Report
ACTION REQUIRED
Staff is requesting the City Council:
1. Receive public comment on the City's NPDES Phase II MS4 Storm Water
Pollution Prevention Program and 2006 Annual Report; and
2. Approve the Annual Report for 2006; authorize mayor's signature and
submittal to Minnesota Pollution Control Agency.
BACKGROUND
In June 2002, the Minnesota Pollution Control Agency (MPCA) issued a MS4
general permit for cities discharging stormwater into waters of the state.
Shortly after the permit was issued, the Minnesota Center for Environmental
Advocacy (MCEA) filed an appeal for the permit indicating that it was
inappropriate to issue a general permit in place of individual permits and
because they believed the MPCA failed to address non-degradation and
education as part of the permit. In May 2003, the Minnesota Court of Appeals
ruled in favor of the MCEA. The MPCA has since revised their permit to
address additional requirements.
As part of the revised permit, Chanhassen and 29 other communities must
address the non-~egradation of all waters. This requirement has been added to
determine if any new or expanded discharges beyond 1988 baseline conditions
exist within the selected communities (MR 7050.0815). Chanhassen is
currently working with Wenck Associates to develop a non-degradation plan.
This plan will allow Chanhassen to determine if expanded discharges exist
and what reasonable measures can be taken to return pollution loading of
receiving waters to levels consistently achieved during 1988 baseline
conditions.

The City of Chanhassen submitted a revised application for permit coverage on May 26,
2006. Currently the permit application has not been approved by the MPCA due to
internal issues within the MPCA. It is anticipated that this revised permit application will
be approved in 2007. The information in the annual report for 2006 is reporting on
Chanhassen's approved (2002) permit.
HIGHLIGHTS OF PROGRESS - 2006
. Reduced solid waste and dumping through 5,213 visits to the Carver County
Environmental Center by Chanhassen residents.
. Reduced pollution by recovering 3,500 tons of debris through street sweeping efforts.
. Completed storm sewer map. All.known structures have been identified, inventoried
and inspected. Additional information on new infrastructure, storm sewer pipes and
flows is added as it becomes available.
. Developed storm sewer maintenance and inspection database.
. Conducted 64 documented construction site inspections in cooperation with the
Carver Soil and Water Conservation District. Inspections have dramatically
increased compliance at construction sites. Many inspections of individual homesites
also occurred.
. Initiated soil sampling program within parks to assist with soil fertilizing needs.
. Reviewed storm water management, erosion and sediment control, and wetland
ordinances to begin ordinance amendments in response to the Surface Water
Management Plan (SWMP) update.
· Recycled 1,125 gallons of used oil from public works operations.
. Mailed between 400 and 600 notices to remind residents to have septic systems
pumped. Two systems were identified as failing.
. Maintained natural resources web pages, which received over 9,000 web hits.
. Included 9 articles relating to stormwater quality in the Chanhassen Connection
. Contributed to 5 newspaper articles related to water resources in the Chanhassen
Villager
ADDITIONAL ACCOMPLISHMENTS - 2006
. Adopted Second Generation Surface Water Management Plan.
. Installed new culvert under trail at Stone Creek Drive and Bluff Creek to better
accommodate large flows.
. Constructed Phase I of rain garden project at Lake Ann Park (grading).
. Cooperated with Riley-Purgatory-Bluff Creek Watershed District in the
reconstruction of 5 stormwater ponds in the Lake Riley and Rice Marsh Lake
subwatersheds.
. Cooperated with Plowshares Development, Inc. to construct (1) and expand (2)
stormwater management ponds in the Stonefield development and Power Hill Park.

. Completed projects to resolve drainage issues near Hillsdale Court and Harrison Hill
Trail in the Longacres neighborhood.
. Adopted slow/no wake ordinances to protect Lake Susan and Lotus Lake during times
of high water.
FUTURE PROJECTS - 2007 to 2008
. Complete ordinance updates associated with the adoption of the Second Generation
Surface Water Management Plan.
. Enlarge stormwater pond in Curry Farms Park to provide additional water quality and
water quantity benefits.
. Install curb and gutter, storm sewer and stormwater ponds in Koehnen/Yosemite area.
. Stabilize drainageway in Greenwood Shores subdivision.
. Construct raingardens and stabilize drainageway in Lake Riley Woods subdivision.
. Complete Phase II of raingarden project at Lake Ann Park (planting).
. Install curb and gutter, storm sewer and stormwater pond in Dogwood Road area.
. Complete 3 lakescaping projects to protect City infrastructure on Christmas Lake,
Lake Susan and Lotus Lake.
. Conduct a feasibility study for improvements to Triple Crown Estates stormwater
system and begin improvements.
. Cooperate with the Riley-Purgatory-Bluff Creek Watershed District to stabilize
portions of Lake Susan shoreline.
. Cooperate with the Riley-Purgatory-Bluff Creek Watershed District to improve water
quality in Lotus Lake watershed.
RECOMMENDA TION
Staff recommends the City Council hold a public hearing to consider public input on the
City's Storm Water Pollution Prevention Program and 2006 Annual Report.
Staff recommends the City Council adopt the following motion: "The Chanhassen City
Council authorizes the Mayor to sign the City's NPDES Phase IT 2006 Annual Report, as
attached to this report."
