Ordinance 002aRHL 12/6/71 VILLAGE OF CHANHASSEN bye CARVER AND HENNEPIN COUNTIES, MINNESOTA ORDINANCE NO. 2 - AN ORDINANCE AMENDING SECTION 1, SUBDIVISION 2 of SECTION 3, ,AND SUBDIVISION 6 OF SECTION 5 OF ORDINANCE NO. 2, ADOPTED JULY 17, 1967, AND ENTITLED "AN ORDINANCE LICENSING AND REGULATING THE SALE AND CONSUMPTION OF INTOXICATING LIQUOR AND PROVIDING A PENALTY FOR VIOLATION". THE VILLAGE COUNCIL OF CHANHASSEN ORDAINS: SECTION 1. Section 1, Subdivision 2 of Section 2, and Subdivision 6 of Section 5 of Ordinance No. 2, adopted July 17, 1967, and entitled "An Ordinance Licensing and Regulating the Sale and Consumption of Intoxicating Liquor and Providing a Penalty for Violation", are hereby amended to read: Section 1. Provisions of State Law Adopted. The provisions of the Minnesota Intoxicating Liquor Act, it being a part of Minnesota Statutes, Chapter 340, and all laws amendatory thereof and supplementary thereto, copies of which are on file in the office of the Village Clerk, with reference to the definition of terms, application for license, granting of license, conditions of license, restrictions on consumption, provisions on sales, conditions of bonds or insurance of licensees, hours of sale, and all other matters pertaining to the retail sale, distribution, and consumption of intoxicating liquor are hereby adopted and made a part of this ordinance as if fully set out herein, except as modified herein. Section 3. Types of Licenses. Subdivision 2. "On Sale". Licenses for the sale of intoxicating liquor to be consumed on the premises shall be issued only to hotels, clubs, restaurants and establishments for the sale of "on -sale" liquors exclusively, whose fixtures and structures, exclusive of land, have a fair market value of at least $2 50, 000.00 . • An exclusive liquor store includes an on -sale or combination on - sale and off -sale establishment operating a restaurant or selling food for consumption on the premises. The Village Council may provide for an independent appraisal at the license applicant's • t • expense as an aid in determining the value of said premises. In the event this requirement as to investment in fixtures and structures is not complied with within one year from the date of the issuance of the license, the license may be revoked. Provided, however, that the Village Council may issue not to exceed three "on -sale" licenses for the sale of intoxicating liquors in establishments which have held "on -sale" or bottle club licenses for not less than three years prior to July 20, 1967, whose fixtures and structures, exclusive of land, have a fair market'value of less than $250,000.00. Section 5. Conditions of License. Subdivision 6. No person under 21 years of age shall be employed in any rooms constituting the place in which intoxicating liquors are sold at retail "on -sale" , and no such person shall be allowed to be or remain in any such room unless such person is accompanied by his parent or guardian, except that persons under 21 years of age may be employed as musicians or to perform the duties of a busboy or dishwashing services in places defined as a restaurant or hotel or motel serving fond in rooms in which intoxicating liquors are sold at retail "on -sale". SECTION 2. This ordinance becomes effective from and after its passage and publication. Passed by the Council this -13 day of December, 1971.
