ORDINANCE NO. 736
AN ORDINANCE AMENDING CHAPTER 10 CHANHASSEN CITY CODE CONCERNING
CANNABIS BUSINESSES
THE CITY COI.INCIL OF THE CITY OF CHANHASSEN, MINNESOTA ORDAINS
Section 1. Chapter 10 of the Chanhassen City Code is hereby amended to add a new Article l0-
X to read as follows:
ARTICLE lO-X CANNABIS BUSINESSES
Sec l0-235 Purpose and lntent; Authority and Jurisdiction
(a) Findings and Purpose. The city makes the following legislative findings
(1) The purpose of this Article is to implement the provisions of Minnesota Statutes,
chapter 342, which authorizes the city to protect the public health, safety, welfare of residents by
regulating cannabis businesses within the city.
(2) The city finds that the proposed provisions are appropriate and lawful land use
regulations for the city, that the proposed regulations will promote the interests of the community
for now and in the future, and that the proposed provisions are in the public interest and for the
public good.
(b) Authority. The city has the authority to adopt this Article pursuant to:
(l) Minnesota Statutes, section 342.13(c),regarding the authority of a local unit of
government to adopt reasonable restrictions of the time, place, and manner of the operation of a
cannabis business provided that such restrictions do not prohibit the establishment or operation
of cannabis businesses.
(2) Minnesota Statutes, section 342.22, regarding the local registration and
enforcement requirements of state licensed cannabis retail businesses and lower potency hemp
edible retail businesses.
(3) Minnesota Statutes, section 152.0263, Subd. 5, regarding the use of cannabis in public
places.

Operation of a cannabis business of the types established by Minnesota Statues, section 324.10
shall require a state license in accordance with Minnesota Statutes, section 342.14.
Sec. l0-237 Retail Registration
(a) Delegation. The City of Chanhassen hereby delegates cannabis retail registration
authority to Carver County, subject to the limitations of this Section. The City may
rescind that delegation at its sole discretion through an amendment to this Ordinance.
(b) Registrations Limited.
The number of cannabis retail businesses within the City is limited to one registration for
every 12,500 residents within the City of Chanhassen.
(l) If Carver County has one active cannabis retail businesses registration for every
12,500 residents, no additional state-licensed cannabis retail businesses shall be
registered within the City of Chanhassen.
(2) Except as provided under subsection (bxl), the number of cannabis retail businesses
within the City shall be limited to a maximum of three regisftations.
Sec. I 0-238 Temporary Carurabis Events
(a) Permit Required
A permit is required to be issued and approved by the City of Chanhassen prior to holding
a Temporary Cannabis Event.
(b) Fee.
A registration fee, as established in the City's fee schedule, shall be charged to applicants for
Temporary Cannabis Events.
(c) Application Submittal and Review.
(l) An applicant for a temporary cannabis event permit must submit a completed application
form, as provided by the City. The application form shall include, but is not limited to:
a. Full name of the property owner, applicant, and on-site contact;
b. Address, email address, and telephone number of the property owner, applicant,
and on-site contac!
(2) The applicant shall include with the form:
a. The application fee as established for Temporary Outdoor Sales/Events in the
City's fee schedule;
b. A copy of the OCM cannabis event license application, submitted pursuant to
342.39 subd. 2.
(3) The application shall be submitted to the Community Development Director, or
other designee for review. If the designee determines that a submitted application is

incomplete, they shall return the application to the applicant with the notice of
deficiencies.
(4) Once an application is considered complete, the designee shall inform the applicant as
such, process the application fees, and forward the application to relevant staff for
approval or denial.
(5) The application fee shall be non-refundable once processed.
(6) The application for a license for a Temporary Cannabis Event shall meet
the following standards:
a. Events shall only be permitted at business possessing an on-sale alcohol
license.
b. Events may not be held within 500 feet of a school or a residential
treatment facility.
c. On-site consumption shall only include hemp-derived cannabinoid edibles.
d. Events must occur within the premises specified on the location's liquor
license.
e. Liability insurance shall be provided in accordance with the city's
temporary event ordinance.
(7) A request for a Temporary Cannabis Event that meets the requirements of this section
shall be approved.
(8) A request for a Temporary Cannabis Event that does not meet the requirements of
this Section shall be denied. The City shall notify the applicant of the standards not
met and basis for denial.
Sec. 1 0-239 Lower-Potency Hemp Edibles
(a) Sale of Low-Potency Hemp Edibles. The sale of Low-Potency Edibles is permitted,
subject to the conditions within this Section.(b) Additional Standards
(1) Beverages.
The sale of Low-Potency Hemp Beverages is permitted in places that meet
requirements of this Section.
(2) Storage of Product. Low-Potency Edibles shall be sold behind a counter and stored in
a locked case.
(3) Performance Standards. All deliveries must occur in the rear of the building.

Section 2. This ordinance shall be effective immediately upon its passage and publication.
