PLANNING COMMISSION SUMMARY
The Planning Commission held a public hearing on September 18, 2007. The
Planning Commission voted 4 to 0 to approve a motion recommending approval of
the Interim Use Permit. There were no issues or concerns expressed regarding the
proposal.
The Planning Commission minutes are item la of the September 24, 2007 City
Council agenda.
RECOMMENDA TION
Staff and the Planning Commission recommend adoption of the motion as
specified on pages 4 - 5 in the staff report dated September 18, 2007 approving
the Interim Use Permit to allow filling and grading on the site.

PROPOSAL/SUMMARY
The applicants, who are property owners of adjacent properties, are requesting an interim use permit
to bring approximately 46,000 cubic yards of fill to the site. This property is surrounded on all sides
byroads: New TH 101, Lake Susan Drive and Waters Edge Drive (old Highway 101).
A telephone transfer station building is located in the southwest comer of the site. The farmstead is
located in the northwest comer of the site. A black walnut woods is located in the north central
portion of the site. A partial windbreak is located to the south of the farmstead. The proposed
grading will eliminate the trees in the windbreak. The high point on the property is located in the
northeastern portion of the site with an elevation of920. The low point on the property is located in
the southeast comer of the site where a 48-inch culvert outlets water from the site to the east under
TH 101. This southeast comer of the property is approximately 20 feet lower than the intersection
ofTH 101 and Lake Susan Drive.
There is an existing house, two accessory structures, and a gravel drive on the site; all of which
will remain at the completion of site grading. Approximately 50 percent of the site is farmed or
grassland. The site will be left in a condition that will be used for crops in the short term and
facilitate development in the future.
Staffis recommending approval of the interim use permit subject to the conditions of the staff
report.

BACKGROUND
Summer 2007, Minnesota Department of Transportation completes the construction ofthe adjacent
roadways, realigned Trunk Highway 101 and Lake Susan Drive, altering surrounding grades.
On April 1 0, 2006, the Chanhassen City Council approved the final plat for Planning Case #06-05
for Chanhassen Gateway North creating three lots and two outlots.
On February 27,2006, the City Council approved the following:
. Preliminary plat for Planning Case 06-05 for Gateway North.
. Site plan with a variance for the reduction of nine enclosed parking spaces for Planning Case
06-05 for Chanhassen Gateway Place.
On June 27,2005, the City Council approved rezoning the property located at the northwest
intersection of the future alignment of Highways 101 and 212 with an approximate area of24

acres from Residential Single-Family to Planned Unit Development-Mixed Use incorporating
design standards.
GRADING. DRAINAGE AND EROSION CONTROL
The site currently has two drainage areas. Approximately 90 percent ofthe site drains through a
48-inch culvert installed by the Minnesota Department of Transportation during the construction
of Trunk Highway 101. The remaining 10 percent of the drainage is directed towards the
northeast property line. The proposed grading plan does not change the drainage areas.
Drainage calculations were not provided or required with this submittal. The reason for not
requiring drainage calculations is because the drainage areas and impervious surface is
unchanged.
Most of the significant trees on the site will be saved. The black walnut woods will remain after
grading completion. Approximately twelve trees will be removed near the middle of the site.
The trees that will be removed are primarily box elder and poplar. Some trees near the US West
Telephone property were not shown on the plans. These trees will need to be shown on the
existing conditions plan and the proposed grading plan to determine which trees will be saved.
The trees near the US West Telephone building should be preserved for building screening.
Most ofthe fill is proposed near the center ofthe property. Up to 10 feet of fill will be placed in
some areas. No fill will be placed near the buildings or in the black walnut woods. A temporary
stockpile of black dirt is shown near the northeast comer of the site. This area will need to be
graded back to existing conditions upon completion.
Erosion control must be maintained at all times. The applicant will be required to keep the
streets clean and free of debris. All exposed soil areas shall have temporary erosion protection or
permanent cover year round, according to the following table of slopes and timeframes:

A $5,000 escrow to guarantee restoration and erosion control measures will be required with the
permit.
The hauling operation is anticipated to begin as soon as permit approval is obtained. Permitted
hours of operation will be 7:00 a.m. to 6:00 p.m., Monday through Friday, and 9:00 a.m. to 5:00
p.m. on Saturday with no work permitted on Sundays or legal holidays. Staff will require that
the applicant provide a proposed haul route for review and approval.
An interim use permit expires one year from the date of approval from the City Council. The
permit may be renewed on an annual basis subject to City Council approval. The applicant will
need to request a formal extension 45 days prior to the expiration date.

A temporary construction easement is required for the grading on the US West Telephone
property.
Ground (i.e. non-paved) surface grades shall not be less than 2%.
MISCELLANEOUS
A demolition permit is required for the removal of any structure(s). If future construction in this
area is anticipated, these soils must be engineered for the intended structural loads and their
placement must be properly compacted and tested as required by such soil engineering. A
report, verifying placement, compaction and soil suitability, from the testing agency will be
required before building permits will be issued.
RECOMMENDA TION
Staff recommends that the City Council PhuuliRg Csm.m.issisR adopt the following motion and
adoption of the attached findings of fact and recommendation:

August 13, 2007, revised August 21,2007, subject to the following conditions:
1. A demolition permit is required for the removal of any structure(s).
2. If future construction in this area is anticipated, these soils must be engineered for the
intended structural loads and their placement must be properly compacted and tested as
required by such soil engineering. A report, verifying placement, compaction and soil
suitability, from the testing agency will be required before building permits will be issued.
3. Show the trees for the US West Telephone property in the existing conditions and the
proposed grading plan. Preserve as many trees as possible in this area to provide screening
for the building.
4. Install tree protection fencing around all trees to be saved on site.
5. Tree protection fencing and erosion control fencing must be installed and inspected by the
City prior to beginning site grading.
6. Silt fence must be added around the outer limits of the temporary topsoil stockpile. This area
must be regraded to the elevations shown on the proposed grading plan. Streets must be kept
clean and free of debris at all times. Erosion control blanket shall be installed on all slopes
greater than or equal to 3: 1. All exposed soil areas shall have temporary erosion protection
or permanent cover year round, according to the following table of slopes and timeframes:

7. The applicant shall provide the City with a cash escrow in the amount of$5000.00 to
guarantee erosion control measures, site restoration, and compliance with the interim use
permit.
8. Permitted hours of operation will be 7:00 a.m. to 6:00 p.m., Monday through Friday, and
9:00 a.m. to 5:00 p.m. on Saturday with no work permitted on Sunday or legal holidays.
9. The applicant must provide a proposed haul route for review and approval.
10. An interim use permit expires one year from the date of approval from the City Council. The
permit may be renewed on an annual basis subject to City Council approval. The applicant
will need to request a formal extension 45 days prior to the expiration date.
11. A temporary construction easement is required for the grading on the US West Telephone
property.
12. All permits must be secured prior to commencement. This includes a drainage permit from
the Minnesota Department of Transportation, a watershed district permit, and a Minnesota
Pollution Control NPDES stormwater permit. A stormwater pollution prevention plan must
be submitted to the City for review by Carver SOil and Water Conservation District.
13. Changes are needed to the grading plan. The elevations 906 and 908 that are shown in the
black walnut woods in the existing conditions must remain in the grading plan. Change the
grading in this area to allow the water to exit the comer of the woods. The swale for the
drainage around the US West Telephone property should be moved to the center ofthe lot
line.
14. An as-built grading plan is needed at the completion of site grading to ensure compliance
with the approved grading plan."

Application of Neil Klingelhutz and Gateway Development, LLC for an Interim Use Permit to
bring approximately 46,000 cubic yards of fill to the site.
On September 18,2007, the Chanhassen Planning Commission met at its regularly
scheduled meeting to consider the application of Neil Klingelhutz and Gateway Development,
LLC for an interim use permit for the property located at 8601 Great Plains Boulevard and 760
Lake Susan Drive. The Planning Commission conducted a public hearing on the proposed
interim use was preceded by published and mailed notice. The Planning Commission heard
testimony from all interested persons wishing to speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Single-Family Residential, RSF, and Planned Unit
Development - Residential, PUD-R.
2. The property is guided by the Land Use Plan for Residential - Low and Medium Density
and Mixed Use.
3. The legal description of the property is: Lot 1, Block 1, Gateway North, Carver County,
Minnesota;
And,
Part of the NW 1,4 of the NW 1,4 of Section 24, Township 116, Range 23, Carver County,
Minnesota described as follows: Commencing at the NW comer of the NW the NW
comer of said Section 24; thence on an assumed bearing of South 89 degrees 19 minutes

4. Interim Use Permit Findings:
a. The proposed use will not be detrimental to the public health, safety, comfort,
convenience or general welfare of the neighborhood or the city.
b. The proposed use will be consistent with the objectives of the city's
comprehensive plan and the zoning code.
c. The proposed use will be designed, constructed, operated and maintained so to be
compatible in appearance with the existing or intended character of the general
vicinity and will not change the essential character of that area.
d. The proposed use will not be hazardous or disturbing to existing or planned
neighboring uses.
e. The proposed use will be served adequately by essential public facilities and
services, including streets, police and fire protection, drainage structures, refuse
disposal, water and sewer systems and schools; or will be served adequately by

such facilities and services provided by the persons or agencies responsible for the
establishment of the proposed use.
f. The proposed use will not create excessive requirements for public facilities and
services and will not be detrimental to the economic welfare of the community.
g. The proposed use will not involve uses, activities, processes, materials, equipment
and conditions of operation that will be detrimental to any persons, property or the
general welfare because of excessive production of traffic, noise, smoke, fumes,
glare, odors, rodents, or trash subject to compliance with the conditions of
approval.
h. The proposed use will have vehicular approaches to the property which do not
create traffic congestion or interfere with traffic or surrounding public
thoroughfares.
1. The proposed use will not result in the destruction, loss or damage of solar access,
natural, scenic or historic features of major significance.
J. The proposed use will be aesthetically compatible with the area.
k. The proposed use will not depreciate surrounding property values.
1. The proposed use will meet standards prescribed for certain uses as provided in
the City Code.
5. The planning report #07-16 dated September 18, 2007, prepared by Robert Generous, et
aI, is incorporated herein.
RECOMMENDA TION
The Planning Commission recommends that the City Council approve the interim use
permit to permit the importation of up to 46,000 cubic yards of fill.

General Provisions
1. All erosion control measures shown on the plans must be installed prior to commencement of grading
operations and be maintained until all areas altered on the site have been restored.
If silt fence is used, the bottom flap must be buried and the maximum allowable spacing between
posts is 4-foot on center. All posts must be either 2" x 2" pine, hardwood, or steel fence posts. If hay
bales are used, all bales must be staked in place and reinforced on the downstream side with snow
fence. The silt fence must be orange in color, which will be more evident and easier to locate for
removal at the completion ofthe project.

2. All areas altered because of construction must be restored with seed and disced mulch, sod, wood
fiber blanket, or be hard surfaced within two weeks from the completion of construction or no later
than October I, 2007.
3. Upon completion of construction and restoration of areas disturbed, the permit applicant is
responsible for the removal of all erosion control measures installed throughout the site.
4. Street sweeping must be undertaken and completed on an as-needed basis.
5. At the entryway onto the site, a rock filter dike being a minimum of2 feet in height and having
maximum side slopes of 4: 1 must be constructed. This rock filter dike will enable construction traffic
to enter the site and also provide an erosion control facility.
6. The District must be notified in writing a minimum of 48 hours prior to commencement of
construction. Upon receipt of this notification, a field inspection of the project site by the District's
engineer will be undertaken to ensure that all erosion control measures have been properly installed.
Construction cannot commence until this field inspection has been completed.
7. Upon completion of the project, the permit applicant is required to complete and submit the middle
portion of the attached permit, indicating that t~e project has been completed. Upon receipt of this
application, a field inspection ofthe site by the District's engineering advisor will be undertaken to
ensure that all areas have been properly restored and that all erosion control measures throughout the
project site have been removed.
8. The Riley-Purgatory-BluffCreek Watershed District (RPBCWD), its officers, employees and agents
review, comment upon, and approve plans and specifications prepared by permit applicants and their
consultants for the limited administrative purpose of determining whether there is reasonable
assurance that the proposed project will comply with the regulations and criteria of the RPBCWD and
other state and federal agencies. The determination of the RPBCWD that issuance ofthis permit is
appropriate was made in reliance on the information provided by the applicant.

9. The grant of this permit shall not in any way relieve the permittee, its engineer, or other professional
consultants of responsibility, nor shall it make the RPBCWD responsible for the technical adequacy
of the engineer's or consultant's work. The grant of this permit shall not relieve the permittee from
complying with all conditions and requirements ofthe permit, which shall be retained, by the ,
permittee with the permit. ,. I
10. The issuance of this permit does not convey any property rights in either real or personal property, or
any exclusive privileges, nor does it authorize any injury to private property or any invasion of
personal rights, nor ariy infringement of federal, state, or local laws or regulations.
II. This permit is permissive only. No liability shall be imposed upon the RPBCWD or any of its
officers, agents or employees, officially or personally, on account of the granting of this permit or on
account of any damage to any person or property resulting from any act or omission of the permittee
or any of its agents, employees, or contractors.
12. In all cases where the doing by the permittee of anything authorized by this permit shall involve the
taking, using, or damaging of any property, rights or interests of any other person or Rersons, or o(
any publicly owned lands or improvements or interests, the permittee, before proceeding therewith,
shall obtain the written consent of all persons, agencies, or authorities concerned, and shall acquire all
necessary property, rights and interest.
13. This permit is not transferable. The permittee shall make no changes, without written permission
previously obtained from the RPBCWD, in the dimensions, capacity, or location of any' items of work
authorized by this permit.
14. The permittee shall grant access to the site at all reasonable times during and after construction to
authorized representatives of the RPBCWD for inspection ofthe work authorized by this permit.
15. This permit may be terminated by the RPBCWD at any time deemed necessary in the interest of
public health and welfare, or for violation of any of the provisions of this permit, unless otherwise
provided in the special provisions.
16. Construction work authorized under this permit shall be completed on or before date specified above.
The permittee may, in writing, request that the RPBCWD extend the time to complete the project and
shall state the reason for any requested extension.
17. If dewatering is required and sump pumps are used, all pumped water must be discharged through an
erosion control facility prior to leaving the construction site. Proper energy dissipation must be
provided at the outlet of the pump system.

Thank you for the opportunity to review the above-referenced sketch plan. We look forward to
seeing the site plan when it is completed. MnlDOT has the following preliminary comments:
Water Resources:
A drainage permit is required. Roadway inslopes cannot be any steeper than currently
constructed. The proposed construction will need to maintain existing drainage rates to MnlDOT
right-of-way. The following item has already been provided to MnlDOT:
1) A Grading Plan of the existing & proposed project, dated August 17,2007 and revised
August 21, 2007.
Hydrologic, and hydraulic computations/modeling before and after proposed reconstructions
(ie., Hydro-CAD input assumptions, calibration data, results for 10, 50, and 100 year storm
events) are not needed at this time since the plan is only to bring the site up to surrounding
grade without changing the drainage areas or property use.
