AMENDMENT TO ENCROACHMENT AGREEMENT THIS AMENDMENT TO ENCROACHMENT AGREEMENT ("Amendment") made this 20,1 day of &� 2015, by and between the CITY OF CHANHASSEN, a Minnesota municipal co lion ("City"), and WILLOW -MN LLC, a Colorado limited liability company ("Owner"). RECITALS WHEREAS, on April 22, 2015, the City and Owner executed an Encroachment Agreement and recorded the same on May 1, 2015 with the Carver County Recorder as Document No. A609340 ("Agreement"); and WHEREAS, Owner and the City desire to amend the Agreement to remove the encroachment for sanitary sewer and to reflect the actual location of the private water sewer service located within Target Lane, the City's right of way; NOW, THEREFORE, the City and the Owner agree as follows: 1. Amendment to Paragraph 1B of Agreement. Paragraph 113 of the Agreement is hereby amended to read as follows: B. The Owner desires to construct a private water service on the Subject Property and connect its private water service to the City's utility service lines within the Target Lane right of way. 2. Amendment to Paragraph 2 of Agreement. Paragraph 2 of the Agreement is amended to read as follows: 2. ENCROACHMENT AUTHORIZATION. The City hereby approves the encroachment for private water service within that portion of the City's right of way for Target Lane legally described on the attached Exhibit "A" and depicted on the attached Exhibit "B" (the "Encroachment Area"). As a condition of this approval, Owner shall be responsible for any damage to Target Lane caused by the construction, repair, replacement, use or maintenance of the private utilities located within the City's right of way. If the City determines it is necessary to relocate the private water service, it may do so at the City's expense after thirty (30) days advance written notice to Owner, except that no notice will be required in case of an emergency. 3. Amendment to Paragraph 3 of Agreement. Paragraph 3 of the Agreement is amended to read as follows: 3. HOLD HARMLESS AND INDEMNITY. In consideration of being allowed to encroach in the Encroachment Area, Owner, for itself, its successors and assigns, hereby agrees to indemnify and hold the City harmless from any damage caused to the Subject 183010v1 Property or the private water lines located within the Encroachment Area, caused in whole or in part by the encroachment onto the Encroachment Area. Further, Owner hereby agrees to defend and indemnify the City for any damage or injury incurred by Owner, it employees, agents, contractors or assigns in connection with the construction, installation, repair, use or maintenance of the private utilities within the City's right of way. 4. Amendment to Exhibits A and B. Exhibits A and B to the Agreement are amended as provided in Exhibits A and B attached hereto. 5. Agreement. We believe the development site is configured so the Noodles restaurant traffic will not significantly impact the internal operations of the site. The main concern is related to the operation of the traffic signal that provides access on West 78" Street. The purpose of our study is to determine if the signal timing plan needs to be altered and if the traffic signal needs to be physically interconnected to the traffic signal at the Powers Boulevard/ West 78" Street intersection (so they can operate in coordination). To determine if the signal operations need to be altered along West 78" Street to accommodate the traffic generated by the Noodles restaurant, we propose completing the following scope of work: 1. Collect existing lunch time and p.m. peak period turning movement volumes on a typical weekday at the West 781" Street intersections at Powers Boulevard and the Site Access. 2. Forecast the traffic volumes added to the study intersections during the study periods. 3. Perform capacity analyses in the Build Noodles traffic condition at the study intersections. 4. Based on delay and queue measurements from the capacity analyses, determine if we need interconnect and/or signal timing plan modifications at the study intersections. S. Prepare forecasts and capacity analyses for two alternative development scenarios. 6. Prepare a brief technical memorandum that documents our analyses and recommendations. The fee for preparing the study scope below is $4,480, due upon receipt of the study. The study pdf will be emailed to you within 20 business days of receiving a notice to proceed. City Council approval requires a majority vote of city council. BACKGROUND On November 10, 2014 the City Council approved the final plat for Chanhassen Retail Fourth Addition. Because there were no public improvements, the approval of the plat included a resolution for the conditions of approval. The applicant recalculated the storm water construction fees. Modifications to the fees resolution require council approval. Kate Aanenson: Okay. So this item as you mentioned Mayor, council members is on 1900 Stoughton Avenue. Mr. Bruce Lamo, the applicant. This property is zoned Business Fringe. If you recall the history on this property, we did do a conditional use amendment on the, he's requesting a conditional use amendment from the original one that was done. As you recall this property was split and the conditional use that over rode the entire property, there was some ambiguity there so we changed our ordinance to make sure that there's an existing conditional use. You can administratively split the property. So that, the storage unit did put in a stormwater pond to the back to resolve some of those issues and now Mr. Lamo wants to continue with additional phases so it needs a CUP amendment. Some of the concerns when we had the Planning Commission public hearing was to make sure that there's screening across the street on Stoughton Avenue. They were concerned about the visibility. The staff did require Mr. Lamo, I do have the material samples here to match the existing or the architectural standards. Not what was put in place then but to meet the new standards. As you may be aware, these types of buildings can last quite a while on a piece of property so we wanted to make sure. I think the other discussion that we had with Mr. Lamo and Mr. Generous and myself talking to him about long term wise we looked at some of the access points to this property. We talked about this on our 61 corridor study that we did. We informed Mr. Lamo that that is our intention to bring sewer and water down in this area and that if we're down in that area before this developed there's still an opportunity to provide municipal services to the back of this property coming through an access way through Chaska and making sure that he's provided an opportunity so I think we're in sync on that to make sure that, provide him the most opportunities for future development as possible. So right now he'll be kind of doing the buildings in increments. Not attending them all see how he, how much use there is but again he's planning on five additional buildings again to taking those incrementally. So the BF district again was intended to look at limited use of commercial properties if this was guided industrial it still could be a use in that zoning district so we did take a look at that but again we are coming forward with the Comprehensive Plan amendment in this area itself. The difference with the BF district in the, when that was put in place is intended to be kind of a temporary use without municipal sewer and water. If this was some other type of facility we'd want to see that. The one issue with the BF district it does require the 40 percent, which is a higher percent of green space requirement so that does limit the ultimate development of the property so again looking at providing municipal service and giving him that opportunity. Otto Associates has provided an engineer's opinion of cost to treat 1.1 inches of water quality volume from the new impervious surfaces associated with this development. This opinion of cost was $25,000 and shall be due at time of final plat to be put into an account to be used exclusively for the improvement of downstream water quality. Grading and Erosion Prevention and Control The total disturbance will not exceed the minimum one -acre threshold to require a National Pollution Discharge Elimination System Construction Permit. The applicant has developed a preliminary erosion control plan. This plan must be consistent with Section 19-145 of Chanhassen City Code. On a positive note the Southwest Metro Lakes Coalition homeowners associations have a long history of working with the Riley -Purgatory -Bluff Creek Watershed District on many improvement projects in the past. For example, the Lake Riley Improvement Association provided funding and active participation in partnership with the Watershed District to the University of Minnesota on a multi -year carp study that is now gaining worldwide recognition for it's findings. Lotus Lake homeowners contribute $15,000 a year for aquatic invasive species inspections at their public access. The members of the Southwest Metro Lakes Coalition believe that the best use of the watershed district's taxpayer provided funding is to identify and provide financial support to water quality improvements that would provide the greatest amount of return for the largest number of citizens as possible. In conclusion, the Southwest Metro Lakes Coalition intends to continue the tradition of it's member homeowners associations of vigorously protecting and promoting the health and water quality of our lakes. We believe and hope you agree that access to clean and functional recreational lakes by all of our citizens is part of the reason that Chanhassen is consistently rated as one of the best places to live. CHANHASSEN RETAEL ADDITION AND A PORTION OF THE TARGET PARKING LOT: REOUEST FOR PRELIMINARY PLAT AND SITE PLAN REVIEW FOR A 4,412 SQUARE FOOT RETAIL/RESTAURANT BUH DING. APPLICANT: HALIFAX DEVELOPMENT, LLC/OWNER: TARGET CORPORATION. Kate Aanenson: Thank you Mayor, members of the City Council. This item did appear before the Planning Commission on September 161 and they did recommend approval of the preliminary plat and the site plan. The applicant, Halifax Development is actually out of Denver. So again there are two actions being requested tonight. Subdivision and site plan review. The subject site is located on, between West 78" and Highway 5. The outlot. The City got this outlot remnant as part of the construction of West 78t6 and the extension of that with Powers Boulevard. As you recall when we were looking at the downtown, intensifying the downtown we talked about when we rezoned this to Central Business we met with a lot of the property owners along there and actually we envisioned that maybe an outlot could be placed in this area of Target parking lot and that's kind of what we anticipated. As it turned out the applicant was looking at putting it closer to Highway 5, which certainly met the same need because no matter we would have to provide additional parking that was removed from Target would have to be placed back there so in either development scenario, whether it was placed adjacent to West 78' or Highway 5, that site would have to be graded and provide parking so with that we are replatting the Outlot A. So this is a little bit more complex than just our subdivision. In order for this application to go forward, so the subdivision, the preliminary plat is of the City's property but in conjunction with that Target will also be participating so they have a purchase agreement with Target's the separate but Target doesn't want to do a subdivision so through our ordinance we do allow an administrative split so in working with the attorney's office we had the sequencing set together so they will purchase from the City of Chanhassen the property. Subdivide that, which is the action you're taking tonight and then at closing they'll administratively take that portion from Target to make the project whole and that project needs to occur in order for the site plan to get approved because they need all that parking and access for the SCANNED Chanhassen City Council — October 13, 2014 V project to go forward so you can see on there the total square footage of the property. Be about 34,250 square feet. Some of that again from the City and some from Target. So on this side over here is actually the preliminary plat as shown. Mayor Furlong: Ms. Aanenson, just to clarify then. Kate Aanenson: Yes. Yes. Mayor Furlong: The parcel that will be included in this from the current Target parcel, that's not going to come back through for council approval? Kate Aanenson: No. Mayor Furlong: You said that will be administratively. Kate Aanenson: No because it's an administrative subdivision, yep. Mayor Furlong: Okay. Kate Aanenson: So it will happen at closing. The description is included in the documents for closing. Mayor Furlong: Okay, thank you. Kate Aanenson: And I'll show this a little bit more illustratively why that needs to happen. Actually we're improving the access onto that Target Lane as it comes off of West 781. You can see right here so this project actually, you have that quick U turn here to get into the three restaurants that are currently located there. The Taco Bell, Leeann Chin and Perkin's. So this actually creates a better access going in and better sight lines coming in so the reconstruction of the Target parking lot provides for a better flow and still maintaining, they have an existing pylon sign there so again in order for the project to go forward we actually made sure that Target had enough parking. They had parking to give up which we kind of determined earlier but went back and re-evaluated that and then looked at what they, the business wanted. So originally they were looking at one use. The Noodles and as it turns out they had enough parking between the two that they could actually provide for another building so actually there's two users on there. The only one they know right now would be the Noodles and the have a couple ideas for a secondary tenant but that hasn't been determined yet. So the landscaping plan, as shown on the picture on the left meets the city ordinances. Again they will have a pylon sign. They're looking at putting that in a location which gives them better visibility and then they'll also have wall signs I want to say closer to Target Lane as opposed to Highway 5 so when you're coming in off that way because they'll get the visibility from Highway 5 from the wall sign. So we do have the materials here too. The material boards here. Originally when it was submitted it was a little bit darker in colors so we asked that they lighten the building up a little bit. Again you're going to have visibility from Highway 5. It does have a parapet wall and it also has outdoor seating adjacent to Highway 5 and it was hard to see in the landscaping plan. The landscaping plan, there is outdoor seating but that's also well screened so that would be a nice opportunity there for outdoor dining. So this is the renderings of the site plan. It does meet the city ordinance. The Highway 5 architectural standards. The pitched roof elements and the like so it does meet city code so with that we are recommending approval of the preliminary plat and the site plan and I'd be happy to answer any questions that you have. Mayor Furlong: Thank you Ms. Aanenson. Questions for staff. Mr. Laufenburger. Chanhassen City Council — October 13, 2014 • Councilman Laufenburger: Thank you Mr. Mayor. Kate, I think this is a great plan and I expect that this may be a typo but the sum of the two lots that you identify in square footage doesn't equal the total and I just. Kate Aanenson: I think it's correct in the staff report now. Councilman Laufenburger: I'm looking at what identifies as page G-1. Well. Kate Aanenson: I'll check those numbers. Councilman Laufenburger: Yeah, as long as what we record identifies that we're not creating even 2 or 3 square feet out of nothing I think is important. Kate Aanenson: Yes. Councilman Laufenburger: Okay. Also you talk about the second retail. We are not approving a Noodles here. Kate Aanenson: No. Councilman Laufenburger: We are approving the plan, is that correct? Kate Aanenson: That's correct. Councilman Laufenburger: Okay. Kate Aanenson: It's our understanding it could be a Noodles. Councilman Laufenburger: It could be something else. Kate Aanenson: But it could change, that's correct. Councilman Laufenburger: Okay. Okay. And as long as it's a retail that meets our plan then we're saying bring it on right. Kate Aanenson: Correct. As long as it meets the parking standards and sign controls. Councilman Laufenburger. Alright, thank you very much. That's it Mr. Mayor. Mayor Furlong: Councilwoman Tjornhom. Councilwoman Tjornhom: Kate do you foresee ever, and ... without looking at the plans but where they could somehow, at some point turn it into a drive thru? Kate Aanenson: No. Actually there's a change in grade as you get behind, it's hard to see on the, behind the Perkins there. It gets narrow right through there and you're actually behind, this is the dumpster for the Perkins in their parking lot. It's actually too narrow of a site to have that happen. Councilwoman Tjornhom: Okay. And there is sufficient parking for two? Kate Aanenson: Yes there is. Yes. 5 Chanhassen City Council — October 13, 2014 V Mayor Furlong: And I think to follow up on that question, for two what types of uses? For two restaurants or for retail? Kate Aanenson: Yes it could be two restaurants. It could be two restaurants, yes. Mayor Furlong: Okay. Alright. Councilwoman Tjornhom: One more question. When it comes to delivery trucks, where are those entrances? Kate Aanenson: They're actually going to use the front door entrances, yep. Councilwoman Tjomhom: Okay. Mayor Furlong: Other questions? Ms. Aanenson from the topography, this building will sit down below Highway 5, is that correct? Kate Aanenson: That's correct. Mayor Furlong: Have we done anything with regard to screening of the HVAC equipment? Kate Aanenson: Yes. Mayor Furlong: More than just what might happen for a typical building? Kate Aanenson: Yes, along Highway 5 we do require that it be effectively screened so this building does have parapet walls that does screen it and they're tipped in so it should effectively screen that. And with landscaping. Mayor Furlong: So we think with the sight lines for vehicles driving by, we want them to be able to see the business name but we also don't want them looking down on the equipment. Kate Aanenson: Right. The highest point was you're actually on the bridge as you're kind of on the high point. Mayor Furlong: Okay. Kate Aanenson: And as you're coming down towards Powers you're coming down. Mayor Furlong: Sure. Kate Aanenson: Yeah, so it would be on, going westbound that you'd have the best visibility of that. Mayor Furlong: And I guess, and that's what I wanted to know is did we look at the topography of this site and what the sight lines would be from Highway 5. Kate Aanenson: Yes. Mayor Furlong: And we've taken the appropriate precautions for screening the equipment. M Chanhassen City Council —October 13, 2014 Kate Aanenson: Yes, we had the architect give us those drawings to show those perspectives. Mayor Furlong: Okay. Okay. Thank you. Any other questions for staff at this time? Todd Gerhardt: Mayor. Mayor Furlong: Mr. Gerhardt. Todd Gerhardt: Just want to thank Kate and her staff for working on this development. It does feed into our goals of trying to intensify retail development in the downtown area. And also the City is selling some remnant land here so a little over $200,000 that the council can decide where you'd like to see that money go to. It could go to the road assessment fund. It could go to park and trails. So council is free to designate those dollars wherever you wish and but can't count on the money right now until closing occurs and we can bring that item back at a future council meeting once we have a successful closing. Mayor Furlong: Okay, thank you. Questions. Councilwoman Tjornhom. Councilwoman Tjornhom: One more question. Mayor Furlong: That's fine. Councilwoman Tjomhom: I've got to get the planning commissioners out of me at some point. Signs. Where will the signs be for this? Obviously it's tucked in. Kate Aanenson: Yeah, so when you're coming down Target Lane, their monument sign they're going to have facing so as you come past Perkins, it'd be on the interior. Not, would not be on the Highway 5 side so it'd be in Target Lane. Councilwoman Tjornhom: Are there any signs there now? I don't remember. Kate Aanenson: There's a Perkins sign. Councilwoman Tjornhom: There is? Kate Aanenson: On the other side of the island there on the island. And then they will have wall signs on three sides because they have three frontages. Councilwoman Tjornhom: Okay. Kate Aanenson: Highway 5, the Target Lane and then the back side of Highway 5 so. Councilwoman Tjomhom: And so their sign, when you say their sign, that's the sign that will be used for both, whoever comes in there? Both businesses. They'll have to share that one sign location? Kate Aanenson: For the monument, that's correct. Councilwoman Tjornhom: Monument. Kate Aanenson: That's correct. Chanhassen City Council — October 13, 2014 Councilwoman Tjornhom: Okay. Mayor Furlong: Ms. Aanenson with that picture that you have there, Target Lane is a public street is that correct or is it private? Kate Aanenson: That is a public street, that's correct. Mayor Furlong: Okay. And where does that terminate? Is it about where the monument sign is? Kate Aanenson: Yeah if I can go back to, there's a drawing on here that shows. So now it's going to be extended. Right now it, you just had a legged intersection so now you actually can travel through that lane and it actually creates better circulation for that end of Target too. Mayor Furlong: And that's my question. Will Target Lane be extended then all the way past there? Will that continue to be a public street? Kate Aanenson: It will be private after that point. Mayor Furlong: Okay. Kate Aanenson: Yep. Mayor Furlong: And are there, this property abuts Target Lane which is a public street, correct? Kate Aanenson: Correct. Mayor Furlong: So we don't have to worry about access easements or anything from the neighboring property owners. Kate Aanenson: No, that's why this project took quite a while to figure out how to get that and it was kind of an oddly shaped piece of property. Mayor Furlong: Sure. Kate Aanenson: So the only way this project could come forward is actually working with Target to modify the parking and that's between the two. A negotiation between the City and Target so that took a little time. Mayor Furlong: And I think credit, Mr. Gerhardt when we're thanking people credit should go to Target as well for. Kate Aanenson: Yes. Todd Gerhardt: Yep. Mayor Furlong: Their cooperation and working with the City and the property owner. Kate Aanenson: Yes. And I did want to note that the developer was here today. He was meeting with Target and finalizing his agreements but he's on the way back to Denver right now. Mayor Furlong: Okay. Okay. Chanhassen City Council — October 13, 2014 Kate Aanenson: We didn't think there'd be any issues so. Councilwoman Ernst: Mr. Mayor? Mayor Furlong: Yes. Councilwoman Ernst: I should have mentioned this before but I would like to recuse myself from this particular. Mayor Furlong: Okay, as an employee of Target. Councilwoman Ernst: Yes. Mayor Furlong: As an employee of Target, that's fine. Thank you Councilwoman Ernst. With that are there any other follow up questions at this time? Councilman Laufenburger: Comment. Mayor Furlong: Anybody from the developer? Kate Aanenson: That's what I was saying. He was in here earlier today. Mayor Furlong: Okay. Did he have any concerns that you're aware of on any of the conditions set forth in the plan? Kate Aanenson: No, we went through everything that needs to be done and Andrea Poehler from the attorney's office has been working closely with the closing documents so I think everything's moving right along. It will come back for final plat. There are no public improvements so we will do a site plan agreement. Mayor Furlong: Okay. Kate Aanenson: So the developer will be signing that and this property is still in the name of the HRA so we'll convert that. That document's being drafted so when we come back for final plat you will also be transferring that property to the City Council but everything's in line to have that happen. We anticipate a closing sometime in December. Mayor Furlong: Thank you. Okay. Very good. There were no public comments I believe at the Planning Commission. Kate Aanenson: That's correct. Or whatever they say in Noodles country. • Chanhassen City Council — October 13, 2014 Mayor Furlong: Councilwoman Tjornhom Councilwoman Tjomhom: No I think these are always good evenings when we're approving a plat like this where new businesses are coming into town, especially restaurants because we all know that that's one of our favorite things to welcome into town so. Mayor Furlong: Yeah I agree. I'm pleased to see it coming and I think as Mr. Gerhardt complimented the staff and others involved, when you look at this, while it's coming to us and it's in very clean form and ready to go, we know that didn't just happen and there was a lot of work behind the scenes throughout our planning department and engineering department and others. The developer. Target, the neighboring property owners. A lot of different people were involved so these things don't just happen. I know this has been something that's been in the works for many, many months and as Mr. Gerhardt said, this is part of our strategic initiative as a city to look for ways to intensify a little bit the downtown and take advantage of the area we have within our downtown and to enhance and promote our local economy so when we see these occurring, this is an area that clearly can, and I do like the way the traffic's going to flow. It's actually going to improve access I think to Target and to that whole area so I think it's just a wonderful project from a design standpoint. Planning standpoint but also from an amenity and a new business coming to town for our residents and our local economy so very pleased to see it. If there are other comments that'd be great. That's the City's property that we're splitting. That's not including the two parcels of Target and the Chanhassen parcels so there's different numbers. This is for the plat. What I showed you that I think you were talking about the numbers that didn't match were the parcels, yeah. Mayor Furlong: So do the, because some of the numbers here are including the 7,000. Before the final plat is recorded the Surface Water Management fees, Park Dedication fees, and GIS fees must be paid as well as any recording fees not collected with the final plat application. 11 Chanhassen City Council — October 13, 2014 2. The applicant shall submit $25,000 in lieu of constructing stormwater best management practices. This shall be due at time of final plat to be put into an account to be used exclusively for the improvement of water quality downstream of the site. 3. The Storm Water Utility fee is estimated to be $18,525.10 and shall be due at final plat. Park and Trail 1. Full park fees in lieu of additional parkland dedication and/or trail construction shall be collected as a condition of approval for Shops at Chanhassen. The park fees will be collected in full at the rate in force upon final plat submission and approval. Site Plan Environmental Resource 1. The applicant shall provide Rational Method calculations for proposed pipe design. The applicant shall work with City staff to assure downstream system has adequate capacity to handle the additional volume directed from the new impervious surface. 2. The erosion prevention and sediment control plan must be consistent with Section 19-145 of Chanhassen City Code. Building Official 1. The building is required to have automatic fire extinguishing systems. 2. Building plans must be prepared and signed by design professionals licensed in the State of Minnesota. 3. Retaining walls over four feet high must be designed by a professional engineer and a permit must be obtained prior to construction. 4. Detailed occupancy -related requirements will be addressed when complete building plans are submitted. 5. The owner and or their representative shall meet with the Inspections Division as soon as possible to discuss plan review and permit procedures. Engineering 1. The developer must work with the neighboring property owners, including the City, to acquire temporary construction easement for all off -site grading and construction. 2. The developer must acquire a permanent easement over all improvements the developer shall own and be responsible for maintaining, such as the storm sewer. 3. The developer must obtain an access agreement from the City for construction and maintenance of the sanitary sewer and water main within the right of way of Target Lane. 4. The developer's engineer shall include the Perkin's parking lot islands in the topographic plan. Current plans do not show all islands within the survey area. 12 Chanhassen City Council — October ber 13, 2014 5. Final plans shall include existing and proposed elevations at the property corners and structure corners. 6. The grading plan shall include drainage arrows to indicate the direction of water flow. 7. The developer shall submit an accurate soils report indicating soil conditions and permeability. 8. The grading plan shall identify proposed stockpile areas. 9. The grading plan shall show the top and bottom elevation of the retaining wall near the Target sign. 10. The parking spaces shall be adjusted so that minimum dimensions are measured from the gutter flow line. 11. The developer must pay the partial payment of the SAC fees and the WAC fees with the final plat. Plannine 1. All rooftop and ground equipment must be screened from views. 2. Sign illumination and design shall comply with ordinance. Wall signs shall be limited to the north, east and south elevations. Wall and monument signage shall comply with the sign ordinance. All signs require a sign permit. 3. The applicant may share a monument sign within the same PUD contingent upon the removal of the existing monument sign. 4. The exterior material for the trash enclosure must be of the same exterior material as the building. Recycling space and other solid waste collection space should be contained within the same enclosure. 5. Light levels for site lighting shall be no more than one-half foot candle at the project perimeter property line. This does not apply to street lighting. All fixtures must be shielded. 6. Provide and maintain a cross access agreement with Target for parking. 7. Approval of the site plan is contingent upon approval of the subdivision and the administrative lot line adjustment for Target as shown in Exhibit # 7 All voted in favor and the motion carried unanimously with a vote of 3 to 0. As an employee of Target, Councilwoman Ernst recused herself from this item. The lot has street frontage. Access to the lot is gained off of a public street from Target lane via West 78's Street. The minimum lot area in this PUD is 20,000 square feet. Lot 1 will have an area of 34,249 square feet. At today's rate the payment is $12,500 per acre for approximately $7,562.50. SUBDIVISION FINDINGS 1. The proposed subdivision is consistent with the zoning ordinance. Finding: The subdivision meets the intent of the city code subject to the conditions of the staff report. 2. The proposed subdivision is consistent with all applicable city, county and regional plans including but not limited to the city's comprehensive plan; Findin : The proposed subdivision is consistent with applicable plans. 3. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and storm water drainage are suitable for the proposed development; Finding: The proposed site is suitable for development subject to the conditions specified in this report. 4. SITE PLAN The proposed building contains two uses, a fast -casual restaurant (Noodles & Company) and a future retail or restaurant use. It shows signs along the east, north and south elevations as well as proposing a monument sign at the entrance into the site. Conflicting sign details and locations have been submitted. One ground low -profile business sign is permitted. The height of the sign shall not exceed 8 feet and square footage shall not exceed 64 square feet. All signs shall meet ordinance requirements pertaining to height, area, illumination and dimensional letters. Wall signs will be limited to three elevations, north, south and east. All signage will require separate permits. The applicant has approached staff regarding adding the name of one of the neighboring users on the proposed monument sign. Since this site is a PUD, staff has no objection to this request. However, the monument sign on the other site must be removed. LIGHTING/SIGNAGE A photometrics plan must be prepared for the site. The numbers may not exceed one-half foot candle at the project perimeter property line. This does not apply to street lighting. All fixtures including wall packs must be shielded. PARKING The ordinance requires one parking space per 200 square feet for multi -tenant buildings. Twenty-three parking spaces are required. The applicant is showing 43 spaces, meeting the parking requirements. Additionally, the applicant has a cross -access agreement with Target. Target also exceeds their parking requirement of 533 spaces. Articulation: The building incorporates adequate detail and has been tastefully designed. The architectural style is unique to the building but will fit in with the surrounding area. The building will provide a variation in style through the use of brick, stucco, metal and glass. The building utilizes exterior materials that are durable and of high quality. Signs: All signage must meet the sign criteria in the Central Business District. The applicant may share a monument sign with another user in the same PUD contingent upon the removal of the existing monument sign. Material and Detail The building contains brick and stucco. High -quality materials are being used on the building. Color The colors chosen for the building are light tans and browns. The selection is unique, but blends in with the surrounding buildings. Heip_ht and Roof Design The building ranges in height between 17 and 19 feet. The district has no height limits. The structure is a single level. The roofline is staggered, adding articulation to the design of the building. The rooftop equipment is screened from views by a parapet wall. Facade Transparency All facades viewed by the public contain more than 50 percent windows and/or doors. Loading Areas, Refuse Areas, etc. Loading to the building will be thorough the front entry. The trash enclosure is located along the southern property line and southeast of the proposed building. The enclosure utilizes the same exterior material as the building. Recycling space and other solid waste collection space should be contained within the same enclosure. The plan shows proposed grading, storm sewer and parking lot construction outside the property lines. The developer must work with the neighboring property owners, including the City, to Planning Commission • • Shops at Chanhassen— Planning Case 2014-28 September 16, 2014 Page 9 of 16 acquire a temporary construction easement for all off -site grading and construction. The developer must also acquire a permanent easement over all improvements the developer shall own and be responsible for maintaining, such as the storm sewer. The developer must obtain an access agreement from the City for construction and maintenance of the sanitary sewer and water main within the right of way of Target Lane. GRADING AND DRAINAGE The developer's engineer shall include the Perkin's parking lot islands in the topographic plan. Current plans do not show all islands within the survey area. Final plans shall include existing and proposed elevations at the property comers and structure corners. The grading plan shall include drainage arrows to indicate the direction of water flow. The developer shall submit an accurate soils report indicating soil conditions and permeability. The grading plan shall identify proposed stockpile areas. The grading plan shall show the top and bottom elevation of the retaining wall near the Target sign. STREETS & PARKING LOTS The developer hired Spack Consulting for a traffic study of this area and the signal timings at Target Lane/West 78a' Street and West 781 Street/Powers Boulevard. The results of the study showed that the proposed development would not alter the Level of Service designations at the intersections, and the data did not indicate the need for traffic improvements. In order to construct the water and sanitary sewer connections, Target Lane will be excavated and rebuilt to City standard specifications. The proposed alignment is adjusted so that Target Lane runs directly into the Target parking lot, while providing entrance into the Shops at Chanhassen lot. The parking spaces shall be adjusted so that minimum dimensions are measured from the gutter flow line. SANITARY SEWER AND WATER MAIN A proposed 6-inch, C900 water main will connect the development to the existing water main under West 78's Street. Final plans will show the profiles and avoid conflict with storm sewer. Proposed 6-inch and 8-inch PVC sanitary sewer main will connect the development to the existing sanitary manhole at Target Lane. Final plans will show the profiles and avoid conflict with storm sewer. The remaining SAC and WAC fees shall be collected with the building permit, based on the rates in effect at the time of building permit application. The party applying for the building permit is responsible for payment of that remainder. Gradina and Drainaee The site currently decreases in elevation from west to east with drainage working toward the right-of-way for Minnesota Department of Transportation and into pond LS-P3.31 located south of Target. Under the proposed conditions, surface water will be directed into a private storm sewer system before discharging into the same pond. The applicant shall provide Rational Method calculations for proposed pipe design. The applicant shall work with city staff to assure downstream system has adequate capacity to handle the additional volume directed from the new impervious surface. Stormwater Management The Riley -Purgatory -Bluff Creek Watershed District and the City of Chanhassen have both identified this pond as a good candidate for increased capacity and improved water quality treatment. Rather than have the applicant provide storm water management features on the subject property, the District and the applicant have agreed to take cash in lieu of these facilities. Otto Associates has provided an engineer's opinion of cost to treat 1.1 inches of water quality volume from the new impervious surfaces associated with this development. This opinion of cost was $25,000 and shall be due at time of final plat to be put into an account to be used exclusively for the improvement of downstream water quality. Grading and Erosion Prevention and Control The total disturbance will not exceed the minimum one -acre threshold to require a National Pollution Discharge Elimination System Construction Permit. The applicant has developed a preliminary erosion control plan. This plan must be consistent with Section 19-145 of Chanhassen City Code. One noted deficiency is that the swale west of the building must be stabilized within 48 hours prior to discharging. The developer must coordinate the proposed grading in the northeast comer of the site with the affected small utilities, as the plans show altering the grade in the vicinity of two small utility pads. Any fees paid for WAC and SAC units currently associated with the site will be credited to the WAC and SAC fee calculation. LANDSCAPING Minimum requirements for landscaping at Shops at Chanhassen include 1,728 square feet of landscaped area around the parking lot, three landscape islands or peninsulas, and six trees for the parking lot. The applicant's proposed as compared to the requirements for landscape area and parking lot trees is shown in the following table. An internal sense of order for the buildings and use on the site and provision of a desirable environment for occupants, visitors and general community; b. The amount and location of open space and landscaping; c. Materials, textures, colors and details of construction as an expression of the design concept and the compatibility of the same with adjacent and neighboring structures and uses; and d. Vehicular and pedestrian circulation, including walkways, interior drives and parking in terms of location and number of access points to the public streets, width of interior drives and access points, general interior circulation, separation of pedestrian and vehicular traffic and arrangement and amount of parking. (6) Protection of adjacent and neighboring properties through reasonable provision for surface water drainage, sound and sight buffers, preservation of views, light and air and those aspects of design not adequately covered by other regulations which may have substantial effects on neighboring land uses. Fes: The proposed development is consistent with the City's design requirements, the comprehensive plan, the zoning ordinance and the site plan review requirements. Staff is recommending approval of the request with conditions. The site design is compatible with the surrounding developments. It is functional and harmonious with the approved development for this area. The overall design is sensitive to the City's image. Based upon the foregoing, staff is recommending approval of the site plan with conditions outlined in the staff report. The Storm Water Utility fee is estimated to be $18,525.10 and shall be due at final plat. Park and Trail Full park fees in lieu of additional parkland dedication and/or trail construction shall be collected as a condition of approval for Shops at Chanhassen. The park fees will be collected in full at the rate in force upon final plat submission and approval. Detailed occupancy -related requirements will be addressed when complete building plans are submitted. 5. The owner and or their representative shall meet with the Inspections Division as soon as possible to discuss plan review and permit procedures. Engineering 1. The Minnesota Department of Transportation (MnDOT) has reviewed the site plan and has the following comment: Rater Resources: MnDOT does not allow an increase in storm water discharge to MnDOT right-of-way. Please submit documents specified below with a drainage permit application: l . Final drainage plan showing storm sewer plan, storm sewer and culvert profiles and pond contours 2. Existing and proposed drainage area maps with flow arrows 3. This item will appear before the City Council on October 13'. The applicant is Halifax Development, LLC. The actions before you tonight are two. One is a subdivision and the second is a site plan review. This property is located just south of West 780' Street and east of Powers Boulevard, surrounding what is called the Target PUD. It is an outlot called Chanhassen Retail 2°d Addition. There's 3 other restaurants in that site. If you recall the City went through a process of up -zoning some of the downtown core in order to encourage intensification of development and actually we had met with Target and then said that there's an opportunity, based on their parking, that they could put additional parking on some of the City's property and then put a restaurant maybe on West 78tb As it turned out the applicant is actually looking at putting the restaurant on the City's property and working through the parking with Target Corporation. So again access is gained via what's called Target Lane, which is a public street right here. So in order to assemble the property to make it fit on the site and work through the access to the site, Target Lane comes in and takes a sharp U-tum to go to the 3 restaurants and then also then you can coming south you could take a left going into Target. So through this subdivision you're actually reconvening the parking between Target and the proposed use. So property being sold to the, from the City is about 26,370 square feet and then property is being assembled from Target so there will be a subdivision of our parcel and then the Target parcel will be administratively added to that to create the lot so it'll be a total of .79 acres. So the original survey that was in the staff report shows the property plus there's a little piece that was added to it in order to put the utility, storm water into an easement. Not just an easement but property owned by the City so there'd be a little bit larger piece than what's shown on the survey but that will be corrected and recorded when we get to that phase. Just wanted to clarify that. So that's the subdivision on that. So the second part of it then would be, the site plan itself. So this is a little bit more detail on the, showing how the parking will be reconfigured and actually better access going into when you come down off of Target Lane, coming into the site. Reconfiguring those, that turning movement there. So you have Perkins that would be right in front of it so this building then would be right behind the, kind of behind the Perkins area there and the building itself as you can see right in this area here showing that parking and then in more detail here. So the building itself is, has two users in it and is 4,412 square feet so right now they have the one user that they know which will be Noodles and the second one is undetermined yet as tenant. So in order for the parking to work, there's enough for both Target and this user to be whole and requirement even for a restaurant with both, for the Target to maintain their's they will have a cross access easement across the Noodles property but both of them do meet the required standards of the ordinance of the parking standards. The other issue then would be the signs. They have submitted a sign plan. They can have signs on 3 elevations because it does Highway 5 and the change in grade. You'll get good visibility from the wall signs. We just want to make sure that, how we do channel letters are required. There's a little bit of, in the illustrations that they presented, again just illustrative of what they would do. We are confident that they would meet city ordinance as far as how they're put on the building itself and then they do have a, are 2 SCANNED Chanhassen Planning Commission — September 16, 2014 allowed a monument sign and that sign is off of Target Lane, kind of when you come in before you get to Perkins. The applicant may provide an opportunity for the other users in there to go on that too which is fine in the PUD and they would eliminate one of those if they, if that worked out and they could eliminate one of the other signs. If it doesn't then they would just continue to maintain their own sign on their property. They have submitted a landscaping plan. Again there is outdoor seating in this area here which is adjacent to Highway 5 so we wanted to make sure that that was landscaped well again because of the change in grades from Highway 5. Highway 5 is actually a little bit higher there. You have a berm that's going to the west so there is adequate screening for that outdoor seating. Again we encourage those sort of things on sites. They have submitted building material samples. I'll put that up but I've got that on the screen here too. Let's see. So the materials itself, the stucco and the brick. Lighter than when it originally came in. It originally came in, it was a little bit darker and so now they've lighten up the materials which we think looks a little bit better. Kind of what's within the surrounding areas. Again the Noodles has kind of their trademark, the red awning on the building itself which I think is a little bit kind of characteristic of what we saw on the BP site when we came on that kind of similar view. Perspective. So again this shows the two uses in a little bit more detail. So this would be the Noodles site and then potential other restaurant or retail site on that property and then the outdoor seating here too. And the dumpster which we have a condition again that it meets the same material as the building itself. And then we did ask for some illustrations again because of the views from Highway 5 and what you see on the top. The roof does have a parapet wall which is screening the rooftop equipment so again we think that it meets all the standards of the city ordinance. So with that we are recommending approval. Again the motion states for the preliminary plat and for the site plan so with that I'd be happy to answer any questions that you have. Aller: I think the report was well done. Straight forward. I don't have any questions. Does anybody else have? And for those again that are present or at home, all these materials are found on the Chanhassen website on a regular basis. You can go check out what's been done. What is being done and what has been done in the past. So with that would the applicant like to come forward and make a presentation? Aller: Do you foresee any problems with for instance snow removal or any of those other things that would be? Hans Kuhhnan: No, we're going to have an agreement with, we've got to work a lot of things out with Target with a number of easements we need with Target as well as maintenance. We're going to share maintenance of that roadway costs. The applicant shall submit $25,000 in lieu of constructing stormwater best management practices. This shall be due at time of final plat to be put into an account to be used exclusively for the improvement of water quality downstream of the site. 3. The erosion prevention and sediment control plan must be consistent with Section 19-145 of Chanhassen City Code. 4. The Storm Water Utility fee is estimated to be $22,345.40 and shall be due at final plat. Building Official 1. The building is required to have automatic fire extinguishing systems. 2. Building plans must be prepared and signed by design professionals licensed in the State of Minnesota. 3. Retaining walls over four feet high must be designed by a professional engineer and a permit must be obtained prior to construction. 4. Detailed occupancy -related requirements will be addressed when complete building plans are submitted. 5. The owner and or their representative shall meet with the Inspections Division as soon as possible to discuss plan review and permit procedures. Engineerinn 1. The developer must work with the neighboring property owners, including the City, to acquire temporary construction easement for all off -site grading and construction. 2. The developer must acquire a permanent easement over all improvements the developer shall own and be responsible for maintaining, such as the storm sewer. The site is located north of Highway 5 and east of Powers Boulevard. Access to the parcel will be gained off of West 78`h Street via Target Lane. Sewer and water are available to the site. APPLICABLE REGULATIONS • Chapter 20, Article II, Division 6, Site Plan Review • Chapter 20, Article XVIII, Central Business District • Chapter 20, Article XXIII, Division 7, Design Standards for Commercial, Industrial and Office - Institutional Development • Chapter 18, Subdivision BACKGROUND The City of Chanhassen through the HRA owns Outlot A, Chanhassen Retail Second Addition, which is approximately 1.47 acres. The property surrounds the three buildings west of Target including Taco Bell, Leeann Chin and Perkin's. This outlot is a remnant of the construction of the widening of West 781 Street and Powers Boulevard. A portion of the Target parking lot (7,877 square feet) will be added administratively to the city property to create the lot for the proposed building. The lot has street frontage. Access to the lot is gained off of a public street from Target Lane via West 78's Street. The minimum lot area in this PUD is 20,000 square feet. Lot 1 will have an area of 34,248 square feet. PARKS AND TRAILS The condition of approval for platting Outlot A, Chanhassen Retail Second Addition is the payment of park and dedication fees at the rate in force at the time of final plat approval. At today's rate the payment is $12,500 per acre. SUBDIVISION FINDINGS 1. The proposed subdivision is consistent with the zoning ordinance. Finding: The subdivision meets the intent of the city code subject to the conditions of the staff report. 2. The proposed subdivision is consistent with all applicable city, county and regional plans including but not limited to the city's comprehensive plan; Fes: The proposed subdivision is consistent with applicable plans. 3. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and storm water drainage are suitable for the proposed development; FindinE: The proposed site is suitable for development subject to the conditions specified in this report. 4. It shows signs along the east, north and south elevations as well as proposing a monument sign at the entrance into the site. Conflicting sign details and locations have been submitted. One ground low -profile business sign is permitted. The height of the sign shall not exceed 8 feet and square footage shall not exceed 64 square feet. All signs shall meet ordinance requirements pertaining to height, area, illumination and dimensional letters. Wall signs will be limited to three elevations, north, south and east. All signage will require separate permits. The applicant has approached staff regarding adding the name of one of the neighboring users on the proposed monument sign. Since this site is a PUD, staff has no objection to this request. However, the monument sign on the other site must be removed. LIGHTING/SIGNAGE A photometrics plan must be prepared for the site. The numbers may not exceed one-half foot candle at the project perimeter property line. This does not apply to street lighting. All fixtures including wall packs must be shielded. PARING The ordinance requires one parking space per 200 square feet for multi -tenant buildings. Twenty-three parking spaces are required. The applicant is showing 43 spaces, meeting the parking requirements. Additionally, the applicant has a cross -access agreement with Target. Target also exceeds their parking requirement of 533 spaces. Planning Commission Shops at Chanhassen— Planning Case 2014-28 September 16, 2014 Page 8 of 16 ARCHITECTURAL COMPLIANCE Size, Portion and Placement Entries: The building has pronounced entrances. Articulation: The building incorporates adequate detail and has been tastefully designed. The architectural style is unique to the building but will fit in with the surrounding area. The building will provide a variation in style through the use of brick, stucco, metal and glass. The building utilizes exterior materials that are durable and of high quality. Signs: All signage must meet the sign criteria in the Central Business District. The applicant may share a monument sign with another user in the same PUD contingent upon the removal of the existing monument sign. Material and Detail The building contains brick and stucco. High -quality materials are being used on the building. Color The colors chosen for the building are light tans and browns. The selection is unique, but blends in with the surrounding buildings. Height and Roof Design The building ranges in height between 17 and 19 feet. The district has no height limits. The structure is a single level. The roofline is staggered, adding articulation to the design of the building. The rooftop equipment is screened from views by a parapet wall. Facade Transparency All facades viewed by the public contain more than 50 percent windows and/or doors. Loading Areas, Refuse Areas, etc. Loading to the building will be thorough the front entry. The trash enclosure is located along the southern property line and southeast of the proposed building. The enclosure utilizes the same exterior material as the building. Recycling space and other solid waste collection space should be contained within the same enclosure. The plan shows proposed grading, storm sewer and parking lot construction outside the property lines. The developer must work with the neighboring property owners, including the City, to Planning Commission Shops at Chanhassen— Planning Case 2014-28 September 16, 2014 Page 9 of 16 acquire a temporary construction easement for all off -site grading and construction. The developer must also acquire a permanent easement over all improvements the developer shall own and be responsible for maintaining, such as the storm sewer. The developer must obtain an access agreement from the City for construction and maintenance of the sanitary sewer and water main within the right of way of Target Lane. GRADING AND DRAINAGE The developer's engineer shall include the Perkin's parking lot islands in the topographic plan. Current plans do not show all islands within the survey area. Final plans shall include existing and proposed elevations at the property corners and structure corners. The grading plan shall include drainage arrows to indicate the direction of water flow. The developer shall submit an accurate soils report indicating soil conditions and permeability. The grading plan shall identify proposed stockpile areas. The grading plan shall show the top and bottom elevation of the retaining wall near the Target sign. STREETS & PARKING LOTS The developer hired Spack Consulting for a traffic study of this area and the signal timings at Target Lane(West 78 h Street and West 78'b Street/Powers Boulevard. The results of the study showed that the proposed development would not alter the Level of Service designations at the intersections, and the data did not indicate the need for traffic improvements. In order to construct the water and sanitary sewer connections, Target Lane will be excavated and rebuilt to City standard specifications. The proposed alignment is adjusted so that Target Lane runs directly into the Target parking lot, while providing entrance into the Shops at Chanhassen lot. The parking spaces shall be adjusted so that minimum dimensions are measured from the gutter flow line. SANITARY SEWER AND WATER MAIN A proposed 6-inch, C900 water main will connect the development to the existing water main under West 78`s Street. Final plans will show the profiles and avoid conflict with storm sewer. Proposed 6-inch and 8-inch PVC sanitary sewer main will connect the development to the existing sanitary manhole at Target Lane. Final plans will show the profiles and avoid conflict with storm sewer. Planning Commission Shops at Chanhassen— Planning Case 2014-28 September 16, 2014 Page 10 of 16 The developer must pay the partial payment of the SAC fees and the WAC fees with the final plat. The remaining SAC and WAC fees shall be collected with the building permit, based on the rates in effect at the time of building permit application. The party applying for the building permit is responsible for payment of that remainder. Grading and Drainage The site currently decreases in elevation from west to east with drainage working toward the right-of-way for Minnesota Department of Transportation and into pond LS-P3.31 located south of Target. Under the proposed conditions, surface water will be directed into a private storm sewer system before discharging into the same pond. The applicant shall provide Rational Method calculations for proposed pipe design. The applicant shall work with city staff to assure downstream system has adequate capacity to handle the additional volume directed from the new impervious surface. Stormwater Management The Riley -Purgatory -Bluff Creek Watershed District and the City of Chanhassen have both identified this pond as a good candidate for increased capacity and improved water quality treatment. Rather than have the applicant provide storm water management features on the subject property, the District and the applicant have agreed to take cash in lieu of these facilities. Otto Associates has provided an engineer's opinion of cost to treat 1.1 inches of water quality volume from the new impervious surfaces associated with this development. This opinion of cost was $25,000 and shall be due at time of final plat to be put into an account to be used exclusively for the improvement of downstream water quality. Grading and Erosion Prevention and Control The total disturbance will not exceed the minimum one -acre threshold to require a National Pollution Discharge Elimination System Construction Permit. The applicant has developed a preliminary erosion control plan. This plan must be consistent with Section 19-145 of Chanhassen City Code. One noted deficiency is that the swale west of the building must be stabilized within 48 hours prior to discharging. The developer must coordinate the proposed grading in the northeast corner of the site with the affected small utilities, as the plans show altering the grade in the vicinity of two small utility pads. Any fees paid for WAC and SAC units currently associated with the site will be credited to the WAC and SAC fee calculation. LANDSCAPING A �r•D« Minimum requirements for landscaping at Shops at Chanhassen include 1,728 square feet of landscaped area around the parking lot, three landscape islands or peninsulas, and six trees for the parking lot. The applicant's proposed as compared to the requirements for landscape area and parking lot trees is shown in the following table. An internal sense of order for the buildings and use on the site and provision of a desirable environment for occupants, visitors and general community; b. The amount and location of open space and landscaping; c. Materials, textures, colors and details of construction as an expression of the design concept and the compatibility of the same with adjacent and neighboring structures and uses; and d. Vehicular and pedestrian circulation, including walkways, interior drives and parking in terms of location and number of access points to the public streets, width of interior drives and access points, general interior circulation, separation of pedestrian and vehicular traffic and arrangement and amount of parking. (6) Protection of adjacent and neighboring properties through reasonable provision for surface water drainage, sound and sight buffers, preservation of views, light and air and those aspects of design not adequately covered by other regulations which may have substantial effects on neighboring land uses. Finding: The proposed development is consistent with the City's design requirements, the comprehensive plan, the zoning ordinance and the site plan review requirements. Staff is recommending approval of the request with conditions. The site design is compatible with the surrounding developments. It is functional and harmonious with the approved development for this area. The overall design is sensitive to the City's image. Based upon the foregoing, staff is recommending approval of the site plan with conditions outlined in the staff report.
