AN ORDINANCE ESTABLISHING A PARK AND RECREATION COMMISSION FOR THE VILLAGE is OF CHANHASSEN, MINNESOTA. THE VILLAGE COUNCIL OF CHANHASSEN ORDAINS: Section 1. Subdivision 1. There is hereby created a Park and Recrea- tion Commission for the Village of Chanhassen, Minnesota, consisting of seven members to be appointed by the Mayor with the approval of the Village Council. The first Commission shall consist of two members appointed for three year terms, two members appointed for two year terms, and three members appointed for one year terms. Subsequent appointments shall be made for three year terms. All terms shall be on the basis of calendar years. Subdivision 2. Members of the Commission shall serve without compensation, and their terms of office shall expire at the end of the period for which they are appointed. Subdivision 3. Upon appointment, all members of the first Commission shall meet forthwith and organize by electing a Chairman and Vice Chairman to serve in the absence of the Chairman and by adopting such rules for the conduct of its work as the Commission may deem necessary. Said rules shall include the establishment of a regular time for monthly meetings of the Commission. Thereafter a Chairman and Vice Chairman shall be elected at the regular meeting of the Commission in January of each year and the rules, including the times of regular meetings may be changed, enlarged or amended by majority vote at any regular meeting of the Commission. Section 2. The Commission shall advise the Village Council in the conduct of a public recreation program for the Village of Chanhassen and to that end the Commission shall advise the Village Council in providing, conducting and supervising recreation areas, facilities, services and programs for public recreation, including such facilities as playgrounds, parks, swimming pools, beaches, camps and indoor recreation centers either within or without the corporate limits of the Village upon property under the custody and management of the Village or upon other public or private property with the consent of the owners of such property. The Commission. shall advise the Village in the operation of parks, recreation areas and like facilities now owned or hereafter acquired by the Village, and may advise the Village to enter into agreements of a cooperative nature with other public and private agencies, organizations or individuals when, in the judgment of the Commission, such procedure would prove advantageous. C7 0 Section 3. Subdivision 1. The Commission shall advise the Villaae Council in the employment of a qualified superintendent of recreation and such other personnel as may be necessary in its judgment for the efficient administration, conduct and development of the public recreation system of the Village of Chanhassen. Subdivision 2. With the approval of the Village Council, the superintendent of recreation may serve as the executive secretary of the Commission with areas of responsibility as defined by the Council. It shall be the duty of the Recreation Commission to make recommendations to the Village Council concerning the property acquisitions needed to complete a comprehensive recreation system. Section 4. On or before September 1st of each year, the Commission shall render a full report to the Village Council covering its operation for the preceding 12 months, together with its recommendations and an estimate of the funds required for its work for the ensuing year. It shall also render such other regular or special reports, advisory recommendations or make such investigations as it deems advisable, or as may be requested by the Village Council. Section 5. A recreation fund shall be established in the Village budget into which all taxes levied and collected for recreation purposes and all gifts, bequests or endowments of money as donations or grants from persons, firms or corporations including government agencies and all fees and charges for recreational services or facilities shall be deposited. Section 6. This ordinance shall take effect and be in force from and after its publication. Passed by the Council this 15th day of January 1968. AFFIDAVIT OF PUBLICATION STATE OF MINNESOTA SS County of Hennepin N. J. Van Sloun, being duly sworn, on oath says he is and during all the times herein stated has been the General Manager - printer of the newspaper known as The Excelsior South Shore Minnetonka Herald and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the English language in news- paper format and in column and sheet form equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted to news of local interest to the com- munity which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements. (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office. (5) Said newspaper purports to serve the Village of Excelsior, in the County of Hennepin, and it has its known office of issue in the Village of Excelsior, in said county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer of said newspaper or persons in his employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours to the business of the newspaper and business related thereto. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the General Manager of said newspaper and sworn to before a notary public stating that the news- paper is a legal newspaper.
