Amy —there were some questions on the $30,973 security being held in association with Dakota Retail ("Tono
Pizza"). This was being held by Sharmeen until Landscaping and final inspections for the site passed. I've
attached an e-mail in which Jamie/Manuel were working with Dario to get the site in compliance with their
approved plans (last communication I have).
In reviewing the engineer's estimate attached to the security, it appears the private stormwater facilities ($14,100),
ESC ($10,403), and Landscaping ($6,470) securities are all being tied to final landscaping inspection. Once that
Landscaping inspection passes the release letter can be drafted and released.
I'm CC'n Eric so he can coordinate who will sign the letter when the time comes, and as a reminder of the
amendment to their agreement regarding parking and a potential evaluation deadline of 10/10/2024. I'll bring the
LOC documents up front today.

inspection associated with the ROW work and your
ROW permit. From your security, $37,580.00 was
being held for this work. Upon completion of the
inspection, it was determined that temporary
stabilization of disturbed areas within the ROW was
not completed, and the street patches appear to be
out of tolerance with surrounding surfaces (note
7. Plate 5202A).
As such, $5,000.00 will be held of the $37,580.00,
reducing the security by $32,580.00. This will leave a
total remaining balance of $35,973.00 in security for
Phase I. Sharmeen will be providing you a copy of the
letter sent to the bank authorizing the release.
We will monitor how the patch settles after the
freeze/thaw and determine if this street needs repair
this spring.
