The Preserve at Bluff Creek 151 Addition
BACKGROUND
The Ryland Group has requested the drainage and utility easements in Outlot A, The Preserve at Bluff
Creek 151 Addition be vacated. The property is located on the south side of Lyman Boulevard at the
intersection of the northern segment of Audubon Boulevard.
A drainage and utility easement was granted in 2006 to the City for the installation of trunk sanitary
sewer and water. The trunk sanitary sewer and watermain extend through proposed Outlots A and H,
The Preserve at Bluff Creek 2nd Addition and the right of way for a future street extending from the
Lyman Boulevard/Audubon Road (north) intersection. Outlots A and H will be deeded to the City and
will be subject to blanket drainage and utility easements. The future lots along Degler Drive extension
will have oversized backyard drainage and utility easements extending minimum 10 feet from the
adjacent trunk utility. Until these lots are final platted, a blanket drainage and utility easement will be
placed over Outlot B.
The exhibit included in the easement document contains a sketch and description of the drainage and
utility easement. The developer's engineer discovered that the legal description does not match the
accompanying sketch. The City Attorney advised staff to vacate both the drainage and utility easement
as shown on the sketch and the one described in the legal description.
