Ordinance 001j�x ORDINANCE NO. AN ORDINANCE RELATING TO THE DUST TREATMENT OF STREETS The Village Council and Township Board of Supervisors of Chanhassen, by joint action, do hereby ordain: Section 1. Pursuant to Minnesota Statutes, Section 429. 101 , the Council may from time to time by resolution order the oiling, sprinkling or other dust treatment of streets and alleys, including maintenance work incidental and necessary to such dust treatment. Upon the adoption of any such resolution the • Clerk shall transmit copies thereof to the Village Engineer, who shall then proceed with such work under the direction of the Council by purchasing the necessary materials and em- ploying day labor, or by entering into contracts for such work with private parties, or by entering into cooperative agreements with neighboring municipalities, for the apportionment of such work on streets which are divided down the center line thereof between the Village and the neighboring municipality. Section 2. The Village Engineer shall keep a record of the cost of such work done on each street or alley and shall report such information to the Village Clerk, including the cost of all such work on any streets or portions thereof situated beyond the Village boundaries, performed pursuant to a cooperative agree- ment with a neighboring municipality. Section 3. Whenever the Council has by resolution ordered work in accordance with Section 1 hereof and such work has been commenced or a contract or contracts therefor awarded, the Council may issue obligations to defray the expense thereof in accordance with and subject to the limitations of Minnesota Statutes, Section 429. 101, subdivision 3. Section 4. On or before September 15 of each year the Clerk shall prepare an assessment roll assessing all costs of such work re- ported to him against each separate lot or parcel of land abutting on the streets wherein such work was done, in proportion to the benefits conferred upon such lots or parcels. In the case of such work done pursuant to a cooperative agreement as set forth in Section 1 hereof, the cost of the work done by the Village shall be spread against all lots or parcels of land abutting on the Village side of the streets covered by the cooperative agreement. The Council shall thereupon examine such assessment roll submitted by the Village Clerk, and if satisfactory, shall call a public hearing and levy special assessments for such work in accordance with Minnesota Statutes, Section 429.061. All such special assessments shall be payable in a single installment, with interest • thereon at the rate of 6% per annum. • 0 0 * Section 5. (5) Said newspaper purports to serve the Village of Excelsior, in the County of Hennepin, and it has its known office of issue in the Village of Excelsior, in said county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer of said newspaper or persons in his employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours to the business of the newspaper and business related thereto. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the General Manager of said newspaper and sworn to before a notary public stating that the news- paper is a legal newspaper.
