• ORDINANCE NO. 13
AN ORDINANCE REGULATING THE PRESENCE OF MINORS UNDER THE AGE OF
EIGHTEEN YEARS ON STREETS OR IN PUBLIC PLACES BETWEEN CERTAIN HOURS,
DEFINING THE DUTIES OF PARENTS AND OTHERS IN THE CARE OF MINORS,
AND PROVIDING FOR ARREST AND PENALTIES FOR VIOLATION THEREOF.
The Village Council ordains:
Section 1: It shall be unlawful for any person under the age of 16 years to
be on or present in any public street, avenue, alley, park or other public
place in the Village of Chanhassen between the hours of 10:00 p.m. and
5:00 a.m. of the following day, official Village time, unless accompanied by
his or her parent or guardian, or person having lawful custody and control of
his or her person or unless there exists a reasonable necessity therefor. The
fact that said child, unaccompanied by parent, guardian, or other person
having legal custody, is found upon any street, alley, or public place after
. 10:00 p.m. or before 5:00 a.m. of the following day, shall be prima facie
evidence that said child is there unlawfully and that no reasonable excuse
exists therefor.
Section 2: It shall be unlawful for. any person under the age of 18 years and
over the age of 16 years to loiter, loaf or idle on or about any public street,
avenue, alley, park or other public place in the Village of Chanhassen be-
tween the hours of p.m. and 5:00 a.m. of the following day, official
Village time.
Section 3: It shall be unlawful for any parent, guardian or other person
having the lawful care, custody or control of any person under the age of 18
years to allow or permit such person to violate the provisions of this ordi-
nance.
Section 4: It shall be unlawful for any person, firm or corporation operating
or in charge of any place of amusement, entertainment or refreshment, or
other place of business, to permit any minor under the age of 18 years to
loiter, loaf or idle in such place during the hours prohibited by this ordi-
nance.
• Section 5: This ordinance shall not be construed as permitting the presence
at any time of any person under 18 years in any place where his presence is
now prohibited by any existing law or ordinance.

Section 6: Wherever the owner or person in charge or in control of any place
of amusement, entertainment, refreshment, or other place of business shall
find persons under the age of 18 years loitering, loafing or idling in such
place of business, he shall immediately order such person to leave, and if
• such person refuses to leave the said place of business, the operator, shall
immediately inform the Police Department of the violation.
Section 7: Any member of the police force is authorized to arrest any person
or persons violating the provisions of this ordinance.
Section 8: Any person violating any of the provisions of this ordinance shall,
upon conviction, be punished by a fine not exceeding $100.00 or by imprison-
ment for a period not exceeding ninety days.

Streets or in Public Places Be-
tween Certain Hours, Defining
the Duties of Parents and Oth-
ers in the Care of Minors, and
Providing for Arrest and Pen-
alties for Violation Thereof.
The Village Council Ordains:
Section 1: It shall be unlawful
for any person under the age of
j 16 years to be on or present in
any public street, avenue, alley,
park or other public place in the
Village of Chanhassen between
the hours of 10:00 p.m. and 5:00
a.m. of the following day, official
Village time, unless accompanied
by his or her parent or guardian,
or person having lawful custody
and control of his or her person
or unless there exists a reason-
able necessity therefor. The fact
that said child, unaccompanied
by parent, guardian, or other per-'
son having legal custody, is found
upon any street, alley, or public
r place after 10:00 p.m. or before
5:00 a.m. of the following day,

Section 3: It shall be unlawful
for any parent, guardian or other
person having the lawful care,
custody or control of any person
under the age of 18 years to allow
or permit such person to violate
the provisions of this ordinance.
Section 4: It shall be unlawful
for any person, firm or corpora-
tion operating or in charge of any
place of amusement, entertain-
ment or refreshment, or other
place of business, to permit any
minor under the age of 18 years
to loiter, loaf or idle in such place
during the hours prohibited by
this ordinance.
Section 5: This ordinance shall
not be construed as permitting M
the presence at any time of any
person under 18 years in any
place where his presence is now
prohibited by any existing law or
ordinance.
Section 6: Wherever the owner
or person in charge or in control
of any place of amusement, enter-
tainment, refreshment, or other
place of business shall find per-
sons under the age of 18 years
loitering, loafing or idling in such
place of business, he shall imme- ;
diately order such person to
leave, and if such person refuses
to leave the said place of busi-
ness, the operator shall imme-
diately inform the Police Depart-
ment of the violation.
Section 7: Any member of the
police force is authorized to.
arrest any person or persons vio-
lating the provisions of this ordi-
nance.
Section 8: Any person violating
any of the provisions of this ordi-
nance shall, upon conviction, be
punished by a fine not exceeding
$100.00 or by imprisonment for a
period not exceeding ninety days.

AFFIDAVIT OF PUBLICATION
STATE OF MINNESOTA SS
County of Hennepin
N. J. Van Sloun, being duly sworn, on oath says he is and
during all the times herein stated has been the General Manager -
printer of the newspaper known as The Excelsior South Shore
Minnetonka Herald and has full knowledge of the facts herein stated
as follows:
(1) Said newspaper is printed in the English language in news-
paper format and in column and sheet form equivalent in printed
space to at least 900 square inches. (2) Said newspaper is a weekly
and is distributed at least once each week. (3) Said newspaper has
50% of its news columns devoted to news of local interest to the com-
munity which it purports to serve and does not wholly duplicate
any other publication and is not made up entirely of patents, plate
matter and advertisements. (4) Said newspaper is circulated in and
near the municipality which it purports to serve, has at least 500
copies regularly delivered to paying subscribers, has an average of
at least 75% of its total circulation currently paid or no more than
three months in arrears and has entry as second-class matter in its
local post -office. (5) Said newspaper purports to serve the Village of
Excelsior, in the County of Hennepin, and it has its known office of
issue in the Village of Excelsior, in said county, established and
open during its regular business hours for the gathering of news,
sale of advertisements and sale of subscriptions and maintained by
the managing officer of said newspaper or persons in his employ and
subject to his direction and control during all such regular business
hours and devoted exclusively during such regular business hours to
the business of the newspaper and business related thereto. (6) Said
newspaper files a copy of each issue immediately with the State
Historical Society. (7) Said newspaper has complied with all the
foregoing conditions for at least two years preceding the day or
dates of publication mentioned below. (8) Said newspaper has filed
with the Secretary of State of Minnesota prior to January 1, 1966
and each January 1 thereafter an affidavit in the form prescribed by
the Secretary of State and signed by the General Manager of said
newspaper and sworn to before a notary public stating that the news-
paper is a legal newspaper.
