Paul Oehme, City Engineer/Director of Public Works y.; Alyson Fauske, Assistant City EngineerQ,t' ~ May 14, 2007 FROM: DATE:' SUBJECT: Dogwood/Tanadoona Street and Utility Project No. 06-06: Call Assessment Hearing REQUESTED ACTION (Simple Majoritv Vote ReQuired) Council is requested to call the assessment hearing for the Dogwood/Tanadoona Street and Utility Project No. 06-06 for June 11,2007 and approve the attached resolution. DISCUSSION Roadway Improvements At the public hearing, Council directed staff to design Tanadoona Drive and Dogwood Road north of the Arbors Development to a width of 26 feet. Also, Council directed staff to design Dogwood Road in the Arbors Development to the City's standard 31-foot width. The roadway sections were decided to be urbanized with curb and gutter. Staff is still working with two property owners on right-of-way streets. Staff is anticipating having the right-of-way completed and ready for Council consideration the night of the hearing. Sanitary Sewer and Watermain Improvements All homes are currently served by individual wells. Three of the properties are served by a small, city-owned and maintained lift station and forcemain; the remaining properties are served by individual septic systems. The proposed utility improvements will provide service to the proposed development at the southern end of Dogwood Road, The Arbors. Gravity sanitary sewer will be installed within Dogwood Road and will connect to the lift station at the southeast corner of Dogwood Road and Tanadoona Drive. The lift station is proposed to be replaced to handle the ultimate flows for this area. The forcemain from the lift station to the gravity sewer within Tanadoona Drive is also proposed to be replaced to convey the additional flow. City Project 06-06 Call Assessment Hearing May 14,2007 Page 2 Drainage and Runoff Improvements The runoff from the Arbors Development will be conveyed to a storm water pond constructed with the development. This pond will be constructed and paid for by the developer. The runoff outside of the development is proposed to be directed to the corner of Dogwood Road and Tanadoona Drive. Staff has contacted Camp Tanadoona to pursue a drainage and utility easement over the low area of land on the southwest corner of the Camp property for ponding. An appraisal has been completed for the proposed easement area and has been forwarded to the Camp Board for their consideration. The Camp Board is generally amenable to granting the easement, but is waiting for clarification from their attorney before executing the easement agreement. If an easement cannot be acquired, an environmental manhole would be installed to remove some of the sediment from the roadway prior to draining into Lake Minnewashta. Bids will be received and opened on Friday, May 11,2007. Final assessment amounts will be determined based on the lowest responsible bid. SPECIAL ASSESSMENTS AND METHOD OF FINANCING Special assessments are proposed to be levied against benefiting properties for the improvements included in this project. The City will assess benefiting property owners based on the construction bid amount of the improvements. The costs for the improvements are proposed to be assessed to the benefiting properties on a per unit basis. The development will be assessed 100% of the benefit from the project. 100% of the water and sanitary sewer improvements will be assessed back to the benefiting property owners. 40% of the roadway improvements will be assessed back to the existing benefiting property owners consisting with the City's assessment practice. The estimated assessment for existing properties is $30,106.81 per unit and $17,455.45 per unit for properties that have existing City sanitary sewer service. Assessments are proposed for 10 years at 6% interest. Staff intends to publish the notice in the May 24, 2007 edition of the Chanhassen Villager. This schedule provides just over two weeks time between the publication date and the assessment hearing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CHANHASSEN, MINNESOTA: 1. A hearing shall be held on the 11th day of June, 2007 in the Council Chambers at city hall at 7 :00 p.m. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The city clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and shall state in the notice the total cost of the improvement. The clerk shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearings. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City of Chanhassen, except that no interest shall be charged if the entire assessment is paid within 60 days from the adoption of the assessment. The property owner may at any time thereafter, pay to the City of Chanhassen the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. Passed and adopted by the Chanhassen City Council this 14th day of May, 2007.
