ORDINANCE NO. 3-H
AN ORDINANCE REGULATING THE USE OF STREETS AND HIGH-
• WAYS WITHIN THE CITY OF CHANHASSEN, INCORPORATING
PROVISIONS OF THE STATE HIGHWAY TRAFFIC REGULATION
ACT BY REFERENCE, AND IMPOSING A PENALTY FOR THE
VIOLATION THEREOF.
THE CITY COUNCIL OF CHANHASSEN ORDAINS:
Section 1.
1.01. Highway Traffic Regulation Act Incorporated by Reference.
Chapter 169 of Minnesota Statutes, the Minnesota Highway Traffic
Regulation Act, as last amended by laws of 1976, and all laws
amendatory thereof and supplementary thereto, a copy of which is on
file in the office of the City Clerk, is hereby adopted as the
traffic regulation code of the City for the purpose of regulating the
use of highways, streets and alleys within the City of Chanhassen.
Every provision contained in said Highway Traffic Regulation Act is
hereby adopted and made a part of this ordinance as if fully set
forth herein.
41 1.02. Any term used in this ordinance and defined in Minnesota
Statutes, §169.01, has the meaning given it by that section.
Section 2. Driver's License and Vehicle Ownership.
2.01. Driver's License. No person shall drive or operate a
vehicle upon any street or highway in the City of Chanhassen without
having in his possession, as required by the laws of the State of
Minnesota, a valid driver's license or chauffeur's license. No per-
son shall drive a motor vehicle belonging to another without the
owner's consent.
2.02. Owner. A person who holds the legal title of a vehicle, or
in the event a vehicle is the subject of a security agreement for
the conditional sale thereof, or lease with the right of purchase
upon performance of the conditions stated in the agreement, and with
an immediate right of possession vested in the conditional vendee or
lessee, then such conditional vendee or lessee,shall be deemed the
owner for the purpose of this ordinance.,': The operation or use of a
motor vehicle in violation of the provisions of this ordinance shall
be prima facie evidence that said motor vehicle was at the time of

such violation driven, controlled, operated, and used by the registered
owner thereof.

Section 3. Police Duties.
The City's law enforcement agency shall enforce the provisions of
this ordinance• and the state traffic laws. Police officers are
authorized to direct all traffic within the city, either in person
or by means of visible or audible signals, in conformity with this
• ordinance and the state traffic laws. During a fire or other
emergency or to expedite traffic or safeguard pedestrians, officers
of the police department may direct traffic as conditions require,
notwithstanding the provisions of this ordinance and the state traffic
laws. Officers of the fire department may direct or assist the
police in directing traffic at the scene of a fire or in the immediate
vicinity.
Section 4. Trunk restructions.
The city council by resolution may designate streets on which travel
by commercial vehicles in excess of a specific number of pounds gross
weight is prohibited. The city maintenance superintendent shall erect
appropriate signs on such streest. No person shall operate a
commercial vehicle on such posted .streets in violation of the restric-
tions stated.
Section 5. Exhibition Driving.
No person shall turn, accelerate, decelerate, or otherwise operate
a motor vehicle within the city in a manner which causes unnecessary
engine noise or backfire, squealing of tires, skidding, sliding,
swaying, throwing of sand or gravel, or in a manner simulating a
race.
Prima facie evidence of a violation of this section shall be any
of the following:

unreasonable squealing or screeching sound emitted
by the tires;
the throwing of sand or gravel by the tires of said
vehicle;
unreasonable skid, sway, or slide upon acceleration
or stopping.
Impounding of Vehicles.
Any police officer may remove a vehicle from a street to a garage or
other place of safety when the vehicle is left unattended and con-
stitutes an obstruction to traffic or hinders snow removal or street
improvement or maintenance operation. Such vehicle shall not be
released until the fees for towing and storage are paid, in addition
• to any fine imposed for violation of this ordinance.

Section 7. Turning.
7.01 Restriction on Turns. The Council may by resolution,
whenever necessary to preserve a free flow of traffic or to prevent
accidents, designate any intersection as one where the turning of
• vehicles to the left or to the right, or both, is to be restricted
at all times or during specific hours. The city maintenance super-
intendent shall mark, by appropriate signs, any intersection so
designated. No intersection on a trunk highway shall be so designated
until the consent of the Commissioner of Highways to such designation
is first obtained. No person shall turn a vehicle at any such inter-
section contrary to the direction on such signs.
7.02 U -Turns. The City Council may by resolution from time to
time, whenever necessary to preserve the free flow of traffic or to
prevent accidents, designate "No U -Turn" zones within the City. No
person shall turn a vehicle so as to reverse its direction of travel
on any street so designated "No U -Turn" zone.
Section 8. Through Streets; One Way Streets.
The Council may by resolution designate any street or portion of a
street as a through highway or a one-way roadway where necessary to
preserve the free flow of traffic or to prevent accidents. The city
maintenance superintendent shall post appropriate signs at the entrance
to such street. No trunk highway shall be so designated unless the
consent of the Commissioner of Highways to such designation is first
secured.
Section 9. Seasonal Weight Restrictions.
The city maintenance superintendent may prohibit the operation of
vehicles upon any street under his jurisdiction or impose weight
restrictions on vehicles to be operated on such street whenever the
street, by reason of deterioration, rain, snow, or other climatic
conditions, will be seriously damaged or destroyed unless the use of
vehicles on the street is prohibited or the permissible weights
thereof reduced. He shall erect and maintain signs plainly indicating
the prohibition or restriction at each end of that portion of the
street affected. No person shall operate a vehicle on a posted
street in violation of the prohibition or restriction.
Section 10. Establishment of Safety Zones, Lanes of Traffic, Etc.
To assist in the direction and control of traffic, to improve safe
driving conditions at any intersection or dangerous location, and to
warn pedestrians or drivers of motor vehicles of dangerous conditions
or hazards, the city maintenance superintendent may establish safety
zones, lanes of traffic, and stop intersections, and he may install
stop signs, yield signs, warning signs, signals, pavement markings,
or other devices. No regulation may established on a trunk highway
unless the consent of the Commissioner of Highways is first secured.

Section 11. Parking Prohibitions.
11.01. Fire Lanes. To insure ready and immediate access of city
emergency vehicles, ambulances, and fire fighting equipment to
public places, whether located on privately owned property or on
publically owned property, the City Fire Chief and Chief of Police
shall establish fire lanes, and they shall order installation by the
• city maintenance superintendent of warning signs, fire lane signs,
or other devices. No person shall stop or park a vehicle in an
established fire lane. Parking of motor vehicles or otherwise
obstructing fire lanes shall be prohibited at all times.
11.02. Height Restriction. No person shall park or permit to
stand any vehicle exceeding six (6) feet six (6) inches in height on
West 78th Street between its intersection with Great Plains -Boule-
vard and Laredo Drive.
11.03. Removing Keys. No person shall leave a motor vehicle,
except a truck which is engaged in loading or unloading, unattended
on any street, used car lot, or unattended parking lot without first
stopping the engine, locking the ignition, and removing all ignition
keys from the vehicle. Whenever any police officer finds any motor
vehicle standing in violation of this provision, he shall remove
the keys from the vehicle and deliver them to police headquarters.
11.04. No parking, stopping or standing zones. The City Council
may be resolution designate certain streets or portions of streets
as no parking or no stopping or standing zones, and may limit the
• hours in which the restrictions apply. The city maintenance
superintendent shall mark by appropriate signs each zone so designated.
Except when necessary to avoid conflict with other traffic or in
compliance with the directions of a police officer or a traffic
control device, no person shall stop or park a vehicle in an established
no stopping or standing zone when stopping or standing is prohibited.

11.05. Snow Emergencies. In order to expedite the prompt and
efficient removal of snow from the streets of the city, no person
shall stop, stand or park any vehicle or permit it to stand on any
street within the city between November 1 and April 1 between the
hours of 2:00 a.m. and 6:00 a.m. on any day.
11.06. Prima Facie Violation. The presence of any motor vehicle
on any street when standing or parked in violation of this ordinance
is prima facie evidence that the registered owner of the vehicle
committed or authorized the commission of the violation.

Section 12.
Official City Block Number Map.
The location and boundaries of each numbered city block, as referred
to in this Ordinance, are as set forth and shown on that certain map
entitled "Official City Block Number Map of Chanhassen" dated April 4,
1977, on file in the office of the City Clerk. Said
block number map and all notations, references, and data shown thereon
are hereby incorporated by reference into this Ordinance, and shall
have the same force and effect as if fully set forth and described
herein.
Section 13. Penalty.
Any person violating any provision of this ordinance shall be guilty
of a misdemeanor and shall be punished by a fine of not to exceed
Three hundred dollars ($300.00) or by imprisonment in the county jail
for a period not to exceed ninety (90) days; but if a minimum fine or
imprisonment is prescribed by the State Highway Traffic Regulation Act
for an offense, such penalty shall apply to a person convicted of the
same offense under this ordinance.
Section 14. Repeal.
Ordinance No. 3-D passed July 22, 1974, Ordinance No. 3-E passed July
12, 1976, Ordinance 3-F passed August 16, 1976, and Ordinance 3-G.
passed November 15, 1976 are hereby repealed in their entirety, and
the above Ordinance is substituted in lieu thereof.
Section 15. Effective Date.
This Ordinance becomes effective from and after its passage and
publication.

11.05. Snow Emergencies. In order to expedite the
prompt and efficient removal of snow from the streets of
the city, no person shall stop, stand or park any vehicle
or permit it to stand on any street within the city bet-
ween November 1 and April l between the hours of 2:00
a.m. and 6:00 a.m. on any day.
11.06. Prima Facie Violation. The presence of any
motor vehicle on any street when standing or parked in
violation of this ordinance is prima facie evidence that
the registered owner of the vehicle committed or
authorized the commission of the violation.
Section 12. Official City Block Number Map.
The location and boundaries of each numbered city
block, as referred to in this Ordinance, are as set forth
and shown on that certain map entitled "Official City
Block Number Map of Chanhassen" dated April 4, 1977,
on file in the office of the City Clerk. Said block number
may and all notations, references, and data shown
thereon are hereby incorporated by reference into this
Ordinance, and shall have the same force and effect as
if fully set forth and described herein.
Section 13. Penalty.
Any person violating any provision of this ordinance
shall be guilty of a misdemeanor and shall be punished
by a fine of not to exceed Three hundred dollars
(=300.00) or by imprisonment in the county jail for a
period not to exceed ninety (90) days; but if a minimum
fine or imprisonment is prescribed by the State High-
way Traffic Regulation Act for an offense, such penalty
shall apply to a person convicted of the same offense
under this ordinance.
Section 14. Repeal.
Ordinance No. 3-D passed July 22, 1974, Ordinance No.
3-E passed July 12, 1976, Ordinance 3-F passed August
,16, 1976, and Ordinance 3-G passed November 15, 1976,
are hereby repealed in their entirety, and the above
Ordinance is substituted in lieu thereof.
Section 15. Effective Date.
This Ordinance becomes effective from and after its
passage and publication.
