ATTACHMENTS Memo - Minnewashta Pkwy and Kings Road Intersection Kings Road Staff Report dated August 12, 2024 5 Memorandum To: Laurie Hokkanen, City Manager From: Charlie Howley, Public Works Director/City Engineer Date: 8/21/2024 Re: Traffic and Pedestrian control measures at the Minnewashta Parkway and Kings Road intersection BACKGROUND Since the inception of the AATP Highway 5 Improvement Project concept was introduced in 2020, there has been some public opposition to where the new Arboretum entrance will be located on Hwy 5 (proposed to be located at the existing intersection of Hwy 5 and Minnewashta Parkway). The public opposition primarily revolves around existing traffic patterns and pedestrian safety the Minnewashta Parkway corridor, and the fear that the proposed Hwy 5 project, once completed, will make an already unsafe condition worse. One of the most consistent requests of the public is to add stop signs on Minnewashta Parkway at the intersection with Kings Road. The existing condition is a standard three-legged intersection with no stop control on the Parkway, and a stop sign on Kings Road. The public opinion being submitted is that by adding stop signs on the Parkway, it will slow vehicles down along the corridor, will provide a safe pedestrian crossing at the intersection, and that it will be a deterrent to future vehicles from using the Parkway as a shorter way to access the Arboretum. EVALUATION OF OPTIONS To help understand the options at his intersection, staff has put together a matrix that compares the pros and cons of the various strategies. RECOMMENDATION Based on the matrix, there are no wrong solutions, but it seems as if there are multiple strategies that could reasonably be selected as the improvement to make. It’s safe to assume that a do- nothing option is not the best approach to take. Staff’s position is one of short term vs. long term. In the short term, Option 3, which is introducing a striped median with plastic bollards, appears to be the best suited solution. The table below shows the trip generation potential for a development of this size according to ITE Trip Generation, 7th Edition After routing these trips through the Kings Rd at Minnewashta Pkwy intersection, we meet 0 of 8 hours required for all-way stop warrants (see attached) To give you an idea of how this added traffic would impact traffic delays at the sidestreet stop controlled Kings Rd at Minnewashta Pkwy intersection, we’ve ran some Highway Capacity Manual calculations to determine those sidestreet delays: Scenario AM Peak Average Delay/Vehicle (sec.) - LOS PM Peak Average Delay/Vehicle (sec.) - LOS Existing 9.3 - A 9.6 - A Existing + Added Homes 10.3 - B 10.9 - B Summary – 163 added homes does add a notable amount of traffic in comparison to the existing Kings Rd and Minnewashta Pkwy volumes. However, the existing roadways and intersection traffic control have sufficient capacity to serve these added trips efficiently. Motion Type Simple Majority Vote of members present Strategic Priority Operational Excellence SUMMARY Consideration of adding stop signs on Minnewashta Parkway at Kings Road. BACKGROUND N/A DISCUSSION There is tremendous interest from the local community to install permanent stop signs on Minnewashta Parkway at the intersection of Kings Road. This location is unique and could reasonably be seen as a candidate for a stop sign. The unique circumstances include: 13 The proximity of the existing trail and therefore pedestrians and bikers relative to the road This intersection is the main crossing point from the west side of Minnewashta Parkway to the east side in proximity of Roundhouse Park The location of the public beach and fishing pier, which has no vehicular parking and therefore all access is by foot or bike Seasonally high pedestrian volumes The potential influx of vehicular traffic on the Parkway due to the Highway 5 Improvement project The stop signs would be standard size (30'x30") and installed on the back side of the adjacent trail, including a red reflective strip on the posts. The signs could be installed within a couple of days of approval by the City Council. Alternate options for a blinking style are as follows: 1. Continuous blinking, battery powered, ~$2000ea, 2-week lead time 2. Radar triggered blinking, solar powered, ~$5000ea, 6-week lead time (similar to what's at Lake Dr/Dakota by McDonalds) Update on August 12, 2024: The summary of Bolton & Menk's second analysis at the intersection as it relates to all-way stop, stop warrants and pedestrian/bike safety. BUDGET The cost to furnish and install the standard signs is immaterial and can be absorbed in the Public Works annual operating budget. Blinking signs would put our line item over budget. RECOMMENDATION From strictly an Engineering standpoint, the data currently available does not provide justification to support the installation of a stop sign at this location. There is, however, other justifications supporting the installation such as: The potential increase in traffic volume resulting from the upcoming Hwy 5 Improvement project The proximity to a public park, a public beach, and a public trail Forthcoming updated data collection of pedestrian counts at this intersection (currently being collected) The theoretical implications to vehicle navigation applications as a strategy to reroute shortest routes Therefore, it's reasonable to support the installation of the stop signs at this location. BACKGROUND DISCUSSION BUDGET RECOMMENDATION 15 ATTACHMENTS Memo - Prelim 2025 Budget and Levy Discussion 2024-08-26 FINAL 16 1 Date: August 26, 2024 To:Mayor and Council Members From: Kelly Grinnell, Finance Director Re:Preliminary 2025 Budget & Levy Discussion 2025 General Fund Budget Since the June council work session staff has continued to refine the 2025 General Fund budget. There were several items pending at that time that are now known. Wages and Benefits The current union contract is in effect through 2025. The contract calls for a 3% COLA for union employees, therefore a 3% COLA would be budgeted for all FTEs. Eligible employees will also receive a step increase of 3%. The City issued an RFP for health insurance this year (this is required by state statute every five years). The results of the RFP were very favorable, with our current provider offering a 5% reduction in premium. Staff is still reviewing options to determine if another provider offers a better option. We had originally budgeted a 10% increase and have $30,000 in assigned fund balance (if premiums are significantly higher than expected). We will not have results for dental insurance for another month. There is currently a vacant position for a Senior Planner and staff has budgeted to replace this position with a Facilities Maintenance Technician position. With these changes, the overall wages and benefits portion of the 2025 General Fund budget is increasing by 1.4%, or $122,699, from $8,532,155 to $8,654,854. In June we were expecting a 2.8% overall increase in wages and benefits. Other Expenses Other expenses for the 2025 General Fund budget are expected to increase 6.3%, from $7,121,196 to $7,570,388. Some of the significant changes include: AI Madison Software - $25,000 No election in 2025 – decrease in budget from 2024 of $33,000 Carver County Sheriff’s Contract – up $171,448, a 6.9% increase, compared to 12.5% in 2024 and 8.4% in 2023 There is no required municipal contribution to the Fire Relief Association – In June we had $50,000 included Wildlife population management - $10,000 budgeted – this amount will likely increase in future years, as the city will be limited in what can be done in 2025 due to regulations Lifeguard Contract - $40,000 is included, but may not be needed – staff will review how the season at Lake Ann went without lifeguards in 2024 and make a recommendation to council Solar Garden rate credits – due to rate change from MN Public Utilities Commission we will likely lose most of our credit, which is about $46,200 among all funds for 2025. The change takes effect in April 2025. The impact on the General Fund is about $19,000 for 2025 and $34,000 for 2026. Other funds affected include the Water and Sewer Funds. The impact on the 17 2 Water Fund is about $19,000 for 2025 and $31,000 for 2026. The impact on the Sewer Fund is about $8,000 for 2025 and $14,000 for 2026. Overall Expenses Total expenses for the current draft of the 2025 General Fund budget are $16,225,242, up 3.7%, or $571,892, compared to $15,653,350 for 2024. Revenues Total revenues for the current draft of the 2025 General Fund budget are $16,299,100, up 3.5%, or $555,750, compared to $15,743,350 for 2024. Most of the increase is due to a 4% increase in the General Fund levy, which adds $474,000. Fire aid is expected to increase by $40,000. Investment income is projected to increase by $50,000. Budget Surplus The current budget draft shows a budget surplus of about $74,000. Staff requests council feedback on options for the surplus: Option 1 – Reduce the General Fund Levy by $74,000, this would decrease the overall property tax levy increase from 7.1% to 6.6%. Option 2 – Add a contingency line item to the budget of $74,000. There is currently no contingency amount included in the budget, but this would give flexibility for unexpected opportunities or expenses. Option 3 – Add an FTE for a Parks Operator position to begin on July 1, 2025. Staff has identified a new for help in parks maintenance as the city continues to grow. Option 4 – Reduce the General Fund levy by $74,000 but increase the levy for the Capital Vehicle & Equipment fund by $74,000. Staff is working to expand the current Capital Improvement Plan forecast from five to ten years. The ten-year forecast is showing that current funding levels will likely be inadequate given the need to replace the Fire Engine in 2029. 2025 Other Funds The City has several other budgeted funds, including special revenue funds and capital project funds. Staff is working on updates to the Capital Improvement Plan (CIP) for 2025-2029 and adding projections for 2030-2034. The 2025-2029 CIP will be presented at a future work session. The City has three Enterprise (or Utility) Funds: Water, Sewer, and Storm Water. These funds do not have a property tax levy and are operated like a business, with user fees set to cover operating, capital, and debt expenses. Budgets for these funds will be considered in the fall. Property Tax Levy Projections The table below shows levy projections from the December 2023 Truth in Taxation meeting based on the 7.4% increase in 2024 and new levies for City Hall Campus debt: 18 3 Staff has refined the projections based on new debt service for the Civic Campus and with the potential addition of debt for the Chanhassen Bluffs Recreation Center: Impact on Property Tax Market Values for Pay 2025 Homestead Market Value Exclusion (HMVE) Increased The 2023 MN State legislature increased the market value exclusion for homeowners. The HMVE decreases property taxes on lower-valued owner-occupied homes. Beginning with taxes payable in 2025, the HMVE exclusion increased from $413,800 to $517,200. The increase in the HMVE slightly decreases tax capacity for the City and slightly higher property taxes for higher valued homes and commercial/industrial properties. Projected Property Tax Increases for Various Properties The table below shows projected property tax increases for various residential properties.The impact to Home A is lower due to the HMVE change described above. 19 4 The table below shows projected property tax increases for two commercial/industrial properties. The impact to these properties is greater than the impact to residential properties due to the projected higher increase in market value. Residential properties increased in value by about 1.07% compared to the 5.16% increase in commercial/industrial properties. Next Steps The council is required to adopt a preliminary tax levy by September 30 of each year and hold a Truth in Taxation public meeting prior to adopting a final levy and budget before the end of the calendar year. The next council work session to discuss the budget is scheduled for September 9, 2024.Due to council member schedules, the plan is to adopt preliminary tax levy at the council meeting later that night. If necessary, the preliminary tax levy could be adopted at the September 23, 2024, meeting. He noted that clarity was added to the contract but no major changes were made. The terms of the redevelopment agreement have been satisfied and the assessment agreement has been paid in full. As a result it is appropriate to terminate the Redevelopment Agreement and Assessment Agreement. Chanhassen Bluffs Community Center: Ballot Question Councilmember Kimber stated that he is hearing from residents that a pool is very important to them to have as a part of the Chanhassen Bluffs Community Center. He brought forward language to include two questions for the ballot. Question one would be regarding the Local Option Sales Tax and if question one passed, question two would be should a pool be included in the plan. Councilmember McDonald said that he liked including the question about the pool. Councilmember Schubert said she was still not comfortable with including the pool because the long- term costs would be so high. Mayor Ryan would like to keep just the first question because she is not ready to support the cost of a pool. Councilmember McDonald said that the public has asked for a pool and if residents have been educated about the costs of a pool, then we should put the question on the ballot because the residents are the ones that should make the decision. Councilmember Kimber said that the residents should decide. He suggested putting both questions on the ballot and communicating the costs to let the residents have a stay. He then said that he has heard from residents that they don’t like to go to the neighboring pools in the area and pay non-resident prices. He asked if there was a way to negotiate reciprocity with another city to get the costs down. Laurie Hokkanen, City Manager reported that the city has not yet explored that option but that there could be negotiations to provide reciprocity for lower costs to access other pools in the area. The council members discussed the wording of the questions. It was decided that the ballot question would be just one question regarding the sales tax. 36 City Council Work Session Minutes – August 12, 2024 2 Minnewashta Parkway Traffic Workshop Follow-Up Discussion Mayor Ryan reported that city staff had hosted a neighborhood meeting to get input from residents about the Minnewashta Parkway Traffic changes. There was good attendance at the meeting and staff received a lot of feedback. There is an item on the agenda for the council meeting that addresses a stop sign at Kings Road that neighbors have requested. Charlie Howley, Public Works Director/City Engineer, told the council that at the neighborhood meeting residents brought up a safe crossing at Kings Road, lowering the speed limit on Minnewashta Parkway, increased enforcement of the speed limit, directing traffic to different routes, Landscape Arboretum helping to beautify the parkway, and a right-in/right-out option to the intersection at Highway 5. Councilmember Schubert asked if the Arboretum was planning on still having the exit to the Arboretum where the current entrance is located since the entrance is being moved to Minnewashta Parkway. Mr. Howley responded that the Arboretum was planning on having people enter off Highway 5 at the light on Minnewashta and then pay on exit at the east road that is currently the entrance. Discussion was had about a stop sign at Kings Road and if that was the best option for safely crossing. Councilmember McDonald said he would prefer a pedestrian light crossing at Kings Road instead of a stop sign. He was concerned that a stop sign was not as safe as a flashing pedestrian crossing. Mayor Ryan asked for more details from Engineering about a stop sign to determine if that was the best option or may a pedestrian crossing be safer, Mr. Howley responded that the data came back, and it shows that there aren’t enough pedestrians using the intersection to meet the qualifications of a stop sign. However, residents are requesting a stop sign and it is reasonable that one be put up. He said that the cost of a flashing light pedestrian crossing would be approximately $35,000-$40,000. Placing a stop sign at the Kings Road crossing would be approximately $148. It was decided to table the Kings Road stop sign item from the City Council agenda and get more detail from staff to decide on a stop sign versus a flashing light pedestrian crossing. The discussion was paused for the City Council meeting. Mayor Ryan recessed the work session at 6:55 Mayor Ryan reconvened the work session at 7:36 Minnewashta Parkway Traffic Workshop Follow-Up Discussion - Continued Mayor Ryan reconvened the conversation starting with the question of how best to get people safely across the street. Councilmember McDonald agreed that addressing safety concerns and cost to find the best solution. Mr. Howley started the discussion by asking if there was any interest in a mini roundabout. It accomplishes many goals. The cost of that would be approximately $700,000. 37 City Council Work Session Minutes – August 12, 2024 3 Councilmember Schubert asked if there was more development in the area, how would that affect the crossing and what are the long-term goals? Mayor Ryan asked for more information on short-term, mid-term, and long-term goals for the road. She said that the money for a mini round about doesn’t currently exist. Mr. Howley said that he would come back to a future meeting with a memo on solutions for the area including cost and the best option for safely crossing, as safety was the most important to the councilmembers. Mayor Ryan then brought up speed control in the area and the possibility of reducing the speed limit. Mr. Howley said that there had been discussions in the past about lowering the speed limit within city limits. He said that the city needs to be consistent with speeds and that lowering a speed on one road means that other roads may need to have a lower speed limit as well. He said that lowering the speed limit city wide would be easier. Mayor Ryan said she was in support of changing the city speed limit to 25 MPH and then have increased enforcement. Discussion was then regarding a right-in/right-out intersection at Minnewashta and Highway 5. The council decided that was not a good decision for the intersection. Mayor Ryan brought up the resident’s suggestion of having the Arboretum beautify the Parkway and all agreed that was not the Arboretum’s responsibility. Mr. Howley agreed. The requested information will be added to the August 26 work session to review. Discuss Comprehensive Plan Land Use and Zoning District Designation at 6440 Hazeltine Blvd Eric Maass, Planning Director, introduced Tyler Stevens, Clover Investments. Tyler is looking to develop land at 6440 Hazeltine Boulevard and has put in a request to change the zoning of the property to appeal to possible investors. The property has 5.5 acres of land and a large elevation change of approximately 60 feet. It is located next to the planned roundabout across from Minnetona Middle School West. Mr. Maass said that the land is currently zoned Medium Density. Mr. Stevens is looking to change to High Density to appeal to an apartment building and homes. There were two possible rough drafts of development that were shown but neither one was a finished product. They show possible development that would need work before a development application was submitted. Councilmember Schubert asked how many stories the proposed apartment building would have. Mr. Maass replied that base zoning allows for three stories because of the drop in the land. Mayor Ryan, Councilmember McDonald, and Councilmember Kimber all said they would like more of an understanding of what would be built there to help guide them in changing the zoning. Mr. Stevens said that the roundabout has changed how they can develop the land and to market it there needs to be a change in zoning to let developers know what is possible. 38 City Council Work Session Minutes –August 12, 2024 4 Mayor Ryan said she can appreciate that, but the City Council would need to see more specific plans to help them determine the appropriate zoning and impact of the development. Citizen Action Request Form: Nick Gardino Nick Gardino, 7050 Mill Creek Lane, voiced opposition to the draft about providing services to Victoria as it would provide an undue burden to residents. He explained the differences between Victoria and Chanhassen zoning codes and stated concerns about approving the resolution because of these differences and tax concerns. He thanked Mayor Ryan for arranging the public hearing with the developer and commented that residents would be willing to fight this resolution. 2. Citizen Action Request Form: Tyler Adam Tyler Adam, 900 Saddlebrook Trail, discussed the Lake Ann development project. He commented that the forest between Lake Ann and Lake Lucy was unique and provided a habitat for small animals. He voiced concerns about the paving project and its impact on the environment. He stated that allowing the trail to remain natural would save money and honor Prince, who previously owned the land. 42 City Council Minutes – August 12, 2024 3 James Cardwell, 7115 King’s Road, Victoria, commented on the agenda items' title change and asked whether this would set a precedent to establish access to Chanhassen sewer and water services for future projects. He expressed concerns about the safety in the neighborhood with the proposed expansion. Linda Paulsen, 7603 Frontier Trail, voiced her appreciation for discussing the fireplace in the High Timber Lounge. PUBLIC HEARINGS.None. GENERAL BUSINESS. 1. Consider Preliminary Plat, Final Plat, and Development Contract Approval for Waterview, a proposed 5-lot subdivision at 6870 Minnewashta Parkway Eric Maass, Community Development Director, explained that subdivisions typically contain detailed construction plans. He stated this development completes a subdivision and does not need additional roads, which is why the developer submitted the preliminary plat, final plat, and development contract at the same time. Rachel Jeske, Planner, reviewed the scope of the 6870 Minnewashta Parkway subdivision and community engagement completed for the project to this point. She displayed the existing conditions and location of the project. She reviewed the proposal for the project and the staff comments for the landscaping plan. She explained the access for the lots on White Oak Lane and Stratford Lane. She summarized the existing utilities and additional utility needs. Mayor Ryan asked if Outlot A and Outlot B would have lake access. Ms. Jeske answered that Outlot A would be a part of Lot 4 and Outlot B would be a part of Lot 5 and would have lake access. They cannot be sold separately. Mayor Ryan stated that Lake Minnewashta Association had restrictions and asked if lots were currently in place. Ms. Jeske responded that she thought there was one dock in place, but one would need to be added. Mayor Ryan asked if this would be a part of the development contract. Ms. Jeske answered that the city does not regulate docks, but each property is permitted one dock. Mayor Ryan asked if there were stairs going down to the shore. 43 City Council Minutes – August 12, 2024 4 Ms. Jeske responded that Outlot A had concrete stairs to the lakeshore and Outlot B had a driveway. Mayor Ryan asked if anything could be developed on these outlots. Ms. Jeske answered that there could typically be one lake-related structure per lot but they need to follow setbacks. She commented that Outlot A had a steep slope. Mr. Maass stated that when the developer was looking at these lots, the question was asked if all five lots could have lake access. The area around the lake does not have enough area for a beach lot. He explained the process to determine the outlots and connection to the respective lots. Mayor Ryan asked if there was a shared driveway. Ms. Jeske responded that there was no shared driveway. Councilmember Kimber moved, Councilmember McDonald seconded that the Chanhassen City Council approve the requested preliminary plat, final plat, and development contract for the five-lot subdivision located at 6870 Minnewashta Parkway subject to the conditions of approval and adopt the attached Findings of Fact and Decision. The cost for this improvement will be paid for by future developments with future connection fees and development assessments. The business is being purchased by Ashley Gauthier. The business is located at 7882 Market Boulevard. BACKGROUND DISCUSSION Ashley Gauthier is the sole owner of Artistic Timber LLC. Law Enforcement conducted a background investigation, including criminal history, driving records, outstanding warrants, financial, and references on Ms. Gauthier. Sargent Jake Hodge reviewed the 107 background summary and noted that there was nothing questionable related to State Statute. A certificate of insurance showing Liquor Liability and Workers Compensation and the lease agreement need to be provided to the city and is a condition of approval. A public hearing notice was published in the Sun Sailor on August 15, 2024 and mailed to all property owners within 500 feet of the site (see attached list). As of the date of this writing, staff has not received any comments from the public. BUDGET The required annual fee for an on-sale beer and wine liquor license is $410 and the background investigation fee is $250. The applicant paid the background investigation fee at the time of application along with the fee for the liquor license. BACKGROUND N/A DISCUSSION There is tremendous interest from the local community to install permanent stop signs on Minnewashta Parkway at the intersection of Kings Road. This location is unique and could reasonably be seen as a candidate for a stop sign. The unique circumstances include: 119 The proximity of the existing trail and therefore pedestrians and bikers relative to the road This intersection is the main crossing point from the west side of Minnewashta Parkway to the east side in proximity of Roundhouse Park The location of the public beach and fishing pier, which has no vehicular parking and therefore all access is by foot or bike Seasonally high pedestrian volumes The potential influx of vehicular traffic on the Parkway due to the Highway 5 Improvement project The stop signs would be standard size (30'x30") and installed on the back side of the adjacent trail, including a red reflective strip on the posts. The signs could be installed within a couple of days of approval by the City Council. Alternate options for a blinking style are as follows: 1. Continuous blinking, battery powered, ~$2000ea, 2-week lead time 2. Radar triggered blinking, solar powered, ~$5000ea, 6-week lead time (similar to what's at Lake Dr/Dakota by McDonalds) BUDGET The cost to furnish and install the standard signs is immaterial and can be absorbed in the Public Works annual operating budget. Blinking signs would put our line item over budget. RECOMMENDATION From strictly an Engineering standpoint, the data currently available does not provide justification to support the installation of a stop sign at this location. There is, however, other justifications supporting the installation such as: The potential increase in traffic volume resulting from the upcoming Hwy 5 Improvement project The proximity to a public park, a public beach, and a public trail Forthcoming updated data collection of pedestrian counts at this intersection (currently being collected) The theoretical implications to vehicle navigation applications as a strategy to reroute shortest routes Therefore, it's reasonable to support the installation of the stop signs at this location. Motion Type Simple Majority Vote of members present Strategic Priority Development & Redevelopment SUMMARY Chanhassen is being asked to provide public utility service to property within the City of Victoria. This arrangement is something that Chanhassen has done previously with examples being Tristan Heights in Victoria and Deer Ridge in Shorewood. Additionally, properties in Chanhassen were granted access to utilities from the City of Eden Prairie in the Trails End neighborhood when that neighborhood was established. A developer (Norton Homes) is looking to develop property generally located at 7050 Kings Road. The property is within the City of Victoria but does not have vehicular access nor access to municipal utilities from the Victoria side due to the divide created by the Lake Minnetonka Regional trail corridor. The approximately eight-acre property currently consists of a single-family home that has a shared driveway off of Kings Road that also serves a property to the east. The property is currently on well and septic. The proposal shows the approximately 8 acre property being subdivided into 16 homes. The homes would each be custom home builds and are expected to have a sale price of between $1,000,000 121 and $2,000.000 dollars. The City of Victoria is supportive of the proposed development, but that support is contingent upon the City of Chanhassen's support in providing municipal (water and sewer) utilities to the new properties. The City Council received a petition from residents in the area of the proposed development requesting the following: The Developer should hold a neighborhood meeting so that the residents in the area could have an opportunity to learn more about the project and discuss their concerns with the Developer. Norton Homes held a neighborhood meeting on Wednesday August 21st from 6:00-7:30pm at the Chanhassen Recreation Center. Invitations were mailed to approximately 60 homes in both Chanhassen and Victoria with approximately 16 residents attending. Concerns shared at the meeting included lot characteristics (lot area, lot width, and lot frontage), increased traffic, park dedication fees, potential annexation of the property into the City of Chanhassen, overall benefit to the City of Chanhassen in exchange for utilities, and stormwater drainage. That while the subdivision would be located in Victoria, that the subdivision should follow the same minimum lot standards that are required by the City of Chanhassen's Residential Single Family (RSF) zoning district as that is the zoning district which all of the neighboring properties in Chanhassen are zoned. This includes a minimum lot size of 15,000 square feet, a minimum lot depth of 125 feet and a minimum road frontage for each lot of 90 feet as well as a maximum of 30% impervious coverage. The concept plan shows 16 single family lots that have at least 15,000 square feet, at least 125 feet of lot depth, and at least 90 feet of roadway frontage which would adhere to the City's RSF zoning district standards. The City of Victoria allows for up to 35% lot cover outside of the shoreland overlay district however it limits impervious area within the shoreland overlay to 25% impervious which is the same 25% lot cover limitation as the City of Chanhassen for properties developed within the shoreland overlay. Nine (9) of the sixteen (16) proposed lots are within the City of Victoria shoreland overlay district and will be limited to 25% lot cover. That includes the six (6) lots closest to the City of Chanhassen border. While seven (7) lots are outside of the Victoria Shoreland Overlay District and would be eligible for 35% of lot cover, the development as a whole is required to manage stormwater for both rate and volume and will be required to manage stormwater on site and is not allowed to discharge drainage at a rate higher than what the property currently discharges. That a sidewalk is included, connecting the existing Kings Road sidewalk, with a crosswalk. Norton Homes has agreed to provide a sidewalk on one side of the road within the development. That a connection is made to the Lake Minnetonka Regional LRT Trail to the west of the subdivision. There is an additional privately owned property (PID 65-007-3210) between the proposed development parcel and the public land containing the Lake Minnetonka Regional LRT Trail. As a result, Norton Homes is not able to create a connection to the regional trail as it would require installing a segment of sidewalk on private property which Norton Homes does not have control over. Norton Homes will however provide a segment of sidewalk stretching the full east to west extent of the project so that if the private property between the proposed development and the public land ever also develops, that future project would be able to continue the sidewalk connection and provide an opportunity to connect to the 122 regional trail. The Developer should be required to prepare a traffic study to evaluate what improvements would be necessary based on the findings of that study. This could be reduced speed limit, speed bumps, crosswalks, etc. Norton Homes has committed to conducting a traffic study with their proposed development and agreed to any improvements based on the findings of that study. The City of Chanhassen engineering department will be incorporated into the review of the traffic study. BACKGROUND A sanitary sewer capacity study was completed at the direction of city staff to assess whether or not there is capacity within the city's sanitary system to service the additional homes. It was determined that a minor improvement would need to be completed at Lift Station #7 located at the intersection of Kings Road and Minnewashta Parkway in the form of a permanent generator. The cost of the permanent generator project would be at the sole cost of the developer, which they have acknowledged. Chanhassen's water system would have no operational issues with extending water to the development. DISCUSSION Chanhassen will require Victoria to mandate the developer to prepare a traffic impact study to show that the proposed development would not have any adverse impacts to the transportation network in Chanhassen. Victoria has also asked that Chanhassen perform snow plowing of the public streets in the development. The cost would be tracked and billed to Victoria annually. An agreement, such as a Memorandum of Understanding (MOU) or similar, will be prepared and considered by both cities prior to final approval by Victoria in order to formalize the utility service and other public services for the development. This scenario comes up whenever there is a development proposal near a municipal boundary. Inevitably there are factors that result in utilities or road connections coming from one city or the other and that's based usually on which city can provide the road connection or utility connection most efficiently. A few examples that we have already would be: Trails End neighborhood (Settlers West) which includes 48 homes on the south side of Hwy 14 along the border with Eden Prairie. This neighborhood is within the Chanhassen city limits but gets it's utilities from Eden Prairie and the neighborhoods road connection is in Eden Prairie as well. Tristan Heights (Victoria) which includes 30 homes and is the 1st neighborhood on the west side of Minnewashta Pkwy north of Hwy 5. That neighborhood gets its utilities from Chanhassen and their road connection is to Chanhassen. Deer Ridge (Shorewood) which includes 5 homes and is west of Yosemite and east of Cardinal Dr, their utilities and road connection are provided by Chanhassen. 123 With each of those three developments, the City that provided the utilities did not require that they receive any development fees associated with park dedication in exchange for providing access to their utilities. Specifics related to the current request along Kings Road: The created lots in Victoria that get served by Chanhassen utilities will be billed directly by Chanhassen similar to any other utility bill received by lots in Chanhassen. A traffic study will be required by the Developer, however due to the ongoing discussions about Minnewashta Parkway, Chanhassen had its traffic consultant already do an analysis of the Kings Road/Minnewashta Parkway intersection to see if any access control improvements would be needed should approximately 45 acres of land in Victoria all get developed into Single Family Residential lots. The results indicated no material impact to the operations of the existing conditions. Chanhassen staff are working with Victoria to keep alive a potential future street access from the west, which would cross the regional trail. It’s likely feasible but expensive as a bridge is likely involved. This existing Right of Way however may get eliminated based on ongoing property discussions with the Arboretum concerning the AATP Hwy 5 Improvement project. Chanhassen will be asked to do snow plowing of the proposed cul-de-sac road extension, but we will invoice Victoria for our costs. All other street maintenance would be completed by the City of Victoria. The City of Chanhassen cannot impose our Subdivision Ordinance (Chapter 18) or our Zoning Ordinance (Chapter 20) onto land that is within the Victoria municipal boundary even if that land is being serviced through Chanhassen municipal utilities and public right of way. Prior Residential Development near Kings Road Four residential developments north and south of Kings Road have occurred within the City dating back to 1995. Those plats include Oaks of Minnewashta (1995), White Oak Addition (2000), Cimmaron (2004), and Lake Saint Joe Cove (2013). In total there were 68 lots created across those four plats. Each of those four developments were subdivided under standard Residential Single Family (RSF) zoning. Based on feedback from the adjacent neighborhood, the resolution of intent includes that the development shall have lots that have a minimum lot size of 15,000 square feet, 90 feet of roadway frontage, and 125 feet of lot depth. Additionally, that a public sidewalk will be included on one side of the roadway. Norton Homes is agreeable to these additions to the resolution. BUDGET N/A RECOMMENDATION Staff supports the proposed resolution supporting the requested utility servicing for the development. Introduction & Background The City of Chanhassen (City) selected Apex Engineering Group (Apex) for a collection system capacity analysis to accommodate the proposed Kings Road development. The impacted facilities include Lift Stations 3, 7, and 28, along with the gravity sewer system. Analysis includes review of existing collection capacity, capacity with the addition of proposed development, and recommendations with cost estimates of any improvements necessary to accommodate the proposed development. Existing Collection System The collection system downstream of the proposed development is served by a series of gravity pipes and 3 lift stations: LS 28, LS 7, and LS 3. From LS 3, flow is sent to the MCES interceptor. The City of Chanhassen 2040 Comprehensive Plan (Comp Plan) identified the rated firm capacities (largest pump out of service) for these 3 lift stations and are shown in Table 1. Peaking factors for the three lift stations were determined using average flowrates in correlation with the MCES flow variation factors for sewer design due to the most recent data set of 2023 being for daily run times. Peak hourly flow was then calculated using said peaking factors and average flowrates. Based on these numbers, the remaining capacity was able to be calculated for each of the lift stations. A summary of these numbers is shown in Table 1 and more detailed calculations can be found in the Appendix. There were no deficiencies found in the gravity sewer system using the flow rates as calculated in Table 1. Proposed Development The proposed development is located directly west of Kings Road and south of Fox Hollow Drive, within the Victora, MN city limits. The development includes 16, single family residential homes designated R- 1, which fits the Comp Plan’s Residential – Low Density land use (1.2 – 4.0 units/acre) at approximately 2 units/acre. Due to proximity of the development to the City of Chanhassen’s sanitary sewer system, connection to Chanhassen rather than Victoria is being explored. Projected flow from the 16-unit development utilized the MCES residential unit flow of 274 gallons per unit, resulting in a total average flow of 4,384 gallons (3.0 gpm). The MCES peaking factor was used to determine the design peak hourly flow for the development. A summary of the design flows for the proposed development are shown in Table 2. These demands were also evaluated using the City’s collection system model, which did not show any hydraulic deficiencies. Recommended Improvements Based on the projected flows for the proposed development, there are not any required system improvements to meet the hydraulic conveyance requirements. However, the Lift Station #7 Capacity Tech Memo completed by Nero Engineering noted existing operational concerns at LS 7 due to frequent power outages and storage capacity concerns. The capacity concerns were also observed as part of the analysis in this TM and raises concern regarding the addition of any additional flow to the lift station until storage capacity can be addressed. Not having backup power at the lift station site and the response time necessary to mobilize a portable generator to the site exacerbates the insufficient storage capacity at LS 7. A response time of 1 hour is desirable for the City and in turn, 1 hour of storage at peak hour flow to avoid surcharging or backups into upstream homes. The available storage capacity in the drop manhole upstream of LS 7 is approximately 3,600 gallons. At an existing peak hourly flow rate of 293 gpm, there is approximately 12 minutes of storage available before backup will occur. Previous analysis recommended equalization storage be added to LS 7 in the form of a precast manhole. Using the peak hourly flow rate of 293 gpm, an additional 13,980 gallons of storage would be required to accommodate the desired 1 hour of storage. This results in a 14’ diameter precast structure being required at the elevations presented in the previous technical memorandum by Nero. Due to the large size, additional structure configurations and construction methods (cast in place) could be evaluated. The lack of storage and response time discussed is only with existing flows, any new flow to the system would decrease potential response time, increase system storage required, and increase risk of sewer backups to customers. A temporary and short-term alternative to equalization storage would be permanent backup power located at the site. Given that power failures are a major concern and occur regularly, permanent backup power may help to accommodate additional flow in the near term but will ultimately need to have additional storage plans in place to accommodate those new wastewater flows. The existing control panel was installed in 1999 and given the age, it would be recommended to install a new control panel, automatic transfer switch (ATS), and generator sized to handle duplex operation of the station. The existing electrical service is a legacy service and would require replacement to a standard 4-wire, grounded-wye service through Xcel Energy as part of the upgrades.
