chanhassen, this 3rd day of
December, 1979.
