RESOLUTION

RESOLUTION AUTHORIZING DOWNTOWN REDEVELOPMENT PUBLIC IMPROVEMENT
PROJECT NO. 80-3
BE IT RESOLVED, by the City Council of the City of Chanhassen,
Minnesota, as follows:
1. It is hereby found and determined that notice of hearing
on a Downtown Redevelopment Public Improvement in the City was duly mailed
on November 7, , 1980, and published in the Carver County
Herald, the official newspaper of the City, on November 12, and November 19,
1980, as required by Minnesota Statutes, Chapter 429, and as ordered by
resolution of this Council adopted on Noyember 3, 1980.
2. A public hearing having been held on November 24, 1980,
and opportunity having been given at such hearing to all persons to make
known their views on said improvement, and this Council being fully
advised of the pertinent facts, does hereby order the construction of said
improvement, in accordance with the description thereof contained in
said notice of hearing, and as shown in the feasibility study, dated
4It November 4, 1980.
3. Said improvement is hereby designated and shall hereafter
be referred to as "Downtown Redevelopment Public Improvement Project
No. 80-3".
4. Bather, Ringrose, Wolfeld, Jarvis, Gardner, Inc.,
consulting engineers for the City, are directed to defer preparation of
final plans and specifications for said improvement until authorization
therefor has been received from the City Council.
5. The City hereby determines that it is necessary to acquire
all property rights which will be needed for the construction and
location of the Downtown Redevelopment Public Improvement Project described
in Paragraphs 2 and 3; and that such acquisition is in the public interest
and for the public purpose authorized by Minnesota Statute 444.075.
6. Larson & Mertz, Attorneys at Law, are hereby authorized and
directed to proceed with the acquisition of all such property rights by
negotiation, contract or condemnation, and are authorized to do all
things necessary to secure the right of entry or possession of such
property for construction purposes as soon as possible.
