VILLAGE OF CHANHASSEN
CARVER AND HENNEPIN COUNTIES, MINNESOTA
ORDINANCE NO.
• AN ORDINANCE SETTING FORTH URBAN AND RURAL SERVICE DISTRICTS IN THE
VILLAGE OF CHANHASSEN, MINNESOTA, AND RELATING TO TAXATION OF LANDS
WHICH ARE RURAL IN CHARACTER AND NOT DEVELOPED FOR COMMERCIAL,
INDUSTRIAL OR URBAN RESIDENTIAL PURPOSES, ALL PURSUANT TO AUTHORITY
OF CHAPTER 712, LAWS 1965.
THE COUNCIL OF THE VILLAGE OF CHANHASSEN ORDAINS:
Section 1. The Village of Chanhassen hereby divides the area within its
limits in Carver County into an urban service district and a rural service district,
constituting separate taxing districts for the purpose of all municipal property
taxes except those levied for the payment of bonds and judgments and interest
• thereon.
Section 2. The urban service district shall include all properties within
the Carver County limits of the Village of Chanhassen except those set forth by
ordinance as the rural service district.
Section 3. The rural service district shall include only such unplatted lands,
which need not be contiguous to one another, as in the judgment of the Village
Council at the time of adoption of the ordinance are rural in character, and are not
developed for commercial, industrial or urban residential purposes, and for these
reasons are not benefited to the same degree as other lands by municipal services
financed by general taxation. This ordinance may include lands outside the Village
• of Chanhassen which if annexed shall be included in the rural service district.

Section 5. Whenever any parcel of land included in the rural service district
is platted, in whole or in part, or whenever application is made for a permit for the
• construction of a commercial, industrial or urban residential building or improvement

to be situated on such parcel or any part thereof, or whenever such building or
improvement is commenced without a permit, the Village Council shall make and
enter an order by resolution transferring such platted or improved parcel from
the rural service district to the urban service district.
Section 6. In the judgment of the Village Council, the ratio which exists
between the benefits resulting from tax supported municipal service to parcels in
the rural service district to parcels in the urban service district is 60 per cent,
plus any municipal property taxes levied for payments of bonds, and judgments,
and interest thereon.
Section 7. a) No Village services beyond that normally provided by the
Townships of Carver County will be provided by the Village in a rural service dis-
trict, except fire, police and planning services; b) land in a rural service district
shall be used primarily for agricultural purposes and may include pasture, timber,
waste, unuseable wild land and land included in federal farm programs; c) grading
is not considered as development provided grading is such as to hold storm runoff
on the land and not produce storm runoff problems and provided graded areas are
cropped or reseeded within one year; d) any fill hauled in shall be graded and
seeded at least once each year.
Section 8. This ordinance shall take effect and be in force from and after
its passage, filing with the Auditor, Carver County, Minnesota, and publication.

W. JOHN BERTRAM, being duly sworn, on oath says he is and during all times here stated
has been the vice president and printer of the newspaper known as The Excelsior -South Shore
Sun and has full knowledge of the facts herein stated as follows: (1) Said newspaper
is printed in the English language in newspaper format and in column and sheet form
equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly and
is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted
to news of local interest to the community which it purports to serve and does not wholly
duplicate any other publication and is not made up entirely of patents, plate matter and
advertisements. (4) Said newspaper is circulated in and near the municipality which it purports
to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of
at least 75% of its total circulation currently paid or no more than three months in arrears
and has entry as second-class matter in its local post -office. (5) Said newspaper purports to
serve the Village of Excelsior in the County of Hennepin and it has its known office of
issue in the Village of Excelsior in said county, established and open during its regular business
hours for the gathering of news, sale of advertisements and sale of subscriptions and main-
tained by the managing officer or persons in its employ and subject to his direction and con-
trol during all such regular business hours and devoted exclusively during such regular
business hours to the business of the newspaper and business related thereto, (6) Said news-
paper files a copy of each issue immediately with the State Historical Society. (7) Said news-
paper has complied with all the foregoing conditions for at least two years preceding the day
or dates of publication mentioned below. (8) Said newspaper has filed with the Secretary of
State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the
form prescribed by the Secretary of State and signed by the publisher of said newspaper and
sworn to before a notary public stating that the newspaper is a legal newspaper.
