LAW ENFORCEMENT/FIRE DEPARTMENT UPDATE.
Mayor Laufenburger: This is the night of our monthly law enforcement and fire department
update. I would like to invite Lieutenant Eric Kittelson from the Carver County Sheriff's Office
to address us. Good evening Lieutenant.
Lt. Eric Kittelson: Good evening Mr. Mayor, council members. Before I get to the calls for
service I just wanted to address a couple things with the 4' of July celebration coming up next
week. Fireworks are illegal. Any substance or combination of substances or article prepared for
the purpose of producing a visible or audible effect by combustion, explosion or detonation. The
term does not include sparkling items which are non -explosive and non aerial and contain 75
grams or less of chemical mixture so basically if it flies or goes boom it's illegal. If you can
purchase it at a local reputable retailer it's not illegal but that's the long and short of the
fireworks.
Mayor Laufenburger: Thank you for that clarification Lieutenant.
Lt. Eric Kittelson: And we concluded the informal seatbelt survey on May 31'. There were 97
citations county wide for non use of seatbelt and 18 of those were in Chanhassen and the post
enforcement survey revealed a percentage usage rate of 97.3 which is extremely good and
something that we like to see. And then finally it's kind of an early announcement but the 8s'
Annual Public Safety Forum. We're going to be hosting that at the Chanhassen Rec Center on
September 16' and drug awareness will be the topic of discussion and the time for that is yet to
be determined. Into the calls for service we had 145 citations for traffic violations. 328

Mayor Laufenburger: Actually Mr. Sticha do you want to answer that question? This is an item

PROPOSED MOTION
"The City Council approves the variance request to allow signage logos to exceed
30 percent of the sign display area by 12.1 percent, and adopts the attached
Findings of Fact and Recommendation."
EXECUTIVE SUMMARY
The property owner is requesting a variance to allow replacement of existing signage
that will have four logos that exceed 30 percent (maximum allowed per City Code) of
the sign display area by up to 12.1 percent. Letters and logos of the sign will be
illuminated and dimensional. The applicant (representing Lund Food Holdings) is
requesting this variance to keep signage consistency between the Chanhassen
building and their other Twin Cities locations.
PLANNING COMMISSION SUMMARY
The Planning Commission held a public hearing on June 2, 2015 to review the proposed
amendments. The Planning Commission did not find any issues with granting the
variance for the increase in logo percentage of the display area. All voted in favor and
the motion carried unanimously with a vote of 7 to 0. The Planning Commission
minutes of June 2, 2015 are included in consent agenda item for the June 22, 2015 City
Council agenda.
RECOMMENDATION
Staff recommends the City Council approve the variance request to allow signage
logos to exceed 30 percent of the sign display area by up to 12.1 percent as shown in
plans prepared by Scenic Sign Corp., and adopt the attached Findings of Fact and
Recommendation.

PROPOSAL/SUMMARY
The applicant is replacing all signage (with the exception of the Minnesota Grille signage) on the
building and monuments. For this project, the applicant is requesting a variance to allow four
sign logos (three wall signs and one monument sign) to exceed the maximum display area
allowed. Chanhassen City Code Sec. 20-1267 (a) (3) states that "company logos shall not
occupy more than 30 percent of the sign display area." The largest sign logo variance will
exceed the maximum allowed display area by 12.1 percent (covering 42.1 percent of the sign
area). The applicant (representing Lund Food Holdings) is requesting this variance to keep
consistency between signage on the Chanhassen building and with their 25 other Twin Cities
locations.

On March 28, 1994, the City of Chanhassen approved a variance (#94-1) to allow signage at the
proposed site to exceed the 80 square feet signage maximum per business per street frontage. City
Code was later changed to allow up to 275 square feet of signage within the Central Business
District (CBD) (see City Code Sec. 20-1303). The maximum square footage of signage allowed,
per Variance #94-1, is 431 square feet for the south elevation and 376 square feet on the east
elevation.
On December 14, 1998, the City of Chanhassen denied a request to amend Variance #94-1 to allow
an additional 8.25 square -foot sign for a tenant (U.S. Bank) located within the Byerly's building.
In January 2002, Byerly's received permit approval from the City to replace their wall and
monument signage.
In 2003, the building added signage for the Byerly's Minnesota Grille, to advertise 24 hour service
for the Pharmacy (which has since been removed) and for a monument sign that advertises for non-
Byerly's tenants (located near the south entrance door).
The signage replacements (2002), additions (2003) and removals (24-hour service) for the building
reduced the total signage for the south elevation to 270.6 square feet and the total signage for the
east elevation to 57.7 square feet. These were the last approved sign pen -nits for the Bylerly's
building.

In 2008, Section 20-1267 (Uniformity of construction, design, etc.), was revised to allow logos to
encompass up to 30 percent of sign areas (Ordinance No. 468). The previous logo maximum
percentage area allowed was only 15 percent.
ANALYSIS
Currently, the total signage is 270.6 square feet on the south elevation (431 square feet allowed
per Variance #94-1) and 57.7 square feet on the east elevation (376 square feet allowed per
Variance #94-1). The monument signage has a total sign area of 11.8 square feet for each side.
The proposed signage will reduce the overall sign area of the south elevation to 244.1 square
feet, a 26.5 square -footage reduction from the existing signage area, and will reduce the sign area
of the east elevation to 57.5 square feet, a 0.2 square -foot reduction from the existing signage
area. The monument sign will be reduced to 8.9 square feet, a 2.9 square -foot signage reduction
on each side.
The applicant's proposal has four signs (three wall signs and a monument sign) exceeding the 30
percent maximum logo area allowed. The logos will be changed from the letter "B" with a circle
and line through it, to "L&B" with a similar circle and line. Additionally, the lettering will now
shows Lund's & Byerly's (instead of only Byerly's) and the lettering will be reduced in height.
Below are descriptions of each proposed sign change.
It should be noted that the areas for the signs were calculated by using straight lines that follow
the outside perimeter of the signs' letters and logos (see green outline below). Logo areas were
calculated by finding the area of the circular logo (see purple area below). The existing sign
logos already exceed the maximum logo percentage due to the fact that previous sign area
calculations were completed by including the entire area of signage within a rectangle area (see
red outline below), thus making the logo a smaller percentage of the entire area. The proposed
signage would exceed the 431 square -foot maximum signage allowed for the south elevation (per
Variance #94-1) using this method. The current method is believed to be a more accurate
representation of the area of the signage.

The proposed Lund's & Byerly's sign on the south elevation (shown on page 6) has the logo
area increasing from 44.1 square feet (out of 129.8 total square feet of the existing sign) to
57.7 square feet (out of 162 total square feet of the proposed sign). The lettering for the
proposed signage is 6 inches shorter than the existing sign (3 feet tall to 2 feet 6 inches tall).
The increase in logo size, combined with the reduced letter height, increases the logo
percentage of the signage from 34 percent to 35.6 percent.
2. The proposed Lund's & Byerly's sign on the east elevation (shown on page 7) has the logo
area increasing from 19.6 square feet (out of 57.7 total square feet of the existing sign) to
20.7 square feet (out of 57.5 total signage square feet of the proposed sign). The lettering for
the proposed signage for this sign is 6 inches shorter than the existing sign (2 feet 6 inches
tall to 2 feet tall). Similar to the south elevation Lund's & Byerly's sign, the increase in logo
size, combined with the reduced letter height, increases the logo percent of the signage from
34 percent to 36 percent.
3. The Lund's & Byerly's Wine & Spirits sign on the south elevation (shown on page 6)
currently does not have a logo located on the building and has Byerly's written above Wine
& Spirits. The proposed signage will remove `Byerly's" from the signage and add the
"L&B" logo. The Wine & Spirits sign logo is 17 square feet (out of 40.4 total square feet of
the sign). The logo area of the proposed sign encompasses 42.1 percent of the total sign area.
The lettering for this sign will be reduced in height by 7 inches with the proposed plan, but
the length will maintain the same measurement.
4. The proposed Lund's & Byerly's monument sign (shown on page 8) has the logo area
decreasing from 4.1 square feet (out of 11.8 square feet of the existing sign) to 3.14 square
feet (out of the 8.9 square feet of the proposed sign). The lettering height for this sign is
proposed to decrease 4 inches in height (from 11 inches to 7 inches). The decrease in letter
height, combined with the logo decrease, has the logo percentage of signage increasing from
34.7 percent to 35.4 percent.
5. The Pharmacy sign (shown on page 6), which does not have a logo, will have the letters reduced
6 inches in height (from 2 feet to 1 foot 6 inches). However, the length of the sign has been
increased by over 6 feet, increasing the sign area from 13.1 square feet to 29.5 square feet.
6. The applicant proposes to remove the `Byerly's" portion of the Byerly's Minnesota Grille sign
(shown on page 6). This will reduce the sign area from 73.7 square feet to 12.3 square feet.
This sign alteration does not require a variance.
7. The applicant is also proposing to change the face of a small monument sign located at the main
entrance. This signage change involves a color change (from blue to green) with the new
"L&B" logo. This sign alteration will not require a variance.

Overall, the east and south elevations are going to have less square footage of signage with the
proposed plan. All total sign areas are being reduced in size, with the exception of the main sign on
the south elevation. Also, the logo areas of the signage are all increasing in square footage and in
percentage of the total sign area, with the exception of the monument sign which will have an
increase in the logo percentage of the sign, but will have a smaller logo square footage area.
Per City Code Section 20-1267 (a), "all wall signage shall use individual dimension letters, at least
one-half inch deep;" however, logos "are exempt from the individual dimension letter requirement."
Several businesses elect to put logos on their signs and use non -dimensional materials (panels),
which is allowed per City Code. The intent of limiting logos from exceeding 30 percent of all
signage area is to restrict the amount of non -dimensional signage on building, monument and pylon
signs and to encourage the use of individual dimensioned letters and symbols. The proposed logos
for the new Lund's and Byerly's signs, along with the proposed lettering, have a letter and symbol
depth of 4.5 inches. The proposed dimensional letters of the "L&B" logo are much more
aesthetically pleasing than a smaller panel logo which would be allowed per city code.
Furthermore, the proposed signage will reduce the signage area on the building (both the east and
south elevations), bringing the wall areas even further below the 275 square -foot maximum signage
allowed per City Code. Additionally, the proposed signage will not reduce public beauty/aesthetics,
public safety or architectural compatibility with the building by allowing the proposed logos to
encompass more than 30 percent of the total sign area.

The proposed signage redesign for the Lund's and Byerly's building will reduce the height of the
lettering on their wall and monument signs. This redesign will also involve changing the logo
from a "B" to an "L&B" lettering. The signage change will in involve increasing the square
footage area of the logos, with the exception of the monument logo. Overall, four of the
proposed signs will exceed the 30 percent logo percentage of the sign display area, and all of
these proposed signs will increase the logo percentage of the total sign area in comparison to
their current percentage of the sign area. These logos exceed the maximum allowable percentage
by 5.4 percent to 12.1 percent. The total signage of south and east elevation of the buildings will
be reduced, bringing both of them further under 275 square feet of signage allowed, per City
Code. The proposed logos are made of dimensional letters and symbols. The proposed logos are
more aesthetically pleasing than panel logos, which are allowed per city code and are the primary
reason for the 30 percent maximum area restriction of logos allowed on wall signs.
Staff recommends that the Planning Commission recommend approval of the variance request to
allow signage logos to exceed 30 percent of the sign display area by up to 12.1 percent and adopt
the attached Findings of Fact and Decision, as shown in plans prepared by Scenic Sign Corp.

AND RECOMMENDATION
IN RE:
Application of Lund Food Holdings, Inc. for a variance from the 30 percent maximum logo area
allowed on signage on property zoned Central Business District (CBD) — Planning Case 2015-13,
property address 800 West 78th Street.
On June 2, 2015, the Chanhassen Planning Commission met at its regularly scheduled meeting to
consider the application of Lund Food Holdings, Inc. for a variance to the percentage of logo size
on signage. The Planning Commission conducted a public hearing on the proposed variance
preceded by published and mailed notice. The Planning Commission heard testimony from all
interested persons wishing to speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Central Business District, CBD.
2. The property is guided in the Land Use Plan for Commercial.
3. The legal description of the property is: Lot 4, Block 1, West Village Heights 2°d Addition.
4. Section 20-1253. Variances.
The city council, upon the recommendation of the planning commission, may grant a
variance from the requirements of this article where it is shown that by reason of topography
or other conditions, strict compliance with the requirements of this article would cause a
hardship; provided that a variance may be granted only if the variance does not adversely
affect the spirit or intent of this article.
The intent of limiting logos from exceeding 30 percent of all signage area is to restrict the
amount of non -dimensional signage on building, monument and pylon signs and to encourage
the use of individual dimensioned letters and symbols. The proposed logos for the new
Lund's and Byerly's signs, along with the proposed lettering, have a letter and symbol depth
of 4.5 inches. The proposed dimensional letters of the "L&B" logo are much more
aesthetically pleasing than a smaller panel logo which would be allowed per city code.
Furthermore, the proposed signage will reduce the signage area on both the east and south
elevations the building bringing the wall areas even further below the 275 square- foot
maximum signage allowed per City Code. Additionally, the proposed signage will not
reduce public beauty/aesthetics, public safety or architectural compatibility with the building
by allowing the proposed logos to encompass more than 30 percent of the total sign area.

RECOMMENDATION
The Planning Commission recommends the City Council approvesthe sign variance to

Byerly's (Lund Food Holdings, Inc.) is undergoing a rebranding project on all of its (26) stores within the
Twin Cities area. The new brand is "LUNDS & BYERLYS" with an "L&B" logo as an integral part of the
brand. All labeling, marketing and signage would carry this new brand and the logo and lettering are a
unit in all of its uses.
The existing BYERLY'S sign and logos at this Chanhassen location are all larger in size and square footage
when compared to the new proposed branding. We would have to change the design for just this one
location if held to the existing code. The new brand is smaller and still fits nicely within the existing
building design. (The attached building photo mock ups provide the new look compared to the existing
signs for each facade.) The overall appearance of the new signage is in line with the look and feel of the
existing signage. It is more of a "replacement" type project with upgrades to new LED style lighting
which also provides energy savings.

SIGNAGE WITH A LOGO TO EXCEED 30 PERCENT OF THE SIGN DISPLAY AREA
OWNER: MT PROPERTIES. A ND LIMITED PARTNERSHIP, PLANNING CASE

Ingvalson: Good evening Chairman Aller and rest of the Planning Commission. For those of
you that don't know me my name is Drew Ingvalson. I don't have a name up there yet so just
want to let everyone know my name is Drew so feel free to ask me any questions as we go along.
So the first thing we're looking at, so what we're looking at here is a sign logo percentage
variance request. This is the applicant is Lund Food Holdings and then the owner is IRET
Properties. So the location is 800 West 780' Street. The property is north of West 78th Street and
then west of Kerber Boulevard. Looking at that, the signage is located just to the south here, on
the south side of the building and then also on the east side. The east elevation. Then there also
is a monument sign that's located right here at the entrance and this is the Byerly's store for
those of you that don't know. So the request the applicant is making is they're requesting a
variance to allow the replacement of the existing signage that will have logos that exceed 30
percent of the sign display by up to 12.1 percent. City code allows logos to be up to 30 percent
of the sign. The largest one that they are proposing is 42.1 percent. This request is being made
to keep consistency between the signage that they have at other sites and also with the signage
that they have here in Chanhassen. So a little bit of background. There was a variance actually
given for this site in 1994. The variance was given to allow up to 431 square feet on the south
elevation which you see in that picture and then up to 376 square feet on the east elevation. At
the time the maximum signage allowed was 80 square feet. In 2002 and 2003 they went through
a remodel which has the signs that you see there in the picture, that's current. And that signage
actually reduced the signage on the south elevation to 270.6 square feet and on the east elevation
to 57.7 square feet. This is much lower than the maximum allowed at that time so the variance
wasn't needed at that time. The signage actually was up to 275 square feet for a side of the
building. So here's what the signage is going to look like. The new signage is on the right and
the current signage is on the left so the first thing is there is going to be changes to the logo. It's
going to be changed from that B that you see on the left side to L&B for Lunds and Byerly's.
They are also going to be reducing the letter height so that height is reduced approximately 6
inches on most of the signage and also signage is changed from Byerly's to Lunds and Byerly's.
And another thing off the signage is, keeping consistency with the letter depth. The depth of the
letters is going to be 4.5 inches so that's a dimension that it has off of the wall and then also the
logos have that same letter depth. The City requires a half an inch for that letter depth so it's
much deeper. Has a lot more of an accent than what the City requires. Also the logo has that
same letter depth. The City does not require it to have logos have letter depth. They can be on a

panel so that's something that we noticed right away is that the logo has that same letter depth
which gives them nice accent to the signage. So the methods for finding the signage for these, if
you look on the screen in blue is the logo area. It was determined by the circular area of the logo
and then the sign area is what we used was in green. So taking that outside perimeter. Making
right angles along the signage to find the total area. Previous signage was approved for it
actually used what you see in red which is just a large rectangle. Excuse me, large rectangle for
the signage. If that was used for this signage it would exceed the amount allowed for signage for
the site but we have, as staff we've kept consistent with keeping if there's signage above
lettering that we just include that small area instead of taking that whole entire rectangle. Here is
the existing and proposed south elevation signage. Starting from the left there's going to be
change from Byerly's to Lunds and Byerly's with the new logo. The logo percentage change is
34 percent to 35.6 percent so a small percentage change in making it larger. The pharmacy will
not have a logo. The only thing that's changing is the style of the lettering. The wine and spirits
will also have a change with, instead of having Byerly's it will just have the L&B logo with wine
and spirits. The percentage change is from zero percent with no logo to 42.1 percent. The
largest logo percentage that it's taking up. And then the Minnesota Grille will just be removing
the Byerly's section so it will just say Minnesota Grille on that. On the east elevation there's
going to be sort of similar to that front main signage, it's just going to have a, it's a change from
the logo from the B to the L&B and then Byerly's to Lunds and Byerly's and next one. The
existing proposed monument sign has the same logo change as the other ones. The other main
ones in Byerly's logos and it will have a 34.7 to 35.4 percentage change in the logo size so very
small. So at this time staff is looking at it, if you're looking at city code like I said previously the
logos are limited to 30 percent of the signage. A large reason for this ordinance is to limit the
amount of panel signs that doesn't have that dimensions on it so something we noticed right
away was that signage actually has that dimensional which makes it very much more
aesthetically pleasing. Also the total signage is being reduced for on the site even more, bring it
further down to the little further below the 275 square footage requirement. So with that staff is
recommending that the Planning Commission recommends approval of the variance request to
allow signage logos to exceed 30 percent of the sign display area by up to 12.1 percent as shown
on the plans prepared by Scenic Sign Corp and adopts the attached Findings of Fact and
Decision. That is the end of the presentation. I feel free to answer any questions that you might

Aller: Great. The signs are not back lit?
Ingvalson: No.
Aller: There's no lighting involved?
Ingvalson: No.
Aller: The area that the lettering and the logos are taking up are substantially similar to what was
there before?
Ingvalson: Absolutely.

Aller: And in fact in some cases a little bit reduced.
Ingvalson: Yes.
Aller: Some cases with a little bit expanded on the logos.
Ingvalson: Correct.
Aller: When you go back to methods.
Ingvalson: Sure.
Aller: Are we being consistent in our application of the red outline, the green outline and logo
area with all our businesses now in town?
Ingvalson: Absolutely.
Aller: That's consistent.
Ingvalson: Absolutely. If there is something small above it we don't take the entire signage area
because that will take up a lot of area, especially if you have something very small. A small logo
similar to this one and with a smaller sizeable wall, it's a smaller percentage they can have so
that can make it a larger issue so what we've been consistent with doing it this way. With what
you see in the green outline on the screen.

Ross Elenkiwich: My name's Ross Elenkiwich. I'm a project manager at Lund Food Holdings.
As you guys know we are undergoing a new branding operation right now at the 26 of our stores
around the metro area. We're changing them all to Lunds and Byerly's and if you look at the
logo back there, the L&B is an integral part of that and so just trying to stay consistent in
changing out the signs that are existing. Something to note is all of the signs are decreasing in
size on this store with the exception of adding the logo above the wines and spirits and removing
the Byerly's so that's the one difference. Also the signs that will be lit there from the back side
will be LED so they'll be a lower energy. Yeah just the ones on the building will be lit so they'll
consume less energy and it should be a really nice, new, sleek look for the store.
Aller: Awesome. Well I know you have 25 different stores in the area.

Ross Elenkiwich: So a while back Lunds removed the apostrophe in our Lunds stores and then
recently we decided to also remove the apostrophe in Byerlys which makes it a lot easier to
actually light too because we don't have to get the little LED in the apostrophe and have it
separate because there is no track on the back of these. All of these letters are singly mounted to
the brick behind instead of having the raceway in front of them.
Aller: Easier to keep clean too.
Ross Elenkiwich: Yep, exactly.

ADMINISTRATIVE PRESENTATIONS.
Aanenson: Before I do that those of our new Planning Commissioners may not know Drew but
Drew's been with us for 2 years as the intern so we're practicing not calling him the intern
because as of Monday he's full time. He graduated from the Humphrey Institute so.
Aller: Good job.
Aanenson: Yeah he's done a great job for us so obviously we wanted to keep him so yeah, we're
excited. This is his first week so baptism by fire. Make him do a presentation. So with that I
did put in your packet a couple items that are coming up for the City Council. One of those has
been removed. We found an issue with that. I'll go back to what happened at the City Council
in a second but that was the, there was a variance on Minnewashta. Can I get your packet? I
don't know where mine went. And that one is missing, we found some errors there regarding
sewer, water easements that were in the way of preventing them from being able to move
forward so, I can't find my items for upcoming. Here we go. So that was, so you only have one
item on and unless something becomes of that, that was a little bit more complex. That's
relocating a variance for the wetland setback but then also making sure wherever we give that
variance that it doesn't, it meets the suitability for a septic site so we've got two things going on
there. Make sure we can address that. We are anticipating on Friday getting two subdivisions in.
One of more consequence. Maybe 24 lots and the other one 4 lots so we're anticipating both of
those coming in and that would be for your July 7'. Two of those are on here but those 2 are on
here but we may see a couple other things. Actually the variance that was pulled will move to
that date so you'll come to the, after the holidays with some work to do. So last Tuesday night
the City Council took action on the Children's Learning Center. They tabled it. Want to go back

On June 2, 2015, the Chanhassen Planning Commission met at its regularly scheduled meeting to
consider the application of Lund Food Holdings, Inc. for a variance to the percentage of logo size
on signage. The Planning Commission conducted a public hearing on the proposed variance
preceded by published and mailed notice. The Planning Commission heard testimony from all

FINDINGS OF FACT
1. The property is currently zoned Central Business District, CBD.
2. The property is guided in the Land Use Plan for Commercial.
3. The legal description of the property is: Lot 4, Block 1, West Village Heights 2nd Addition.
4. Section 20-1253. Variances.
The city council, upon the recommendation of the planning commission, may grant a
variance from the requirements of this article where it is shown that by reason of topography
or other conditions, strict compliance with the requirements of this article would cause a
hardship; provided that a variance may be granted only if the variance does not adversely
affect the spirit or intent of this article.
The intent of limiting logos from exceeding 30 percent of all signage area is to restrict the
amount of non -dimensional signage on building, monument and pylon signs and to encourage
the use of individual dimensioned letters and symbols. The proposed logos for the new
Lund's and Byerly's signs, along with the proposed lettering, have a letter and symbol depth
of 4.5 inches. The proposed dimensional letters of the "L&B" logo are much more
aesthetically pleasing than a smaller panel logo which would be allowed per city code.
Furthermore, the proposed signage will reduce the signage area on both the east and south
elevations the building bringing the wall areas even father below the 275 square- foot
maximum signage allowed per City Code. Additionally, the proposed signage will not
reduce public beauty/aesthetics, public safety or architectural compatibility with the building
by allowing the proposed logos to encompass more than 30 percent of the total sign area.
