10-09-2023 City Council Regular Meeting MinutesCHANHASSEN CITY COUNCIL REGULAR MEETING MINUTES OCTOBER 9, 2023 Mayor Ryan called the meeting to order at 7:00 p.m. The meeting was opened with the Pledge of Allegiance. COUNCIL MEMBERS PRESENT: Mayor Ryan, Councilman McDonald, Councilwoman Schubert, Councilman von Oven, and Councilman Kimber. COUNCIL MEMBERS ABSENT: None. STAFF PRESENT: Laurie Hokkanen, City Manager; Matt Unmacht, Assistant City Manager; Charlie Howley, Public Works Director/City Engineer; Andrea McDowell Poehler, City Attorney; and Kim Meuwissen, City Clerk. PUBLIC PRESENT: Christie Larson, Southern Valley Alliance PUBLIC ANNOUNCEMENTS: 1. Recognition of Donation from the Chanhassen Athletic Association Mayor Ryan recognized the many improvements the Chanhassen Athletic Association has contributed to the community over many years, including score boards and field improvement projects. The Chanhassen Athletic Association donated finances to assist with the infield improvement project at the Lake Susan baseball field. Mayor Ryan thanked the Association for their continued partnership. CONSENT AGENDA: Councilman McDonald, Councilman Kimber seconded that the City Council approve the following consent agenda items 1 through 12 pursuant to the City Manager’s recommendations: 1. Approve City Council Minutes dated September 25, 2023 2. Receive Planning Commission Meeting Minutes dated September 5, 2023 3. Receive Park and Recreation Minutes dated August 22, 2023 4. Receive Economic Development Commission Minutes dated August 8, 2023 5. Approve Claims Paid dated October 9, 2023 City Council Minutes – October 9, 2023 2 6. Consider approval of a Geotechnical Exploration Contract for the Minnetonka Middle School West Roundabout Project 7. Award Contract for Audit Services 8. Approve Maintenance Agreement with Riley Purgatory Bluff Creek Watershed District for work related to 2023 Trail Rehabilitation Project 9. Resolution 2023-75: Accept $5,000 Donation from the Chanhassen Athletic Association 10. Resolution 2023-76: Approve Application of the Rotary Club of Lake Minnetonka-Excelsior to Conduct Off-Premise Lawful Gambling at North Coop Restaurant located at 2401 Highway 7 11. Resolution 2023-77: Authorize Design and Construction Administration Services Contract for 2023 Stormwater Pond Maintenance Project. 12. Ordinance 716: Amending the City Code Concerning Regulation of Lawful Gambling and approve the Publication of a Summary Ordinance. All voted in favor, and the motion carried unanimously with a vote of 5 to 0. VISITOR PRESENTATIONS. Christie Larson, Executive Director at Southern Valley Alliance, shared information about Domestic Violence Awareness Month and the services provided. Southern Valley Alliance provides a free crisis line to offer support and resources, support groups, and a transitional housing program. They also provide court advocacy and community education about domestic violence and their services. Mayor Ryan thanked Ms. Larson for sharing information about the services the organization provides. She commented that the city tracks domestic violence cases and they are starting to review the process of restraining orders between the two area counties. She welcomed Ms. Larson’s feedback. PUBLIC HEARINGS. 1. Resolution 2023-78: Approve Vacation of Public Drainage and Utility Easements within Lot 1, Block 1, and Lot 2, Block 1, Paws Claws and Hooves Addition Charlie Howley, Public Works Director/City Engineer, displayed a graphic showing the public draining and utility easements. He reviewed the background of this request. Mayor Ryan opened the public hearing. There were no public comments. City Council Minutes – October 9, 2023 3 Mayor Ryan closed the public hearing. Councilman von Oven moved, Councilwoman Schubert seconded that the City Council adopt a resolution approving the vacation of public drainage and utility easements within Lot 1, Block 1, and Lot 2, Block 1, Paws Claws and Hooves Addition. All voted in favor, and the motion carried unanimously with a vote of 5 to 0. GENERAL BUSINESS. None. COUNCIL PRESENTATIONS. None. ADMINISTRATIVE PRESENTATIONS. None. CORRESPONDENCE DISCUSSION. None. Councilwoman Schubert moved, Councilman McDonald seconded to adjourn the meeting. All voted in favor, and the motion carried unanimously with a vote of 5 to 0.
