REGULAR MEETING
MINUTES
MAY 13, 2024
Mayor Ryan called the meeting to order at 7:00 p.m. The meeting was opened with the Pledge of
Allegiance.
COUNCIL MEMBERS PRESENT: Mayor Ryan, Councilman McDonald, Councilman von
Oven, and Councilman Kimber.
COUNCIL MEMBERS ABSENT: Councilwoman Schubert.
STAFF PRESENT: Laurie Hokkanen, City Manager; Charlie Howley, Public Works
Director/City Engineer; Jerry Ruegemer, Parks and Recreation Director; Priya Tandon,
Recreation Manager; Andrea McDowell-Poehler, City Attorney.

PUBLIC ANNOUNCEMENTS:
1. Presentation of Maple Leaf Awards to Outgoing Commissioners
Mayor Ryan recognized Commissioner Hawks for his six years of service on the Environmental
Commission.
Mayor Ryan recognized Commissioner Vasatka for his service on the Parks and Recreation
Commission and Environmental Commission.
2. GFOA Distinguished Budget Presentation Award
Mayor Ryan stated that the City of Chanhassen has received the GFOA Distinguished Budget
Presentation Award and thanked the staff for their hard work. She provided an overview of the
award.
CONSENT AGENDA: Councilman McDonald moved, Councilman von Oven seconded
that the City Council approve the following consent agenda items 1 through 16 pursuant to
the City Manager’s recommendations:

All voted in favor, and the motion carried unanimously with a vote of 4 to 0.
VISITOR PRESENTATIONS. None.
PUBLIC HEARINGS.
1. Approve On-Sale Intoxicating Liquor License with Sunday Sales for a Club for Life
Time Pickleball located at 2970 Water Tower Place
Laurie Hokkanen, City Manager, reviewed the application and background information for the
liquor license application at Life Time Pickleball.
Mayor Ryan opened the public hearing. There were no public comments.

Mayor Ryan closed the public hearing.
Councilman Kimber moved, Councilman McDonald seconded that the City Council
approve On-Sale Intoxicating Liquor License with Sunday Sales for a Club for Life Time
Pickleball located at 2970 Water Tower Place. All voted in favor, and the motion carried
unanimously with a vote of 4 to 0.
GENERAL BUSINESS.
1. Consider Approval of Comcast Franchise Agreement
Attorney Brian Grogan, Moss & Barnett, presented an overview on the Cable Franchising
agreements in Chanhassen. He reviewed the franchise negotiations and the franchise terms,
explained the system build out, and addressed potential constituent concerns.
Mayor Ryan voiced appreciation for the presentation and the specific follow-up to questions
asked at the public hearing. She asked if Attorney Grogan wanted to address the point at the
public hearing about broadband caps.
Attorney Grogan explained broadband caps and stated that the City does not have the authority
to regulate broadband. He included a memo to explain the broadband cap policy which is
consistent with other major providers.
Mayor Ryan asked if it was a typical bond amount for the size of the buildout.
Attorney Grogan answered that the buildout is typical for a cable franchise but is not in lieu of
what Chanhassen could require in the city code. This is a standing bond for the next ten years.
The $50,000 can last for ten years.
Councilman Kimber asked if cities throughout the agreement term could request connection for
future public buildings.
Attorney Grogan explained the question is complicated because of a change to the law. The FCC
regulation states that if a city imposes in-kind obligations, the operator might have a right to
offset the cost with the 5 percent fee. There is reduced compensation that is received. Comcast
can reserve the rights under the law to not have unlimited expense to buildout.
Councilman von Oven moved, Councilman Kimber seconded that the Chanhassen City
Council approves entering into a cable franchise agreement with Comcast. All voted in
favor, and the motion carried unanimously with a vote of 4 to 0.

ADMINISTRATIVE PRESENTATIONS.
1. MMSW Roundabout Project Update
Charlie Howley, Public Works Director, reviewed the project for the MMSW roundabout and
goals of the project to mitigate neighborhood parking issues. He provided an overview of the
layout, including the pedestrian crossings. He explained the updates since the last presentation to
City Council on March 20, 2023. He reviewed the open house feedback and summarized the
project costs and the timeline. He explained the next steps for the project.
Councilman von Oven asked how residents find out about the open house.
Mr. Howley answered that the consultants completed the mailer and explained the radius for the
mailing. The speed trailer was located at the intersection advertising the open house.
Councilman Kimber voiced favor for the plan. He asked about the pedestrian walk to the south
and the brown crossing.
Mr. Howley explained the trail was an existing trail and would be continued and tied into the
north and south. The ‘y’ allows for crossing the highway on the south side.
Councilman Kimber asked if the south would also have a push button for crossing.
Mr. Howley stated that the current design is for the push button to be only on one leg, but if there
were additional push buttons installed, it would be a cost decision.
Councilman Kimber stated the one push button is ideal and he is appreciative of the project.
2. Fourth of July Parade Update
Jerry Ruegemer, Park and Recreation Director, provided the background information on the
Fourth of July parade.
Priya Tandon, Recreation Manger, reviewed the previous and current parade routes. She
explained the notification sent to those on the new parade route.
Mayor Ryan asked about the length of the parade route.
Ms. Tandon explained that the route is approximately half of the length of the parade. She
explained the need to keep Kerber Boulevard and West 78th for the seating.
Mr. Ruegemer stated that they considered multiple options for the parade routes but were not
able to obtain permission from property owners to utilize spaces. There have been problems with

starting and ending at the same place, so there are hopes to address these concerns. They also
wanted to continue the partnership with the Rotary and wanted their feedback.
Mayor Ryan voiced appreciation for the mailing to notify property owners of the change in the
parade route.
Ms. Tandon stated information about the parade will be on the website.

Councilman von Oven moved, Councilman McDonald seconded to adjourn the meeting.
All voted in favor, and the motion carried unanimously with a vote of 4 to 0. The City
Council meeting was adjourned at 7:56 p.m.
