Ordinance 003jCITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA ORDINANCE NO. 3-J AN ORDINANCE AMENDING SECTION 11.01 OF ORDINANCE 3-H WHICH REGULATES THE USE OF STREETS AND HIGHWAYS WITHIN THE CITY OF CHANHASSEN, INCORPORATING PROVISIONS OF THE STATE HIGHWAY TRAFFIC REGULATION ACT BY REFERENCE, AND IMPOSING A PENALTY FOR THE VIOLATION THEREOF. • THE CITY COUNCIL OF CHANHASSEN ORDAINS: SECTION 1. Section 11.01 of Ordinance 3-H adopted by the City Council on August 1, 1977 is hereby amended to read as follows: 11.01. ESTABLISHMENT OF FIRE LANES: A. Orders Establishing Fire Lanes: The Fire Department is hereby authorized to recommend to the City Council the establishment of fire lanes on public or private property as may be necessary in order that the travel of fire equipment may not be interfered with, and that access to fire hydrants or buildings may not be obstructed. B. Signs and Markings of Fire Lanes: When a fire lane has been ordered to be established pursuant to this Section it shall be marked by a sign bearing the words "No Parking - Fire Lane - by Order of Fire Department" or striped in a manner to indicate no parking. When the fire lane is on public property or a public right of way, the sign or signs shall be erected by the City, and when on private property they shall be erected by owner at his own expense within thirty (30) days after he has been notified of the order. Parking or Otherwise Obstructing Prohibited: After a sign or signs have been erected in accordance with subdivision B of this Section, no person shall park a vehicle or otherwise occupy or obstruct the fire lane. This ordinance allows for adoption of traffic regulations of fire lanes and other emergency traffic situations not already addressed in the Uniform Fire Code, which will provide for the safety of emergenc% personnel and efficient operation. The penalty section of the ordinance provides that violations are a misdeameanor and subject to a penalty up to $700 and/or 90 days in jail.
