Ordinance 003ds • fr1 �^ t J 7 • CITY OF CHANHASSEN ' • CARVER AND HENNEPIN COUNTIES, MINNESOTA Ordinance No. 3-; AN ORDINANCE REGULATING THE USE OF STREETS AND HIGHWAYS WITHIN THE CITY OF CHANHASSEN, INCORPORATING PROVISIONS OF THE STATE HIGHWAY TRAFFIC REGULATION ACT BY REFERENCE; AND IMPOSING A PENALTY FOR THE VIOLATION THEREOF. ' . THE CITY COUNCIL OF CHANHASSEN ORDAINS: Section 1. Highway Traffic Regulation Act Incorporated by Reference;_ The Minnesota Highway Traffic Regulation Act, as last amended by laws of - 1974, and all laws amendatory thereof and supplementary thereto, copies of which • are on file in the office of the City Clerk, are hereby adopted as the traffic regulation code of the City for the purpose of regulating the use of highways, streets and alleys within the City of Chanhassen. Every provision contained in said Highway Traffic Regulation Act is hereby adopted and made a part of this ordinance as if fully set forth herein. Section 2, Driver's License and Vehicle Ownership._ 2.01 Driver's License. No person shall drive or operate a vehicle upon any street or highway in the City of Chanhassen, without having in his posses=�` sion, as required by the laws of the State of Minnesota, a valid driver's license or chauffeur's license. No person shall drive a motor vehicle belonging to another without the owner's consent. 2.02 Owner. A person who holds the legal title of a vehicle, or in the event a vehicle is the subject of a security agreement for the conditional sale thereof, or lease with the right of purchase upon performance of the conditions stated in the agreement, and with an immediate right of possession vested in the • conditional vendee or lessee, then such conditional vendee or lessee shall be deemed the owner for the purpose of this ordinance. The operation or use of a motor vehicle in violation of the provisions of this ordinance shall be prima facie evidence that said motor vehicle was at the time of such violation driven, controlled, operated, and used by the registered owner thereof. Section- 3. Exhibition Driving._ • Any person, firm or corporation operating a vehicle within the limits of the City of Chanhassen in such a manner as to'cause unnecessary engine noise or tire squeal, skidding or sliding upon acceleration or stopping; or which stimulates a race; or which causes any vehicle to unnecessarily turn abruptly or away shall be guilty of exhibition driving. Section 4. Parking, Snow Removal, Impounding: _ • 4.01 . Impounding of Vehicles. (a) Any vehicle which shall be left parked or standing in violation of this ordinance or the laws of the State of Minnesota may be summarily removed without notice to the owner or operator by officers of the police department of the City of Chanhassen, or persons employed or designated . by them, and stored in any appropriate place. All necessary costs and. expenses of towing, removing and storage of such vehicles.shall first be paid to the person towing, removing or storing such vehicles by the person claiming the vehicles before release of the same. (b) The City of Chanhassen, its agents and employees, shall not be responsible for any damage to'such vehicles removed in accordance with the provisions of this ordinance. ' 4.02 Parking_ Prohibitions. (a) In order to expedite the prompt and efficient removal of snow from the streets of the City, no person shall park any vehicle or pernit it to stand upon any street or highway within the City when there is an accumulation of more than two inches of snow on the street or highway and snow is falling or has fallen within the previous 24 hours, or snow is blowing or has been blowing within the previous 24 hours. Parking may be resumed on individual streets and highways as soon as the snow has been removed therefrom, except as may be otherwise restricted by ordinance or state law. (b) No person shall park any vehicle or permit it to stand upon West 78th Street between its intersection with Laredo Drive and Erie Avenue between the hours of 2:00 A.M. and 6:00 A.M. of each day. - 2 - (c) No person shall park any vehicle or permit it to stand upon fire lanes established on public and rpivate property by the City Fire Chief. • (d) No person shall park any vehicle exceeding 6 feet 6 inches in height or permit it to stand upon West 78th Street between its intersection with Great Plains Boulevard and Laredo Drive. Section 5. Penalty. Any person violating any provision of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine of not to exceed $300.00 or by imprison ment in the county jail for period not to exceed 90 days; but if a minimum fine or impris.onment is prescribed by the State Highway Traffic Regulation Act for an offense, such penalty shall apply to a person convicted of the same offense under this ordinance. Section 6. Repeal. Ordinance No. 3-A, passed igg//a Y /9 , 1970,. Ordinance No. 3-B, ( passed January 17, 1972, and Ordinance No. 3-C, passed January 22, 1973, are "i hereby repealed. Section 7.
