Dear Mr. Generous:
The Metropolitan Council received the City's Old Village Hall CPA on January 12, 2007. The CPA
proposes to change the land use designation for 0.54 acres located south of 78`h Street at Great Plains
Blvd. The purpose of the amendment is to change the land use designation from Public/Semi-Public to
Commercial.
Council staff finds that this amendment meets the Comprehensive Plan Amendment Administrative
Review Guidelines adopted by the Council on May 11, 2005. Therefore, further action on this review is
waived and the city may place this amendment into effect.
The amendment, explanatory materials supplied and the information submission form will be appended
to the city's plan in the Council's files. If you have any questions about this review, please contact Jim

A RESOLUTION APPROVING A COMPREHENSIVE PLAN LAND USE AMENDMENT
FROM PUBLIC/SEMI-PUBLIC TO COMMERCIAL; OLD VILLAGE HALL
WHEREAS, the City of Chanhassen has requested a Comprehensive Plan Land Use
Amendment from Public/Semi-Public to Commercial for Outlot B and the easterly 66 feet of Lot
1, Block 1, Old Village Hall, and
WHEREAS, the Chanhassen Planning Commission held a Public Hearing on January 2,
2007, and voted to recommend approval of the land use amendment, and
WHEREAS, the City of Chanhassen has submitted the proposed amendment to all
adjacent governmental jurisdictions for their review and comment.
NOW, THEREFORE, BE IT RESOLVED that the City Council approves the
Comprehensive Plan Land Use Amendment from Public/Semi-Public to Commercial for
Outlot B and the easterly 66 feet of Lot 1, Block 1, Old Village Hall, contingent on Metropolitan
Council review.
Passed and adopted by the Chanhassen City Council this 8'" day of January, 2007.

Just wanted you to know that our internal reviews are done. The CPA is considered
complete. I am unable to send your an administrative waiver letter until all those
notified have responded or until Feb 16 whichever happens first. FYI - all of the cities
have waived notifications as has the school district. I haven't yet heard from Jackson
Twp, Carver or Hennepin Counties, or the watershed district.

Mayor Furlong: What's the page number on the packet? I think it's page 4. 186 is the

roll.
Councilwoman Tjomhom: Yeah, I make a motion to what he just said.

Mayor Furlong: Second, okay. And that motion is to adopt the resolution adopting the
assessment roll that was distributed in the council packet.

Mayor Furlong: Alright. Any questions or discussion on the motion? Hearing none well
proceed with the vote.
Resolution #2007-04: Councilwoman Tjornhom moved, Councilwoman Ernst seconded to
adopt the resolution adopting the assessment roll for Project 06-05 as presented in the staff
report. All voted in favor and the motion carried unanimously with a vote of 5 to 0.
OLD VILLAGE HALL:
A. CONSIDER AMENDMENT TO LAND USE MAP AND REZONING.
B. APPROVAL OF LEASE WITH SEATTLE SUTTON.
Kate Aanenson: Thank you. Mayor, members of the council. This item did appear before the
Planning Commission on their January 2°d meeting. It was approved on a 7-no vote to approve
the rezoning and the land use amendment. The subject site is the old city hall located on West
78`'. As stated in the staff report you can see Great Plains Boulevard used to go through the
middle of this property and since then we have.
Mayor Furlong: Can you move that up please?
Kate Aanenson: I'm sorry. Thank you. The West 78a', or Great Plains Boulevard used to tie
down across the railroad tracks and the old city hall is actually sitting in that vacated right-of-

way, which is this piece right here. The rezoning actually includes an additional parcel which is
tied to the daycare center there, and to clean up both those properties. The rezoning itself is just
over a half acre and again, I'm not going to go through all the history of the rezoning because it's
a lengthy kind of cleaning up this area. The most recent changes of the Schlenk property which
is, make sure I'm on the camera. This larger area here. Purchased by St. Hubert's for additional
cemetery space, which you see in the additional improvements to that site. And then the pink
area is the actual old St. Hubert's itself, and then the cemetery behind that. The subject site we
were talking again there is the... The piece behind it is actually part of the daycare... so there's a
cross access agreement between the two for parking. Some of the questions that the Planning
Commission had is, if it's office institutional, does that provide enough land use and what would,
if we change it to commercial business, how does that affect the rebuilding or the concerns about
limited parking. Again the building itself is only 500 square feet. It has 4 parking stalls, so
whatever use it ends up ... must meet the parking standards. So as it turns out the City was able to
find a use that matched that up very well regarding limited traffic and a reasonable use for that
property. So with that, cleaning up the parcel, that also ties back to the ... use itself. Staff and the
Planning Commission did recommend approval of the rezoning and the land use amendment.
Those conditions are found on page 4 of your staff report so with that I'd be happy to answer any
questions that you'd have.
Mayor Furlong: Thank you. Questions for staff.
Councilwoman Tjomhom: I just have one question of why the school across the street doesn't
have a public/semi-public zoning instead of it is office industrial?
Kate Aanenson: The Chapel Hills?
Councilwoman Tjomhom: Yeah.
Kate Aanenson: It does have. This piece here.
Councilwoman Tjomhom: And that's, I thought in the packet that it was office industrial.
Kate Aanenson: It's OI. It's office institutional that should say. Institutional.
Councilwoman Tjomhom: Okay,
Kate Aanenson: Which is what we have all of the schools. I believe the new school site will
also be guided and zoned.
Councilwoman Tjomhom: So it's just churches and.
Kate Aanenson: And schools.
Councilwoman Tjomhom: And schools.
Kate Aanenson: Institutional type uses, correct.

Todd Gerhardt: And that's second you have to give it a secondary guiding.
Kate Aanenson: Typically we like to give it a secondary guiding. In this instance we didn't have
that situation, and again there's two difference land uses on there already. The Goddard School,
which again that's that little piece ... and again holding that old right-of-way line. And if you look
at the history of that, we had changed it from, because of the Schlenk's were using it as a
residential from most recently we changed from residential zoning to actual, providing for a
cemetery use. It will be more a park use. So there has been some rezonings, changes in the area
in the public properties that were being used.
Mayor Furlong: Ms. Aanenson, the color coded chart here with the subject property, it's in light
pink now. The dark pink, that is a central business district?
Kate Aanenson: Correct, and this is the office institutional and then the rest is actually the
central business district.
Mayor Furlong: And so the proposal here is to make it part of the red.
Kate Aanenson: That's correct.
Mayor Furlong: And so it's consistent with, okay.
Kate Aanenson: And again at the bottom, the site that ... house is on is actually this little portion
right here and that ... is actually being used by the Goddard School so it makes their zoning
consistent with the PH). Their entire parcel. And again part of that is shared parking, which we
have a cross access agreement so it really makes both uses in the same district compatible with
sharing the parking. Again the Planning Commission thought that was a...
Councilman Litsey: So in essence this is just extending the central business district slightly
more?
Kate Aanenson: That's correct. Yeah, and that's really how it's being used. It does allow for a
little bit more flexibility of the use itself. Of the site itself as opposed to just an institutional type

Kate Aanenson: No, really they can't. You know we're looking at doing a historic zone for
downtown. At this time there's no proposed renovation or public improvements regarding

Laurie Hokkanen: Mayor, the consideration of the lease is for a one year term with Distinctive
Ventures, LLC. They operate a franchise of Seattle Sutton's Healthy Eating, and the way that the
tenant proposes to use the building is that he is open twice a week, currently envisions that'd be
Monday's and Thursdays from 3:00 p.m. to 7:00 p.m.. His clients come to the location to pick up
pre -packaged, prepared healthy meals and they do that twice a week. And we see the benefits of
the lease really as three main benefits to the city. First we'll be taking in the revenue. It's the
lease is set at $450 a month, $5,400 a year. Secondly the city is currently responsible for the
utilities and snow removal for the building, and the tenant will be taking over those costs. We
anticipate that those savings are around $5,000 a year, in addition to the revenue. And then
thirdly as we talked about in the past, it is a benefit to have a tenant in this building. Someone
other than the city keeping a watchful eye over it and making sure that it stays in good condition
so we do recommend approval of this lease.
Mayor Furlong: Thank you. Any questions for staff? One question Mr. Knutson. The lease
speaks to leasing the building commonly known as Old Village Hall so one of the questions I
wanted to make sure is that it is for the building. It's not for the plaza, so the plaza would still
continue to be public.
Roger Knutson: That is correct.
Mayor Furlong: Public space and use.
Laurie Hokkanen: And we have gone over that with the tenant.
Mayor Furlong: Okay. Alright, good. The only other question I had, I didn't see any security
deposit in the lease. Did that come up in your discussions at all?
Todd Gerhardt: We did not negotiate a security deposit but we didn't get the opportunity to call
the tenant today to see if that would be a sticking point. I would recommend adding a one month
security deposit. I don't think that is going to be a sticking point with the tenant, but just wanted
to let you know that we did not discuss that with them.
Mayor Furlong: Okay. Alright. Any other questions or comments? If not, is there, if there's
any discussion overall on either of these two items. Moving forward with the rezoning or
adopting or approving the lease to be signed. No discussion? If not, is there a motion to approve
the recommended motions in items 3(a) and 3(b) subject to the inclusion of a security deposit of

MANAGEMENT PLAN.
Lori Haak: Good evening Mayor Furlong and council members. Over the past 2 years the City
of Chanhassen has been working to update it's 1994 Surface Water Management Plan. The
second generation plan was adopted, was recommended for approval by the Planning
Commission on August 15, 2006 and was adopted by the City Council on August 28, 2006. The
Surface Water Management Plan as revised recommends a number of changes to the standards
that are currently employed by the City and the areas of erosion and sediment control, storm
water management and wetland protection. The recommended revisions to the city code will
really help staff to implement the plan and achieve the goals that are set forth in that plan. The
Planning Commission held a public hearing on December 5, 2006 to review the code revisions
and ordinances and to receive public comment. The minutes of that public hearing are included
in item 1(a) of your packet. No one was present to make comments during that public hearing.

On January 2, 2007, the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of the City of Chanhassen for a land use map amendment
from Public/Semi-Public to Commercial and rezoning of the property from Office and
Institutional, OI, to Central Business District, CBD. The Planning Commission conducted a
public hearing on the proposed land use map amendment and rezoning preceded by published
and mailed notice. The Planning Commission heard testimony from all interested persons
wishing to speak and now makes the following:
FINDINGS OF FACT
The property is currently zoned Office and Institutional, OI.
2. The property is guided in the Land Use Plan for Public/Semi-Public.
The legal description of the property is: Outlot B and the easterly 66 feet of Lot 1, Block
1, Old Village Hall.
4. The Zoning Ordinance directs the Planning Commission to consider six (6) possible
adverse affects of the proposed amendment. The six (6) affects and our findings
regarding them are:
a) The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the official City
Comprehensive Plan.
b) The proposed use is or will be compatible with the present and future land uses of
the area.
c) The proposed use conforms with all performance standards contained in the
Zoning Ordinance.
d) The proposed use will not tend to or actually depreciate the area in which it is
proposed.

McDonald: Mark, why don't we start down with you.
Undestad: No questions.
Dillon: Is there anything that's different? Nothing new is going to go into the spot if it's
rezoned?
Generous: Well there is a personal service use that will go into the property but there'll be no
changes. The use of the site is limited by the parking agreement that we recorded with the plat.
There are 4 parking stalls that are reserved for this use. This site, and that would permit, it could
be a retail use. It could be office use but anything within the CBD, however it's very limited to
building size. It's 500 square feet approximately. We don't see any change. The City's still
going to maintain ownership of it and so well control who we lease this to. However it would
permit the lease agreement to go forward that the City is negotiating right now.

Dillon: So what will this change in zoning do once, if it changes hands and the City doesn't own
it anymore and some private party owns it? I take it, it will be tax value that the City could earn
would go up a lot?
Generous: Well yes, it would go onto the tax rolls but again the site is, it doesn't comply with
the minimum standards so that's why it's an outlot. They can't change anything unless they come
back and get a variance to the standards for a CBD lot. It doesn't meet the frontage requirements
and it doesn't meet the area requirements. So it is very restrictive as to what the use, what
someone could do on the property. Plus they have the limitation on the amount of parking.
Dillon: And there's no other improvements or changes to infrastructure that are being
contemplated?
Generous: Nothing. Internally there'll be some modifications to the building but that's it.
Dillon: That's all the questions I had.
McDonald: Okay.
Keefe: Does the City have a plan to convey the property though?
Generous: No.
Keefe: No. Okay.
McDonald: Debbie.
Larson: Don't have any.
Thomas: No.
McDonald: No? I have no questions or comments either. Is the, well I guess the City is the
applicant, or is there someone else?
Aanenson: No, we're the applicant.
McDonald: Okay. Then in that case, what I would do is open it to the public. Anyone wishing
to make comment on this, if you would please step to the podium and state your name and
address. Okay, seeing no one come forward I will close the public meeting and bring it back up
for the commission for comments. Kurt, we'll start with you.
Papke: I have no concerns with this. It would seem to increase the City's flexibility with what
they want to do with the property and that's kind of the bottom line. We know we still have
control over what we do with it so I think it just increases the options the City has to work with.

slightly smaller than the site location previously submitted because the original map

Thanks for your reply. Based on the numbers given below, I rechecked the Official Plat
map. It appears that you are describing the eastern
66 feet of Block 1 (66 x 356.61) which includes Outlot B. That description and the area
shown on the Official Plat map do not seem to agree with the site shown on the Location
Map that you submitted. It looks to me that the site shown on the location map should be

bigger, with the west line extending all the way to the south (see attached map).
The Location Map site is calculated by our GIS system as being approximately 0.17 acres.
The extended area shown in orange is approximately 0.31 acres. So the two together are
0.48 acres (close to your 0.54 acres noted in your submittal).
If that is accurate, please have your location map redrawn and emailed to me. Thanks.

1, Old Village Hall. The area involved is 66 feet wide by 356.61 feet long, which equals
23,536.26 square feet or 5.41 acres. I will have our GIS person prepare a smaller scale

I'm confused as to the exact property boundaries involved with this CPA as well as the
size involved.
The submittal includes 3 maps:
1. Location Map - Old Village Hall
2. Official plat - Old Village Hall
3. 2020 Land Use Plan
Map 3 does not identify the location of the site in question and appears to show the
'before" or existing land use.
On CPAs we need both the existing and the future land uses shown on 2 different maps and
at a scale that is readable. I'm attaching a sample of a map from St Louis Park FYI
Maps 1 and 2 do not appear consistent with each other. They show different shapes. It is
not clear whether Outlots A & B are included in the site or not. In the form, you
indicate that the site size is 0.52 acres. Our GIS map (attached) which appears to
coincide with your map

and which is based on official Carver County plat data, indicates that the parcel on
"our" GIS map is 0.17 acres.
I suspect that the 0.52 acres that you showed on the form is for the entire area shown in
map 2. It appears to include a substantial area used as Great Plains Blvd. as well as
Outlot A. I would think that the City would want to replat the property shown in map 2,
to remove Great Plains Blvd. as well as Outlot A from the land use change and to make
sure that only the part shown in map 1 is made available for commercial development.
I am withholding sending out the official notifications to adjacent local governments
until I get clarification. The Council cannot act on the plan amendment until 30 days
after it sends out the notifications, so the more quickly you can get back to me on these
matters, the quicker we can process the amendment.

WHEREAS, the City of Chanhassen has requested a Comprehensive Plan Land Use

WHEREAS, the Chanhassen Planning Commission held a Public Hearing on January 2,
2007, and voted to recommend approval of the land use amendment, and
WHEREAS, the City of Chanhassen has submitted the proposed amendment to all
adjacent governmental jurisdictions for their review and comment.
NOW, THEREFORE, BE IT RESOLVED that the City Council approves the

PROPOSAL/SUMMARY
The City is processing a land use amendment and rezoning to permit commercial uses within Old
Village Hall. Part of the problem with the site is that Great Plains Boulevard used to run across the
property before it was realigned as part of the West 78`s Street and Highway 101 realignment. This
66-foot wide area that used to be part of Great Plains Boulevard is shown on the land use map as
public/semi-public and on the zoning map as Office and Institutional District.
The property to the north of West 78th Street and west of Great Plains Boulevard is zoned CBD and
contains the old Kenny's Market building. The property north of West 78th Street and east of Great
Plains Boulevard is zoned OI and contains Chapel Hill Academy. To the east is old St. Hubert's
Church, currently leased by the City. St. Hubert's Catholic Community owns the church and
cemetery. Re/Max constructed a building to the southeast of the site. The railroad and West 79 b
Street are south of the site. Brown's Car Wash, zoned Highway Business District, BH, is on the
south side of West 79"' Street. West of the site is The Goddard School, which is zoned CBD, and
across Great Plains Boulevard is the Chanhassen Dinner Theater, which is also zoned CBD.
The land included as part of the land use amendment and rezoning at one time was part of Great
Plains Boulevard. The intent of the amendment and rezoning is to make all of this development,
The Goddard School and Old Village Hall, one land use and zoning. Additionally, the rezoning will
permit the City greater flexibility in leasing Old Village Hall. The City will retain control of the
uses permitted within Old Village Hall through our ownership of the property. Additionally, use of
the site is constrained by the building size, 550 square feet, and the allocated parking stalls, four.
For example, retail or office uses of the building require three parking spaces. A restaurant use of
the building would not be permitted because nine parking spaces would be required.
Staff is recommending approval of the land use amendment and rezoning of the property.
APPLICABLE REGUATIONS
Chapter 20, Article II, Division 2, Amendments
BACKGROUND
Village Hall was constructed in 1898. This area is in the most historical portion of the City. The
Old Village Hall was formerly known as the Pauly/Pony/Przymus property and was owned by
the EDA. The parcel was 1.15 acres in size. The buildings were removed and the site was
vacant for several years, except for a parking lot and trash enclosure.
In 1998, the City undertook a historic district study of the area. There had been some discussion
among members of the community about leaving this property as open space and there was
strong opposition by the majority of the neighbors to any building on this site. However, this
was not the best site for the preservation of open space, because it was a small, corner parcel. A
building located on the site could be a designed so that it complements the area and is in close
proximity to the street. Also, the existing plaza located north of Village Hall must be preserved
and utilized as a community gathering area. Any new buildings could conform to the common

"old town" design standard with parking located behind the building (south side of property) in
the existing parking lot.
This district included the original St. Hubert's Church and the accompanying cemetery. The Old
St. Hubert's District embodies the history and pride of the downtown and the City. It is a
landmark with a historical reference point for the City's origin and represents center of
community. This site is 1.74 acres in size. The site includes the Old St. Hubert's Church and the
Catholic Cemetery. Old St. Hubert's was built in the 1880s. The steeple on the church has
become a landmark in the area. The site lines to the steeple should be maintained. The cemetery
has additional burial plots and as a use it will always remain as a cemetery. The historic district
standards were not adopted by the City.
In 2000, St. Hubert's purchased the Schlenk property for future expansion of the cemetery. This
property is 1.75 acres in size. The old bed of the railroad tracks was vacated and sold back to the
Schlenks. There are approximately 4 acres total.
The Re/Max building was constructed in 2001. This site was formerly the HIingelhutz/Wilbar
building which was used as an office building. The property that the building sits on is .5 acres
in area with mature trees. The old building was built in 1888 by the Geiser family for a
carpentry shop. The property is zoned OI, Office Institutional and the 2000 land use plan guides
this property as commercial.
On January 27, 2003, the Chanhassen City Council approved the preliminary and final plat for
Old Village Hall. As part of the subdivision, cross -access agreements for Outlot B and the
Re/Max site were recorded across Lot 1 and a parking agreement for Outlot B was recorded
against Lot 1.
On May 27, 2003, the City approved a land use map amendment from Residential -Medium Density
to Public/Semi-Public, rezoning from RSF, Single Family Residential and OI, Office Institutional,
to A2, Agricultural Estate District, a conditional use permit for the use of the property as a
cemetery, and site plan review for St. Hubert's Cemetery. It is surrounded by open space and
mature trees with a charming flower garden that greets those who enter the heart of the city.
Access to the site is via West 78`s Street. In addition, a pedestrian bridge should be constructed
over the existing railroad tracks to provide a connection from West 78th Street to the pedestrian
bridge over Highway 5.
On October 11, 2004, the City approved Site Plan 04-32 for an 8,068 square -foot building to
house The Goddard School on Lot 1, Block 1, Old Village Hall.
REZONING
The proposed rezoning of the property will make the entire Goddard School site, Lot 1, Block 1,
Old Village Hall, one zoning designation as well as making the zoning of Outlot B containing
Old City Hall the same zoning.

RECOMMENDATION
Staff and the Planning Commission recommend# that the City Council
adopt the following two motions and adoption of the attached findings of fact and
recommendation:

AND RECOMMENDATION
Application of City of Chanhassen for a Comprehensive Plan Land Use Map Amendment and
Rezoning of the property located at 391 West 78`h Street.
On January 2, 2007, the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of the City of Chanhassen for a land use map amendment
from PubliclSemi-Public to Commercial and rezoning of the property from Office and
Institutional, OI, to Central Business District, CBD. The Planning Commission conducted a
public hearing on the proposed land use map amendment and rezoning preceded by published
and mailed notice. The Planning Commission heard testimony from all interested persons
wishing to speak and now makes the following:
FINDINGS OF FACT
The property is currently zoned Office and Institutional, OI.
2. The property is guided in the Land Use Plan for Public/Semi-Public.
3. The legal description of the property is: Outlot B and the easterly 66 feet of Lot 1, Block
1, Old Village Hall.
4. The Zoning Ordinance directs the Planning Commission to consider six (6) possible
adverse affects of the proposed amendment. The six (6) affects and our findings
regarding them are:
a) The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the official City
Comprehensive Plan.
b) The proposed use is or will be compatible with the present and future land uses of
the area.
c) The proposed use conforms with all performance standards contained in the
Zoning Ordinance.
d) The proposed use will not tend to or actually depreciate the area in which it is
proposed.
e) The proposed use can be accommodated with existing public services and will not
overburden the city's service capacity.
f) Traffic generation by the proposed use is within capabilities of streets serving the
property.
5. The planning report #07-01 dated January 2, 2007, prepared by Robert Generous, et al, is
incorporated herein.
The Planning Commission recommends that the City Council approve a land use
map amendment from Public/Semi-Public to Commercial and rezoning property from Office and
Institutional, OI, to Central Business District, CBD.

(2) The minimum lot frontage is 75 feet, except that lots fronting on a cul-de-sac shall have
a minimum lot frontage of 60 feet.
(3) The minimum lot depth is 150 feet.
(4) The maximum lot coverage is 65 percent.
(5) Off-street parking shall comply with district setback requirements except:
a. There is no minimum setback when it abuts a railroad right-of-way, except as
provided in sections 20-1191 and 20-1192 pertaining to landscaping require-
ments.
b. There is no minimum setback when it abuts, without being separated by a street,
another off-street parking area.
C. The minimum setback is 50 feet when it abuts a residential district without being
separated from the residential district by a street or railroad right-of-way.
d. The minimum setback is 25 feet for side street side yards.

AN ORDINANCE AMENDING CHAPTER 20 OF THE
CHANHASSEN CITY CODE, THE CITY'S ZONING ORDINANCE,
BY REZONING CERTAIN PROPERTY
THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
Section 1. Chapter 20 of the Chanhassen City Code, the City's zoning ordinance, is
hereby amended by rezoning Outlot B and the easterly 66 feet of Lot 1, Block 1, Old Village Hall
from Office and Institutional District, OI, to Central Business District, CBD.
Section 2. The rezoning of this property is subject to all conditions of City Council
approval.
Section 3. The zoning map of the City of Chanhassen shall not be republished to show the
aforesaid zoning, but the Clerk shall appropriately mark the zoning map on file in the Clerk's Office
for the purpose of indicating the rezoning hereinabove provided for in this ordinance, and all of the
notations, references, and other information shown thereon are hereby incorporated by reference
and made a part of this ordinance.
Section 4. This ordinance shall be effective immediately upon its passage and publication.

WHEREAS, the City of Chanhassen has requested a Comprehensive Plan Land Use
Amendment from Public/Semi-Public to Commercial for Outlot B and the easterly 66 feet of Lot
1, Block 1, Old Village Hall, and
WHEREAS, the Chanhassen Planning Commission held a Public Hearing on January 2,
2007, and voted to recommend approval of the land use amendment, and
WHEREAS, the City of Chanhassen has submitted the proposed amendment to all
adjacent governmental jurisdictions for their review and comment.
NOW, THEREFORE, BE IT RESOLVED that the City Council approves the

McDonald: Mark, why don't we start down with you.
Undestad: No questions.
Dillon: Is there anything that's different? Nothing new is going to go into the spot if it's
rezoned?
Generous: Well there is a personal service use that will go into the property but there'll be no
changes. The use of the site is limited by the parking agreement that we recorded with the plat.
There are 4 parking stalls that are reserved for this use. This site, and that would permit, it could
be a retail use. It could be office use but anything within the CBD, however it's very limited to
building size. It's 500 square feet approximately. We don't see any change. The City's still
going to maintain ownership of it and so well control who we lease this to. However it would
permit the lease agreement to go forward that the City is negotiating right now.
Dillon: So what will this change in zoning do once, if it changes hands and the City doesn't own
it anymore and some private party owns it? I take it, it will be tax value that the City could earn
would go up a lot?

Generous: Well yes, it would go onto the tax rolls but again the site is, it doesn't comply with
the minimum standards so that's why it's an outlot. They can't change anything unless they come
back and get a variance to the standards for a CBD lot. It doesn't meet the frontage requirements
and it doesn't meet the area requirements. So it is very restrictive as to what the use, what
someone could do on the property. Plus they have the limitation on the amount of parking.
Dillon: And there's no other improvements or changes to infrastructure that are being
contemplated?
Generous: Nothing. Internally there'll be some modifications to the building but that's it.
Dillon: That's all the questions I had.
McDonald: Okay.
Keefe: Does the City have a plan to convey the property though?
Generous: No.
Keefe: No. Okay.
McDonald: Debbie.
Larson: Don't have any.
Thomas: No.
McDonald: No? I have no questions or comments either. Is the, well I guess the City is the
applicant, or is there someone else?
Aanenson: No, we're the applicant
McDonald: Okay. Then in that case, what I would do is open it to the public. Anyone wishing
to make comment on this, if you would please step to the podium and state your name and
address. Okay, seeing no one come forward I will close the public meeting and bring it back up
for the commission for comments. Kurt, well start with you.
Papke: I have no concerns with this. It would seem to increase the City's flexibility with what
they want to do with the property and that's kind of the bottom line. We know we still have
control over what we do with it so I think it just increases the options the City has to work with.

McDonald: Okay. Debbie.

recommends that City Council approve rezoning from Office and Industrial District, OI, to
