Ordinance 023bCITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA ORDINANCE NO. 23-B AN ORDINANCE ADOPTING THE MINNESOTA STATE BUILDING CODE; PROVIDING FOR ITS ADMINISTRATION AND ENFORCEMENT; FIXING FEES FOR BUILDING PERMITS; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH, INCLUDING ORDINANCES NO. 23 AND 23-A. • THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS: Section 1. Building Code. The 1980 Edition of the Minnesota State Building Code, one copy of which is on file in the office of the City Clerk, is hereby adopted as the Building Code of the City of Chanhassen and incorporated in this ordinance as completely as if set out in full. Section 2. Additional Codes. The following codes, adopted by reference as a part of the 1980 Edition of the State Building Code, are adopted by reference and incorporated herein as a part of the Building Code of the City of Chanhassen. 8. State of Minnesota Mobile Home Installation Standards ;• 1977, identified as 2MCAR 1.90450 installations and related definitions in 2MCAR 1.90103. • 9. Standards of Performance for Solar Energy Systems and Subsystems Applied to Energy Need of Buildings, 1977 Edition, identified as 2MCAR 1.16101 through 2MCAR 1.16108. 1. 1979 Edition of the Uniform Building Code, identified as "UBC"; 2. 1978 Edition of the National Electric Code, identified as "NEC" 3. 1978 American National Standard Safety Code for Elevators, Dumbwaiters, Escalators and Moving Walks, identified as ANSI A17.1-1978 and Supplement, ANSI A17.la - 1979. 4. 1979 Minnesota Plumbing Code, identified as MHD 120 through MHD 135. 5. "Flood Proofing Regulations", June 1972, Office of the Chief of Engineers, U.S. Army. 6. Minnesota Heating, Ventilating, Air Conditioning and Refrigeration Code, identified as SBC 7101 through SBC 8505. 7. "Design and Evaluation Criteria for Energy Conservation in New Building, Additions and Remodeled Elements of Buildings and Standards for Certain Existing Public • Buildings", identified as 2MCAR Section 1.6001 through 2MCAR Section 1.16006. 8. State of Minnesota Mobile Home Installation Standards ;• 1977, identified as 2MCAR 1.90450 installations and related definitions in 2MCAR 1.90103. • 9. Standards of Performance for Solar Energy Systems and Subsystems Applied to Energy Need of Buildings, 1977 Edition, identified as 2MCAR 1.16101 through 2MCAR 1.16108. Section 3. Appendices, Standards and Supplemental Materials. Certain Appendices, Standards and Supplemental Materials referenced in the 1980 Edition of the State Building Code are hereby adopted by reference as part of the Building Code of the City of Chanhassen and incorporated into this ordinance as completely as if set out in full: 1. Minnesota State Building Code Appendix "A", Technical Requirements for Fallout Shelter. • 2. Minnesota State Building Code Appendix "B", Variation in Snow Loads. 3. 1979 UBC Appendix, Chapter 35. 4. Minnesota Plumbing Code Appendix B. 5. Minnesota State Building Code. Appendix "C" abbreviations and addresses of Technical Organizations. 6. 1979 UBC Appendix, Chapters 12,38,48,49,55 and 70. 7. Minnesota Plumbing Code Appendices C and D. 8. Flood Proofing Regulations, Sections 201.2 through 208.2. 5. Minnesota State Building Code Appendix "D", Building Security Sections 4101-4110. Section 4. Organization and Enforcement. The organization of the Bui ing Department and enforcement of the Code shall be conducted within the guidelines established by Chapter 2 of the Uniform Building Code 1979 Edition. 4.01. Department and Administrative Authority. The Building Department shall be the Building Code Department of the City of Chanhassen. The Administrative Authority shall be a State Certified "Building Official" so designated by the Appointing Authority. The personnel serving under the Building Official are the Building Department and the Building Official is the Adminis- trative Authority wherever those terms are used in the Minnesota State Building Code and the Appendices adopted by reference in this ordinance. •r, 4.02. Appointing Authority. The Appointing Authority shall be the City Council of the City of Chanhassen. Section 5. Fees. 5.01. Fee Schedule. The fee for a building permit is • set fortH in the followi`ng schedule according to the value of the construction as determined by the Building Official: -2- Total Valuation Fee $1.00 to $500.00 $10.00 $501.00 to $2,000.00 $10.00 for the first $500.00 plus $1.50 for r,ach additional $100.00 or fraction thereof, to and including $2,000.00 $2,001.00 to $25,000.00 $32.50 for the first $2,000.00 • plus $6.00 for each additional $1,000.00 or fraction thereof, to and including $25,000.00 $25,001.00 to $50,000.00 $170.50 for the first $25,000.00 plus $4.50 for each additional $1,000.00 or fraction thereof, to and including $50,000.00 $50,001.00 to $100,000.00 $283.00 for the first $50,000.00 plus $3.00 for each additional $1,000.00 or fraction thereof, to and including $100,000.00 $100,001.00 and up $433.00 for the first $100,000.00 - plus $2.50 for each additional $1,000.00 or fraction thereof. 5.02. Plan -Checking Fees. When building plans are required by the Building Official a plan -_checking fee of 65% of the building permit fee as set forth in Section 5.01 shall be paid to the administrative authority at the time of submitting plans and specifications for checking, except that the plan -checking fee for a single family residence shall -be 50% of the building permit fee. Where plans are incomplete, or changed so as to require additional plan -checking, an additional plan -check fee shall be charged at a rate established by the Building Official. 5.03. Expiration of Plan -Check. Applications for which no permit is issued within 180 days following the date of application shall expire by limitation and plans submitted for checking may thereafter be returned to the applicant or destroyed by the Building Official. The Building Official may extend the time for action by the applicant for a period not exceeding 180 days upon written request by the applicant showing that circumstances beyond the control of the applicant have prevented action from being taken. In order to renew action on an application after expiration, the applicant shall re -submit plans and pay a new plan -check fee.. • 5.04. Reinspection Fee. The fee for each reinspection shallYe at the rate o .00 per hour. 5.05. Surcharge. In addition to the fee required by Section 5.01, the applicant shall pay a state surcharge in the • amount fixed by law. The amount required by law shall -be remitted quarterly to the Minnesota Department of Administration. • 5.06. Demolition Fee. The fee for a permit to demolish a building shall be 25.00. -3- 5.07. Refund of Fees. Upon return of a building permit to the City by the holder thereof, with proof satisfactory to the Building Official that no construction was undertaken pursuant thereto, he shall refund to the holder the building permit fee paid by him, except that 5% of the fee paid or $25.00, whichever is greater, shall be retained by the City. A like refund shall be made of any plan -checking fee paid pursuant to this ordinance, except that no refund.shall be made if the City has caused the • plans to be checked. Section 6. General Regulations. 6.01. Plans and Specifications. The Building Official may require that plans and specifications,required under Section 302(b) of the Uniform Building Code,include a survey of the lot upon which the proposed building or construction is to be done, prepared and attested by a registered surveyor, and providing the following information: a. Each lot corner (either existing or proposed). b. Crown of proposed street at each lot line extended. • c. Proposed lawn and driveway elevations at the street side of house. 11. The proposed disposal of drainage and surface waters, • indicating direction of surface water drainage by arrows. 6.02. Denial of Permit. The Building Official shall . deny a permit for construction or enlargement of a dwelling on ground which is too low for adequate drainage of surface waters. He shall also deny a permit for construction or enlargement of any building when it appears that the proposed elevations of the lot -4- 1. Scale of drawing. 2. Lot and block number or legal description of lot. 3. Dimensions of lot and north point. 4. Dimensions of front, rear, and side yards. 5. Locations of,all existing buildings on the lot. 6. Location of proposed building or construction. 7. Location of stakes established by the surveyor along each side lot line a distance of 30 and 60 feet from the front lot corner. The maintenance of these stakes once established by the surveyor shall be the responsibility of the building permit applicant. 8. The side yard and set back dimension of buildings located on adjacent lots. 9. The location of all easements as shown on record plats. 10. Grade elevations atathe following points: a. Each lot corner (either existing or proposed). b. Crown of proposed street at each lot line extended. • c. Proposed lawn and driveway elevations at the street side of house. 11. The proposed disposal of drainage and surface waters, • indicating direction of surface water drainage by arrows. 6.02. Denial of Permit. The Building Official shall . deny a permit for construction or enlargement of a dwelling on ground which is too low for adequate drainage of surface waters. He shall also deny a permit for construction or enlargement of any building when it appears that the proposed elevations of the lot -4- for which the permit is to be issued, in relation to the established or proposed grades of adjoining or nearby streets, will probably cause a change in the existing drainage of surface waters which will result in substantial hazard or inconvience to persons residing in the City or traveling on its streets. 6.03. Interference with Surface Waters. No temporary or permanent obstruction, diversion, bridging or confining of an existing channel or natural waterway through or over which any • lake, stream or surface water naturally flows shall be made without the written approval of the City Engineer and the Building Official. Section 7. Violations and Penalties. It is unlawful for any person, Yirm. or corporation to erect, construct, enlarge, alter, repair, move improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure in the city, or cause the same to be done, contrary to or in violation of any provision of this ordinance or the codes adopted by reference in this ordinance. Any person, firm or corporation violating this ordinance or any code adopted by reference in this ordinance shall be deemed quilty of a separate offense for each day or portion thereof during which any such violation is committed, continued, or permitted, and upon conviction of any such violations, such person, firm or corporation,shall be punishable by a fine of not more than $500.00 or by imprisonment for not more than 90 days, or by both such fine and imprisonment, plus the costs of prosecution in any case. Section 8. Ordinances Repealed. Ordinances 23 and 23-A, enacted March 4, 1968 and January 26, 1970, respectively, are hereby repealed together with all other ordinances of the City or parts, portions, or sections of such ordinances in conflict herewith. Section 9. Title. This ordinance, including all portions hereof hereby adopted by incorporation and reference, is hereby entitled and shall be cited as "The Chanhassen Building Code". Section 10. Effective Date. This ordinance shall take effect and be in force from and after its passage and publication.
