CONSIDER APPRQVAL OF THE 1995 BI.]DG~F/DEBT ANALYSIS. Gerhardt: Mr. Chairman, if we could modify the agenda and switch 3 and 2 around. Let Brad go early and Don can finish his dinner. Boyle: Well sounds okay to me. ~)N$_mER MODIFYING THE REBEVELQ~ AGREq~t'ENT WITH DF_AN · ,q)HN$0N ON OAK PONDS DEVELOPMENT, Gerhardt: Under this item, if you remember the project was broken out into really a variety of different phases and on the back we looked at the document that shows the dark highlighted areas. You'll notice with the dark lines outlined and these are the owner occupied townhouses that is out there fight now. And Mr. Johnmn was planning on just do.' ~mg Phase I of that... What we did not take into consideration was the demand and success thai Mr. Johnson had in marketing these and the demand for this type of housing in Chanhassen. He is right now has sold all 92 units. Or 90 units in both phases I and II and he says that Mr. Johnson, based on his marketing of those properties, finding those individuals that are interested and also just the demand out here for this type of housing. In light of that we are looking at restruc~g Mr. Johnson's deal. Well before we get into that, we kind of looked at the whole picture of this area. Then you get into the second phase of that to the north, which showed 102 rental units to the north. Brad Johnson: 104. Housing and Redevelopment Authority - November 10, 1994 Gerhardt: 104 rental units. Boyle: Is that both phases Todd? Gerhardt: Yeah, Phase I and H. And those were all rental units and some of the problems that you've been seeing fight now in the rental industry, and Brad can talk a little bit more about this. He's been doing some projects down in...or Austin and Duluth and just finding the financing and the people that can take this projeclt on, it's been real difficult. And we kind of found this out as we're working with the senior housing project. So in light of that, staff met with Brad and Mr. Johnson, oh probably 3-4 months ago and talking about the availability of what his Phase HI over here, we're proposing to put senior housing. That was going to be 14 or so low townhouses in that location, and those were going to be owner occupied. And those aren't really the type of units that Dean is familiar with and he was looking, or we suggested to him that we trade the density of the rentals on this side and move those over onto the Phase III side for the senior housing and that he may looking at coming in on this development and put in owner occupied townhouses with a value of $140,000.00 up to $180,000.00. He was amenable to that idem Boyle: So there would be no rental then Todd, is that it? Gerhardt: The only rental that would be there would be the senior housing project itself. Boyle: Which is Phase IH? Gerhardt: Correct. At our last meeting you approved a purchase agreement for that Phase HI land. The true price of that land is $140,000.00. The purchase price that you approved at the last meeting was $100,000.00. The other $40,000.00 we lumped into the second phase of the 54 units, or the first phase of the owner occupied as a cash payment to them in 1995 as part of that purchase agreement. Contingent upon senior housing would be approved in the Phase HI setting. And the reason for that is that helped the performa of the overall rent's't~ucture for those units in there. And if you remember those members that attended the performa presentation in the senior center, the seniors were quite concerned regarding rents. Gary Fields from Springsted presented the estimated rent goals for that. With that staff has been working on trying to figure out ways of trying to bring the rents down and subsidizing them and this is one approach that we thought the HRA could assist in bringing the overall development costs down. But the project should pay a fair price for the land and we think that $100,000.00 is a fair price. Boyle: Todd would you explain to me one more time the $40,000.00. Where that came from or what, I didn't get it. It went over my head. Housing and Redevelopment Authority - November 10, 1994 Gerhardt: Okay. The land in which the senior housing project is going to sit on. that has got a true price of what Don and I negotiated with Mr. John~n, a purchase price is going to bo $140,000.00. $40,000.00 of which would come directly, out of the HRA...tax increment and be paid to Mr. Johnson through the private redevelopment contract and then the other $100,000.00 coming from the project itself. Boyle: Okay. Okay. I (At this point the quality of the recording was very poor and hard to understand.) Gerhardt: ...The true cost of the land of what Mr. Johnson would sell it for is $140,000.00. Chmiel: That went up $40,000.00 from what it was before when we looked at it? Gerhardt: No. I think we were always around $140,000.00. What we were planning to put back in the project was $110,000.00...so what the bank would allow him to sell that for and the $140,000.00. Brad Johnson and Don Ashworth made statements which were not picked up by the tape. Bohn: Originally when he first opened up...small unit is $130,000.00 and the next time I went over there to talk to him, it went up another $10,000.00 and then every time I went over there it was another $10,000.00. Brad Johnson: You know what he's finding is that people that are buying are adding. Adding a lot of extras to the houses... Boyle: Mike, is there anything you'd like to add? Mason: No. This looks okay to me. Boyle: Don. Gerhardt: In Phase H... Boyle: That same would apply then between the Phase I and proposed, isn't that true? Chmiel: On that Phase H current agreement to...being that there's only $10,000.00 difference in the cost and thaCs the payment for the roadway improvement, which would be in front of this facility. Is that included into Phase II from the...or just strictly Phase II? Housing and Redevelopment Authority - November 10, 1994 Gerhardt: Yes. Boyle: Sim? Questions or comments? Bohn: No. Boyle: Charlie, I know you just came in on this but I'm sure you've probably studied the packet and did you have any questions or comments? Robbins: Well I guess just going by what, you know the phrase you made... Boyle: Are you looking for a motion? Todd Gerhardt made a comment. Robbins: So moved. I will motion on both the items... Boyle: And that is modifying the redevelopment agreement? Robbins: Modifying the DA as well as the first...to reflect the change as well as the... Mason: Second. Robbins moved, Mason seconded that the Housing and Redevelopment Authority approve the proposed change to Dean R. Johnson Private Redevelopment Agreement Phase H for the construction of 51 units of owner occupied townhomes. All vo~ed in favor and the motion carded ummimously. ~ONSIDER APPROVAL OF THE 1995 BUDGET/DEBT ANALY~I~, Don Ashworth presented the staff report on this item. (Good quality on the tape returned at this point in the discussion.) Boyle: Sometimes you don't know whether it's $400,000.00 or $2 million or whatever else. This has been very helpful. Especially when the decision making process comes to other items. Sim. Bohn: No questions. Housing and Redevelopment Authority - November 10, 1994 Boyle: Don? Do you have comments or questions? Chin/el: No. Boyle: Mike? So I guess we need an approval. Do you need a vote to approve the budget/debt analysis? Ashworth: You don't need one for...but you do need one. Boyle: For the budget. Ashworth: ...budget. Boyle: At our last meeting we did discuss the 1995 budget somewhat. Todd, did you have any comments on this or anything you wanted? Gerhardt: No. Nothing's changed from the last presentation. What was brought up at our last meeting was what's an objective. What's the balance. I think you wanted to see where we sat there before you reviewed the budget... There's really no major changes to the '95 budget from last year. The '94 we estimate...fees for service and what took us over the top there was time spent with the vision process... Boyle: Charlie, you weren't at the last meeting. Do you have any questions or comments regarding the 1995 budget? Robbins: The comments would be just more of an observation, and nothing could change these but it appears there's not a lot of control with the income because wek, e got income coming in from wherever a project's coming in so we can't control that And most of the expenses are basically driven by how big a debt on the bonds. And plus the allocations, you know by the expenditures of the manager anti ..so the remainder of those, in terms:~f my comments are it's just, most of it's given anyway. I mean we're just following guidelines from year to year, right? Gerhardt: It was brought out at the last meeting, you had concerns regarding personal services. What happens when the district collapses and we claim that the revenues and the taxes that come back on would be enough to cover those salaries. That was one of the big things that Mike and Sim brought up. Bohn: I have a question. Are we going to be spending as much money next year as we did this year on consultant services? Boy we spend a lot of money on consulting. Housing and Redevelopment Authority - November 10, 1994 Ashworth: I would hope we wouldn't. Boyle: But didn't a lot of that relate to Vision 2001 Ashworth: Yeah, that was a big item. The entry monuments. I think you've gone to a point there where there's no use re-analyzing it. If you want to pick up some part of it and say, well let's go with landscaping. Let's go with the~ign element. Whatever you want to pick up, we should be able to take and bid that withofit having to go back through a lot of the consulting services. Unless you decide you'd like to go a whole new direction. Boyle: I don't think we're going to do that. I just have one comment. On the promotional services, should that really be a primary role of HRA to fund banners, fireworks, music in the park, etc? Ashworth: Really that budget is State Statute. Exactly...a city should not do that but right in the Statutes it says that is a function for HRA. I think they. were looking really more, not necessarily promoting the town through 4th of July but more of a promotion of individual businesses into the community. But it's pretty specific that HR has that authority and ...responsibility. Gerhardt: The Star City program that you see some of the...as a pan of your getting that sign, you have to put a promotional tape for your community together and we have one that we've been in the process of updating on that and pay for things like that. You're taking it a step farther when you draw people into the community that hopefully will spin off and go to some of the businesses and help our business community here. Boyle: It relates. I accept it. Don, would you like to make any comments? Chmiel: No. I'm fine. Boyle: Okay. So I guess I need, if there's no other comments, a motion to approve the 1995 budget as presented. Bohn: I'll make a motion we approve the budget as it was amended. Boyle: May I have a second? Chmiel: Second. Boyle: Charlie, you want to discuss? Housing and Redevelopment Authority - November 10, 1994 Robbins: Comments. With regards to the budget, again we're doing one for '95. Pm also assuming, as is a lot of other budgets, is that we can also look at the, should we say the budget for expenses quarterly and see exactly where we stand. If we want to modify it upward or downward for things we can control, i.e. back to what the Highway 5 Corridor, Vision. In other words, those are things we can control the amount of expenses we want to expend on so we can control that, correct? So we could modify this budget again quarterly. Ashworth: Once adopted by yourself and then agreed to by the City Council, you couldn~ modify it upwards without their approval. You could modify it downward. Chmiel: Yeah, once you establish a total dollar figure, thafs your figure but you can always go less than what that's existing. Robbins: So what we're showing is the cap, not the, okay we're showing the cap then? Ashworth: Yes. You know the building permit revenue has been significantly higher in 1994 than we had originally anticipated so in a similar fashion I had a cap there. I simply went back to the City Council and said, you know we're doing much better here. What I would ask is that you consider modifying to increase both the revenue and the expense to allow me to put on two additional inspectors, and they agreed. Robbins: But by us saying we agree to the budget now do we still have the same, should we say options to do that and modify it both upward and downward if it goes back to Council? Ashworth: Well once it's approved by Council, that represents a cap until the City Council would agree to a new cap. Did I do better in saying it that time? Boyle: I understand. We would have to make a presentation to Council with the rationale to change the budget. . ..:. .' . Chmiel: Yeah. But you're not getting any more dollars so I don~ know how you could revise it up. Bohn moved, Chmiel seconded to approve the 1995 budget for the Homing and Redevelopment Authority. Ali voted in favor and Ihe motion carded ummimously. ~kPPRQVAL OF BII.l.q_: Bohn: This $6,000.00 Hoisington, that's Vision 2000? Housing and Redevelopment Authority - November 10, 1994 Gerhardt: That's probably about 3/4 of your newsletter is in there. Chmiel: 3/4 of the newsletter? Gerhardt: Yeah. What he made, the printing and all the Vision input. Chmiel: That last one that we had? Gerhardt: No, there is more coming that is in the process. Boyle: And the gentleman that made the presentation last night from the survey results is this, thafs not in here is it? Gerhardt:. Yeah we paid him, we had to pay him up front. Chmiel: He's the Chairman of the Republican Party. He's smart. Boyle: Will that do it? Mason: Was he really? Chmiel: Yeah. Mason: I didn't know that. Boyle: Any other questions? Okay, can I have a motion that the bills be approved? Mason moved, Bohn seconded lhat the bills for the Housing and Redevelopment Authority be approved as presented. All voted in favor and the motion carded. Boyle: Any miscellaneohs? Bohn: Yeah, I have a couple of questions for Todd. Has there been any inquiries on our property next to the new bank? Gerhardt: We've been working with Charlie James and... Boyle: Bohn: Consider what, I'm sorry Todd? Purchasing that property next to the bank. Housing and Redevelopment Authority - November 10, 1994 Gerhardt: Charlie has interest in purchasing the land next to Americana Bank so... Bohn: If ifs anything like Byerly's. Gerhardt: He's got some users that Byerly's won't let him use over here so he's looking at trying to put them down there. Boyle: Interesting. Bohn: I have another question for you. What turned Bachman's from not coming to Chanhassen? Chmiel: Well they are here. Bohn: No. They originally were going to, that store thais in Eden Prairie, they were looking at Chanhassen at one time. Gerhardt: The only thing I can think of is the spot where they wanted it maybe was Outlet B at Target and ifs just not big enough. They have about 3 acres there and I think they needed well over 4. And if you look at that Eden Prairie store, ifs a fairly big store. And I don't know how well that would have laid out on that spot with the Highway 5 corridor study and they've done a nice job of laying it out but ifs...how that greenhouse is going to look and things like that. Because you're going to look right down on top of it. They can screen a lot of their back of their building with mulch and things that they have in the back for loading. Trucks. Ashworth: The Planning Commission might go nuts if you had 30 trucks... Gerhardt: But we did not discourage them. I don't think they really showed an inte.rest. They wanted to be as close to 494 corridor and Eden Prairie is closer to that. They've gbt'more of a population base surrounding them too so I heard...tried to get them here but they wanted it in Eden Prairie. Mason: I've got a meeting at 7:00 so I don't care if this meeting goes another half hour or not. lust kidding. When is the lIRA going to tackle affordable housing in this city? When are we going to do it? When are we going to quit talldng about it and when are we going to say, or ask staff or whatever, because I honestly don't know what can we do to see if we can do anything about affordable housing or not? Housing and Redevelopment Authority - November 10, 1994 Robbins: You know, not to play the devil's advocate but in terms of the term affordable housing is, there's a lot of meanings to a lot of. Mason: I'm not talking, and that needs to be clarified. Robbins: Sust wait. First of all we have to define the term affordable housing. That's one aspect. Mason: Fine. Robbins: Okay. So then we've got to determine, not we but in terms of you know physically, you know what land. If we can say we want to put it in or have everybody commit to it, but if there's no space, then we're kind of barking up the wrong tree here. Mason: I agree. Robbins: So you save those aspects. And thirdly, there might not be a developer or builder that really wants to do it. Mason: That could be. That's why I'm asking the qdestion Charlie. Robbins: So those are some issues to consider before we say want to do it. You know it's like saying, if we're selling apples and no one's buying apples, they all want oranges, we've not done a thing. Mason: Yeah, I believe what I said is, when are we going to tackle the issue of affordable housing. Robbins: But I think the question, the way I'm saying it in a kind of round about way, do we tackle that or do they come to us and we help them tackle the question? I don't khbw the answer. Mason: Well I think we need. Chmiel: Who initiates it is the issue. Mason: I think we need to initiate it becaus~ knowing what Myron Orfield wants to do and this, that and the other thing, I think we've got to stay ahead of it. And you know, I agree with every one of your issues by the way. And that's almost the preliminary work to taking a look at this but I think if we aren't on the front of that, it's going to get forced on us one way 10 Housing and Redevelopment Authority - November 10, 1994 or the other. I mean I just, in what little chance I've had with Workman and what Irv Anderson is saying about Orfield's stuff getting passed, and this, that and the other thing. Chmiel: I don't think we're going to see it now. Mason: Well I think you're fight but oh, I think it's clear that Carlson would veto something like that but still, I had that uninitiated for me, I .was asked that by more than one person on the campaign trail this last time and they made i~ clear, and look. I don't want low income but that line about my kid can't afford to live in Chanhassen. Chmiel: I think what Mike is saying basically is whether it be, not be individual units, homes per se but maybe looking at condominiums with the ownership aspect. Boyle: I would assume then that staff would have to be directed to investigate property and maybe developers that would be interested in undertaking that type of project. I think that would be the first step. I don't know. I'm askinl~ Mason: I don't know. That's why I'm throwing it out because I donX know. Chmiel: You don't know until you get the prices back or find out those kinds of things, and thafs true. You go out to talk to developers and see what they can build or what can be built. I'm not saying slum jobs either... Mason: Oh no, no, no, no, no. Robbins: That's what I was saying is that word, and I'm in the lending business for doing these things, is that the word affordable housing has got a connotation different to all of us. I mean every one of us can come up with another...I don't know the answer. I just want you to bear in mind as far as a position. What is it? What is it? Is it low income or is it medium income or is it low to moderate? Is it looking at money funded through the MCDA'or through the MHFA money programs which I'm actively involved with, for doing those. Which are low income property. In other words, there's not an answer that says "affordable housing", we want it because we don't know the answer. Mason: Well okay. So then how do I or Council or lIRA, if that be the pleasure of this agust body, initiate something like that to go on some exploratory mission, just to see what's out there. I don't know. But I'd like to find out. I am worried about people not being able to, I mean you've got people working at Victory Envelope, all of these places, that can't afford to live in this town and I have some trouble with that. But again, I don't know what to do about it and I'd like to find out. ll Housing and Redevelopment Authority - November 10, 1994 Ashworth: The work efforts to provide the answers to the questions you're asking here are at least 90, if not 95% complete. We can reasonably come before your next agenda with the survey work, as far as the number of employees that work in Chanhassen and what their needs for housing is nearly completed. The inventory of the lands available in Chanhassen to house affordable housing is complete. The gentleman who will bring it in front of you is named Jim Winkles. He has done affordable housing throughout the state. He's excellent. He's been working on this project for quite a period of time. He can go through some of the different options and discuss the...with Mr. Robbins which programs that he has had the best success with and I sincerely believe that we can do that for your next meeting. Bohn: Winkles, didn't he talk to us once before? Mason: I was going to say, that name rings a bell. Chmiel: Yes. Ashworth: He was associated with, he broke out of the housing area and went over into the private side and he was involved with the Brooks deal over here. I don't think he considers that kind of a... Mason: Well I'd like to see it on the agenda. I'm speaking for myself obviously. Bohn: Affordable housing is if you can buy the affordable land to build it. Mason: Well yeah. You know are we talking subsidies or what? Boyle: Well I think the answers, like Don said, about 90% of it's done. That's bringing us up to date and then we go from there. Mason: Super. Rezhingle Old St. Hubert's Church - Take and award bids February - March - Start construction March - April - Completion in July crrY OF CHANHA$$EN CARVER AND HENNEPIN COUNTIES, MINNESOTA ORDINANC~ NO. 212 AN ORDINANCE AMENDING CHAPTER 20 OF THE CHANHASSEN CITY CODE, THE CITY'S ZONING ORDINANCE, ESTABLISHING HIGH~AY CORRIDOR DISTRICTS THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS: SECTION 1. Section 20-1 of the Chanhassen City Code is amended by adding the following definitions: Landscape means all forms of planting and vegetation, ground forms, rock groupings, water features and patterns, and all visible construction except buildings and site furnishings. Site Furnishings means any structure, other than buildings, visible from any public way, and any street hardware located in streets and public ways and outside of buildings. Section 20-110 of the Chanhassen City Code is amended by adding subparagraph (7) to read: Within the HC districts, consistency with the purpose, intent, and standards of the HC districts. SECTION 6. Section 20-116 of the Chanhassen City Code is ~ed by adding subparagraph (e) to read: Within the HC districts, the standards for the HC districts shall apply in addition to the standards specified in this division. SECTION 7, Section 20-118 of the Chanhassen City Code is amended to read: Sec. 20-1 1 8. Retaining Walls. Retaining walls exceeding five (5) feet in height, include state walls which cumulatively exceed five (5) feet in height, must be consuucted in accc~lance with plans prepared by a registered engineer or landscape architect and in conformance with all building materials specifications and limitations set forth in this division or, ff applicable, in the HC districts. SECTION 8. Chapter 20 of the Oumhassea City Code is amended by adding Article XX]X to read: ARTICLE XXIX.HIGHWAY CORRIDOR DISTRICTS DIVISION 1, HC-1 DISTRICT Sec. 20-14150. Purpose. The Highway 5 Corridor'and the development within it will be major factors influencing the visual and environmental quality of the community as a whole. Due to the intensity of land uses, the Highway 5 Corridor represents the heart of Chanhassen as well as its dominating image of those passing through the community. Development in the corridor must be designed with greater sensitivity to the environment and of generally higher quality than might have occurred in the absence of specific standards. The purpose of the District is roi (a) Protect creek corridors, wetlands, and significant stands of mature trees through use of careful site design, protective easements, sensitive alignment and design of roadways and utilities, incorporation of natural features, landscaping and massing of trees that enhance existing natural features and views, and the practices delineated in the City's Best Management Practices Handbook. Co) Promote high-quality architectural and site design through improvement development standards within the corridor. These standards govern site planning, placement of building masses, use of materials, and the like enable the City to enhance what otherwise might result in low quality strip development. (c) Create a unified, harmonious, and high-quality visual environment throughout the corridor, thereby identifying it as a special place with a unique identity within both the City and the Twin Cities region as a whole. (d) Foster a distinctive and positive community image, for the City as a whole and especially for the Highway 15 Corridor, which functions as the City's main entrance. Sec. 20-1451. Intent. The City intends that all development within the district should strive toward the highest level of quality in both design and construction. The criteria by which new development in this district shall be judged are as follows: (a) Consistency with all provisions of the Comprehensive Plan, as amended from time to time; the Surface Water Protection Program; all provisions of the Zoning Ordinance and Subdivision Ordinance not specifically overridden by the provisions of this district; and all other applicable land use regulations. (b) Preservation of the natural conditions found on each site to the greatest extent possible, through minimized removal of trees and other vegetation and soil, minimized site grading, and application of the practices found in the City's Best Management Practices Handbook. (c) Establislunent throughout the disu'ict of harmonious physical and visual relationships among existing, new, and proposed buildings, open spaces, natmal terrain, and plant materials and placement with the intent of creating a unique and unified appearance for the entire corridor. (d) Usc of appropriate materials, lighting, textures, colors, and architectural and landscape forms to create a unified, high-quality design concept for each site that is compatible with adjacent and ncighbo~g structures and functions, including but not limil~ to natural areas, City-owned property, and vacant land subject to future development in accordance with the Comprehensive Plan. (e) Creation of unified site desi~on.% each with a sense of inlernal order, that provide desirable environments for gte users and visitors and the community as a whole and that consider all site elements including: the relationship of tmildi,~gs to surrounding landforms; grading; architectural design; building, parking and loading dock orientation; building height; use of man-made matedah, including paving; site fumishlv~gs (lighting, outdoor seating, signage, etc.); landscaping (retention of natural vegetation, plant selection and placement, retention and incorporation of water fca~, etc.); and other visible outdoor site elements. (f) Creation of a suitable balance between the amount and arrangement of open space, landscaping, and view protection and the design and function of man-made features on the other. Achieving this balance shall take into account screening, buffering, size and orientation of open spaces, personal and property security, localized wind and solar effects, and protection of important public ways. (g) Provision of safe and adequate' access to and from sites giving ample consideration to the location and number of access points from public streets, the safety and convenience of merging and turning movements, and lraffic management and mitigation. (h) Provision of on-site vehicular, bicycling, and pedesuian circulation by way of interior drives, parking areas, pathways, and walkways adequate to handle anticipated needs and to safety buffer pedestrians and cyclists from motor vehicles. Ample consideration shall be given to the width of interior drives, internal traffic movement and flow, separation of pedestrian, cycling, automobile, and delivery lraflic, and the safe convenient, and practi~ arrangement of parking spaces. (i) Adequate separation and protection of each site from adjacent properties, access boulevards, and Highway 5 and vice-versa, through reasonable provisions for surface water drainage, sound and sight buffers, view protection, privacy, and other aspects of design that may not be specifically covered by these or other regulations but are found to have significant effect on any or all of the properties and roadways. Sec. 20-1452. District Application. The "HC-I" district shall be applied and superimposed (overlaid) upon all zoning districts as contained herein as existing or amended by the text and map of this ordinance. The regulations and requirements imposed by thc "HC-1" district shall be in addition to those established for districts which jointly apply. Under the joint application of the districts, the more restrictive requirements shall apply. Sec. 20-1453. Building and Parking Orientation. (a) For the purpose of determining front, rear, and side yards, the following shall control: 1, In any lot that abuts Highway $ directly, other than a single family residential lot, the lot line abutting the highway shall be considered the front lot line. In any lot that abuts either of the access boulevards parallel to Highway 5, including any existing single family residential lot, but excluding any new single farnily residential lot, the lot line abutIing the boulevard shail be considered the front lot line. In any lot that abuts both Highway 15 and one of the access boulevards, other than a single family residential lot, the lot shall be regarded as having two front lot lines. The lot line abutting the boulevard shall take design precedence. Such a lot shall be regarded as having no rear lot line or yard. No new single family residential lot may have a front yard that faces Highway 5, nor a front yard that faces either of the access boulevards. No new or existing single family residential lot shall provide driveway access directly from Highway 5, nor shall any new single family residential lot provide driveway access directly from Highway :5 or either of the access boulevards. FRONT LOT LINE Co) Parking areas shall not be locnt~ within the required minlmnm front (primary or secondary) ynrd setbnck of nny lot. Sec. 20-1454. Architectural Design Standards. BU~.D[NC SETBACK Standards governing architectural design shah apply to an new'and renovated buildings within the district with the exception of single-family residences on individual lots. (a) Architectural style shall not be restricted. Evaluation of the appearance of a project shall be based on the quality of its design and on its relationship to its surrotmdings, guided by thc provisions of this section. Site chara~tics to bc evaluated for this purpose include building and plant materials, colors, textures, shapes, massing, rhythms of building components and details, height, roof-line and setback. Designs that are incompatible with their surroundings or intentionally bizarre or exo~c am prohibited. Co) Monotony of design, both within projects and between any project and its surroundings, is prohibited. Variation in detail, form, and siting shah provide visual int~'e~ Site characteristics that may be used for thi, purpose include building and plant matn-ials, sizes, colors, textures, shapes, massing, rhythms of tmilding components and details, height, roof-line, and setback. AvorDI~G MONOTONY (¢) Within the district, particular attention shall be paid to architectural compatibility with the existing environment. (1) Each building shall contain one or more pitched roof elements. (2) All new construction and redevelopment shall conform to the established building scale, range of building materials, pedestrian orientation, and relationship between buildings and the streetscape. (d) Building heights shall be limited to three (3) stories or forty (40) feel Measurement of the highest point shall exclude antennas for television and radio reception, but shall include architectural details (e.g., parapet walls), transmission antennas, satellite dishes and transmission equipment, microwave-transmission equipment, and other non- slructural building elements. (e) All man-made architectural, landscape, and paving materials shall reflect the highest quality possible and should be used in a manner suitable to the nature of the material, its role in the design, general durability, expected level of use or abuse, weathering characteristics, and ease and frequency of maintenance. Major exterior surfaces of all walls shall be face brick, stone, glass, stucco, architecmr~y treated concrete, cast in place or pre-cast panels, decorative block, or approved equivalent, as determined by the city. The following may not be used in any visible exterior application except when specifically permitted by the City in areas with limited public view: Exposed cement ("cinder") blocks. Fabricate metal or pole conslrucfion statures, including mobile homes, sheds, warehouses, and industrial buildings cons~ either on or off-site of corrugated metal panels. Exterior brick that is painted over. Experimental materia~ with no proven record of durability or ease of maintenance in the intended application. A solid wall unrelieved by architectural detailing, such as a change in materials, change in color, fenestrations, or other sigr~ificant visual relief provided in a manner or at intervals in keeping with the size, mass, and scale of the wall and its views from public ways. A change in texture alone is not sufficient to meet this requirement. Materials or construction methods used for one aspect or portion of a project that are significantly lower in quality than those used for the balance of that project, such that this one aspect or portion is or rapidly becomes an eyesore or detriment to the project as a whole. A distinct and different material or combination of materials for each exposed exterior wall. No more than two (2) principal materials or two (2) principal combinations of materials should be used to construct any one building. Addition of other materials for accent use is pemfissible. As building element, combination of elements, or another site suvcttue that acts as a conspicuous building emblem or signnture. Examples include single garish elements (e.g., orange roofs); use of bricks, blocks, or tiles to turn a wall into an outsized sign or logo; and other attmnpts to use a b~ildi~g or wnll as an (f) Site designs and configurntions that tend to catch and accumulate trash, leaves, and dirt shall be avoided. In nddition, provisions for washing and cleaning buildings, other structures, and building grounds shall be considered and included in the design. (g) All building components, such as windows, doors, eaves, soffits, and parapets, shall have good proportions that relate to the facade of the building and shall relate well with one another. PROPORTIONS OF B[JILDING COMPONENTS (h) Colors shall be harmonious. Bright or brilliant colors and sharply contrasting colors may be used only for accent purposes. USING COLOR (i) Mechanical equipment, satellite dishes, and other utility hardware, whether located on the roof or exterior of the building or on the ground adjacent to it, shall be screened from the public view and with materials identical to or strongly similar to building materials or by heavy landscaping that will be effective in winter or they shall be located so as not to be visible from any public way. Use of parapet walls or pitched roof elements to screen equipment is encouraged. In no case shall wooden fencing be used as a rooftop equipment screen. O) Screening of service yards, refuse, and waste-removal areas, loading docks, truck parking areas, and other areas which tend to be unsightly shall be accomplished by use of walls, fencing, dense planting, or any combination of these elements. Screening shall block views from public right-of-way and shall be equally effective in winter and summer. EN FENCE OR W'ALL ~CREEN FEI,,ICE ORWALL lO $~. 20-1~55. Landscape Design and Site Furnishings. The following standards governing design and placement of landscaping and site furnishings shall apply to all new and renovated buildings withiu the district, with the exception of single family residences on individual lots. (a) Where natural or existing topographic patterns contribute to the beauty or utility of a development, they shall be preserved to the greatest extent possible. Modification to topography will be permitted where and to the extent that it contributes to good design. All topographic modifications shall adhere to the practices delineated in the City's Best Management Practices Handbook. : PRESERVING TOPOGR. A~HY (b) The grades of all walks, parking spaces, terraces, and other paved areas shall conform with the requirements of the Americans with Disabilities Act. In addition, they shall provide an inviting and stable appearance from w,l~ing. Stairs and ramps may be substituted for slanted pavement when necessary. (c) All landscape shall preserve and enhance natural features (such as wetlands, drainageways, mature stands of trees, and the like), enhance architectural features, strengthen vistas and important axes, and provide shade. (d) Landscaping shall emphasize massing of plant mam'ials over isolated or scattered placement of individual specimens. Reforestation as prescribeA by the City's Tree Preservation and Reforestation Ordinance is encouraged. LANDSCAPE MAssrNG 11 (e) Unity of design shall be achieved by repetition of certain plant varieties and other materials, and by correlation with natural existing rnateria~ and adjacent developments where appropriate. UNITY Ol= DESICN (f) Plant material shall be selected for intere~ in its structure, texun'e and color, m~d for its ultimate growth size. Plants that are indigenous to the area and others that will be hardy, harmonious to the design of good appearan~ and of relatively easy maintemmce shall be used. (g) In locations where plants will be susceptible to injury by pedestrian or motor traffic, they shall be protected by appropriate cm'bs, tree guards, or similar devices. (h) Where building sites limit planting, the placetrmat of trees in parkways, gardens, or paved areas is encouraged. Trees should be clustered whenever possible, and consideration shall be given to the special needs of plants surrounded by impervious mufaces. 12 (i) In areas where general planting will not prosper, other solutions--such as fences, walls, rock gardens, raised planters, or parings of wood, brick stone, gravel, or cobbles--shall be used. Carefully selected plants shall be included. · - IKICX ALTERNATIYE LANDSCAPE TREATMENT (j) Exterior lighting shall enhance thc building design and adjoining landscape. Lighting standards and fixtures shall be of a design and size compatible with the building and adjacent areas. Lighting shall be arranged and focused so that minimal light falls on adjacent property and no light shines directly at or into any'adjacent building. Excessive brightness and glare shall be avoided. LIGHTING CONTROl. (k) Site furnishings located on private property shall be designed u pan of the site's architectural concept and landscape. Materials and colors shall be in harmony with buildings, surroundings, and other furnishings; scale shall be appropriate to the site and the design; and proportions shall be attractive. (1) Site furnishings and landscaping located in any public way or on other public property shall be harmonious with the design of adjacent buildings, with the appearance of the highway in the vicinity, and with the generally character of the City. (m) Lighting in connection with site furnishings (e.g., to highlight a ground sign) shall meet the criteria applicable to site, landscape, buildings, and signs. (n) AU provisions of the Chanhassen Zoning Ordinance, to the extent that they directly affect thc appearance, design and utility of a particular site, and to the extent that they do no conflict directly with the standards delineated here, shaU be a part of thc criteria of this subsection. 13 DMSION 2. HC-2 DISTRICt Sec. 20-1460. The purpose and intent of the HC-2 disuict is the same as the HC-1 district with certain modifications to the district standards rdlecting that the area within the HC-2 district is not part of the City's central business district. Sec. 20-1461. District Application. The "HC-1" district shall be applied to and super imposed (overlaid) upon all zoning districts as contained herein as existing or amended by the text and map of this ordinance. The regulations and requirements imposed by the "HC-1" district shall be in addition to these established for districts which jointly apply. Under the joint application of districts, the more restrictive requirements shall apply. Sec. 20-1462. Building and Paridng Orientation. The building and parking orientation standards for the HC-1 district shall apply, together with the following additional requirements: (a) On building lots that abut Highway 5 directly, the minimum bnildlng setback from the highway fight-of-way shall be seventy (70) feet. The maximum building setback from the highway right-of-way for all buildings except single family residences shall be one hundred fifty (150) feel No maximum building setback shall apply to single family residence~ Co) On building lots that abut either of the access boulevards parallel to Highway $, thc minimum building setback from the boulevard right-of-way shall be fifty (50) feet. The maximum building setback from the boulevm'd right-of-way shall be one hundred (100) feet. Sec. 20-1463. The architectural design standards for the HC-1 district shall apply, with the exception of Section 20-1456(c) which shall not apply. Landscape Design and Sil~ Purrdshlngs. The landscape design and site fumishlngs standards for the HC-1 district shall apply. SECTION ~. The boundaries of the districts established by this chapter are delineated on the zoning map; the map and all notations, references, and date shown thereon ar~ hereby adopted and made part of this chapter and will be on pernmnent file for public inspection at the Chanhassen City Hall. 14 SECTION 10. West of the site, the path will follow an alignment extending to -a point just short of Great Plains Boulevard. The path will be located on the north side of an existing small berm, and will require the relocation of at least three spruce and one maple. Grading can be performed on a time and material basis or on a lump sum basis; other work will be at contract unit prices. John Knauf has been informed of this work and can work with you for final layout. At the location of the previous cul-de-sac at West 79th Street, the City desires that the south curb be adjusted to better direct traffic onto the new drive at Hanus. At the same time, the south portion of the entry to the drive should be removed and reconstructed as shown on the attached plan (to better accommodate large vehicles that require access to Brown Automotive). The revised opening to the driveway should be approximately 34 feet, and may necessitate a longer conduit for street light service. The island at the north end of the west side shall be reconfigured to create a 15 foot wide concrete island, rather than a landscaped island. The length of the island shall be modified as shown on the attached drawing. Any landscaping that was to be located here will be relocated to other areas of the site. I marked areas for concrete apron removal last week. We do not have a unit price for this work in the Contract, and will need one for performing the work. The conduit for street lighting shall be installed in locations shown on the attached plan. The conduit shall be two inch p.v.c. (schedule 40), installed at 30" (minimum) below grade. The conduit shall extend three feet past edges of pavements and shall be marked with a #14 copper locater wire brought up to grade at ends. Conduit ends shall be sealed.
