MINUTES
JANUARY 22, 2024
Mayor Ryan called the meeting to order at 7:00 p.m. The meeting was opened with the Pledge of
Allegiance.
COUNCIL MEMBERS PRESENT: Mayor Ryan, Councilman McDonald, Councilwoman
Schubert, Councilman von Oven, and Councilman Kimber.
COUNCIL MEMBERS ABSENT: None.
STAFF PRESENT: Laurie Hokkanen, City Manager; Matt Unmacht, Assistant City Manager/
Andrea McDowell-Poehler, City Attorney; Eric Maass, Planning Director; Charlie Howley,

PUBLIC ANNOUNCEMENTS: None.
CONSENT AGENDA: Councilman McDonald moved, Councilman Kimber seconded that
the City Council approve the following consent agenda items 1 through 14 pursuant to the
City Manager’s recommendations:
1. Approve City Council Minutes dated January 8, 2024
2. Receive Environmental Commission Minutes dated December 13, 2023
3. Receive Economic Development Commission Minutes dated December 12, 2023
4. Receive Planning Commission Minutes dated December 5, 2023
5. Approve Claims Paid dated January 22, 2024
6. Approve Professional Services Agreement with SEH, Lake Ann Park Preserve

All voted in favor, and the motion carried unanimously with a vote of 5 to 0.
VISITOR PRESENTATIONS.
Michelle Marie King, 2375 Stone Creek Drive, founder of Positive Presence Global, stated that
her company is a life-coaching company for teenagers nationwide. She shared that high school
students face increased mental health challenges and issues with bullying and cyberbullying. She
reviewed the mentor-life coaching program she established and how it has impacted teenagers
nationwide. She encouraged local leaders to establish proactive mental health practices within
the community to support teenagers and parents.
Mayor Ryan thanked Michelle Marie King for her time and the information she provided.
PUBLIC HEARINGS. None.
GENERAL BUSINESS.
1. Ordinance 721: Amending Lot Cover Standards in the Shoreland Overlay Zoning
District
Planning Director Eric Maass reviewed the current ordinance for the shoreland overlay district.
He presented the proposed changes to the shoreland overlay district ordinance and two maps to
show the lot establishments that are eligible for the five percent lot cover increase.
Public Works Director/City Engineer Charlie Howley explained the relationship between lot
cover and water resource management, including mitigation through best management practices.
He described how impervious surfaces are regulated through various jurisdictional agencies
depending on the project scale.

Mr. Maass mentioned that there would be best management practices required for impervious lot
areas between 25 percent and 30 percent. He provided examples of lots in Chanhassen to explain
the impervious allowance and required vegetative buffer. He noted the Planning Commission
recommendations.
Councilman von Oven asked where the vegetative buffer would be located if it is on a property-
to-property basis.
Mr. Maass responded that staff would work with the property owner to determine where the
vegetative buffer would need to go to properly adhere to the ordinance.
Councilman von Oven asked if a vegetative buffer would remain on the property permanently.
Mr. Maass responded that the vegetative buffer would need to be placed in a conservation
easement. Staff would monitor the vegetative buffer to make sure it was functioning.
Councilwoman Schubert inquired about what steps a property owner would need to take for a
variance request.
Mr. Maass responded that applicants must pay for a variance request. Staff will work with
residents to explain the variance request needs, including a possible site plan and a variance
request fee.
Councilman Kimber thanked Mr. Maass for the visuals to address how vegetative buffers are
placed on a property.
Mayor Ryan asked if properties established after 1976 would still be permitted to go through the
variance requests.
Mr. Maass confirmed these properties could request a variance. Staff would look at existing
standards to respond to variance requests.
Councilman von Oven asked if lots created before January 1, 1976, could apply for a variance
request if they did not want to do a vegetative buffer.
Mr. Maass answered there is administrative room within the proposed ordinance to address
multiple property requests.
Councilwoman Schubert asked if any surrounding cities are considering decreasing their
impervious lot size from 30 percent to 25 percent.
Mayor Ryan thanked Mr. Maass for the time he invested working with the Minnesota
Department of Natural Resources to propose this ordinance.
Councilwoman Schubert moved, Councilman Kimber seconded that the Chanhassen City
Council adopt Ordinance 721, amending Section 20-485 of the Chanhassen City Code,

increasing the amounts of impervious lot cover allowed within the Shoreland Overlay
Zoning District and directing staff to submit the adopted ordinance to the Minnesota DNR
for final review and approval and approves the summary ordinance for publication
purposes. All voted in favor, and the motion carried unanimously with a vote of 5 to 0.
2. Ordinance 722: Amending Lot Cover Standards in the Single Family Residential (RSF)
Zoning District
Planner Rachel Jeske reviewed the proposed ordinance amendment for the RSF Zoning District.
Ms. Jeske presented the zoning map where the ordinance would apply. The proposed ordinance
amendment would not apply to Planned Unit Developments, which have separate lot cover
standards. Ms. Jeske displayed the Planning Commission recommendation.
Mayor Ryan thanked Ms. Jeske for the presentation.
Councilman Kimber moved, Councilman McDonald seconded that the Chanhassen City
Council adopt Ordinance 722, amending lot cover standards in the Single Family
Residential zoning district, and approve the summary ordinance for publication purposes.
All voted in favor, and the motion carried unanimously with a vote of 5 to 0.

Councilman McDonald moved, Councilwoman Schubert seconded to adjourn the meeting.
All voted in favor, and the motion carried unanimously with a vote of 5 to 0. The City
Council meeting was adjourned at 7:36 p.m.
