Ordinance 030U •..i� RHL 10/17/68 VILLAGE OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA ORDINANCE NO. 30 • AN ORDINANCE REGULATING THE INSTALLATION, ALTERATION, EXTENSION AND REPAIR OF PLUMBING SYSTEMS; REQUIRING PERMITS THEREFOR; LICENSING OF PERSONS ENGAGED IN THE INSTALLATION THEREOF; PROVIDING FOR INSPECTION; PRESCRIBING PENALTIES; AND ADOPTING BY REFERENCE THE MINNESOTA PLUMBING CODE. The Council of the Village of Chanhassen ordains: Section 1. MINNESOTA PLUMBING CODE. A certain document, three copies of which are on file in the office of the Village Clerk of the Village of Chanhassen, each being marked "Official Copy, Village of Chanhassen" and designated as Minnesota Plumbing Code, adopted by the Minnesota State Board of Health on July 20, 1937, and as amended on May 9, 1939, January 14, 1947, and October 16, 1951, be and the same is hereby adopted as the Plumbing Code of the Village of Chanhassen for regulating the installation, alteration, extension and repair of plumbing systems; requiring permits therefor; licensing of persons en- gaged in the installation thereof; providing for inspection; prescribing penalties; and each and all of the regulations , provisions, conditions , terms and penalties of said Minnesota Plumbing Code are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance except for the amendments, deletions and additions thereof hereinafter set forth. Section 2. CONSTRUCTION OF MINNESOTA PLUMBING CODE. Wherever used in said Minnesota Plumbing Code or this ordinance, "City" or "Village" shall mean the Village of Chanhassen, "Council" shall mean the Council of the Village of Chanhassen, "Clerk" shall mean the Clerk of the Village of Chan- hassen, "Prop._ administrative authority" shall mean t Village Plumbing Inspector engaged by the Village and assigned the responsibility • for the administration of this ordinance. Section 3. ADDITIONS, AMENDMENTS AND DELETIONS. 3.01 Building Sewer and Drain. The building sewer or building is drain when underground shall not be placed closer than 20 feet to any water supply well or buried water suction pipe. 3.02 New Construction. In all new construction provision shall be made for future public sewer connection by providing for the connection of the building drain with the building sewer, and no permit shall be issued under Section 5 hereof unless the applicant shall have first submitted satisfactory detailed plans and specifications to the Village Clerk providing for such connection. 3.03 Village and Community Water Systems. Water service lines from a village or community water system and water meters shall be installed in the manner specified in Ordinance No. 6 of the Village of Chanhassen. 3.04 Village Sanitary Sewer System. All connections with the Village sanitary sewer system, hereinafter referred to as the public sewer, shall be made in accordance with the provisions of the Minnesota Plumbing Code as herein adopted, Ordinances Nos. 5 and 5A of the Village of Chanhassen, and the following provisions: (a) The connection of the building sewer into the public sewer shall be made at the "Y" branch if such branch is available at a suitable location. If the public sewer is twelve (12) inches in diameter or less, and a properly located "Y" branch is not available, the • owner, at his expense, shall install a "Y" branch in • the public sewer at the location specified by the Village Engineer. Where the public sewer is greater than 12 inches in diameter, and a properly located "Y" -2- nch is not available, a neat hole may :ut into the public sewer to receive the building • sewer with entry in the downstream direction at an angle of approximately forth -five (45) degrees above horizontal. • A forth -five (45) degree ell may be used to make such connection, with the spigot end cut so as not to extend past the inner surface of the public sewer. The invert of the building sewer at the point of connection shall be at the same or at a higher elevation than the spring line of the public sewer. A smooth neat joint shall be made, and the connection made secure and watertight by engagement in concrete. Special fillings may be used for the connection only when approved by the Village Engineer. (b) All connections to the public sewer shall be made where building sewers have been installed. Connections with the public sewer at any other location shall be approved by the Village Engineer prior to commencement of construction. In the event a previously installed building sewer cannot be used, the property owner shall pay the full cost of making the connection. 3.05 Existing Plumbing Installations. Existing plumbing installations which do not meet the standards established by this code may be repaired or altered only upon written authorization of the Village Plumbing Inspector provided such repair or alteration does not endanger the • public health. Section 4. LICENSE, BOND and FEE. 4.01 License and Bond. No person, firm or corporation shall engage in or work at the business of a master plumber or journeyman plumber Qct in the Villalef Chanhassen unless licensed to do so the Minnesota State Board of Health; and no person, firm or corporation shall engage in the business of installation, alteration, extension, or repair of plumbing systems within the Village without first obtaining a license from the Village to carry on such occupation, • and filing with the Clerk a surety bond in the amount of $2,000.00 in favor of the Village and the public suffering damages by reason of the breach of the conditions of said bond, said bond to be in the form prescribed by the Village and conditioned upon the faithful performance of contracts and compliance with this ordinance by the licensee. Such license shall be renewable annually on or before January 1 of each year and may be revoked or refused by the Council for cause. Any installation, alteration, extension, or repair of a plumbing system by a licensee in violation of the provisions of this ordinance or a refusal on the part of a licensee to correct • such defective work performed by such licensee shall be cause for revocation of or refusal to renew a license. No licensee shall allow any other person, firm or corporation to use such license for the performance of plumbing work within the Village. 4.02 Fee. The annual license fee shall be $25.00. Application for such license shall be made annually on a form furnished by the Village. 4.03 Hearing. Before any license issued under the provisions of this section may be revoked or its renewal refused, the licensee shall be given a hearing to show cause why such license should not be revoked or refused. Notice of the time, place and purpose of such hearing • shall be in writing delivered in person to the licensee, or mailed . to said licensee by certified mail at the address of the licensee as set forth on licensee's application. Section 5. PERMITS, FEES and APPLICATIONS. -4- 5.01 E—( s and Fees. No person, firm or corpo -)n shall install, alter, repair, or extend any plumbing system in the Village without first obtaining a permit therefor from the Village. At the time of application for said permit, the applicant shall pay a fee therefor as follows: • Minimum plumbing permit fee $15.00 For each plumbing fixture or fixture opening in excess of 8 $ 1.00 Private community water service connection $10.00 Sanitary sewer service connection $10.00 5.02 Connection with Water and Sewer Systems. A plumbing permit is required for the installation and connection of each water service line or pipe with the water main of all water systems serving more than one family, and for all sewer connections with the Village Sanitary Sewer System. An excavation permit as provided by Ordinance No. 27 of the Village of Chanhassen shall be required if any part of the excavation for water service or sewer service is within a Village street. 5.03 Applications. Application for a permit shall be made in writing upon forms furnished by the Village and shall be signed by the applicant. Each application for a permit shall have thereon the street address or legal description of the property on which the proposed installation, alteration, repair, or extension is to take place; and each application for a permit shall be accompanied by complete plans and specifications for the plumbing installation, repair, alteration, or extension together with substantiating data attesting to the compliance with the minimum standards of this ordinance. The application shall state the name of the person, firm • or corporation who is to install the system, and shall provide such further information as may be required by the Plumbing Inspector. 5.04 Plans and Specifications. Plans and specifications for installation, alteration, repair and extension of plumbing systems M"z 'for all buil s, except single family or 2 -family d0ngs and buildings with less than 2000 square feet, shall be prepared and signed by an engineer or architect registered by the State of Minnesota. 5.05 Minor Repairs. No permit shall be required in case of • repair not affecting sanitation, such as mending leaks in faucets, valves of water supply pipes, mending broken fixtures, tanks, boilers, releasing frozen pipes, or rodding and flushing of house sewers or drains. 5.06 Penalty. Any person, firm or corporation commencing the installation, alteration, repair or extension of any plumbing system or doing any act for which a permit is required without first having obtained such permit, shall pay, in addition to the fees prescribed herein, an additional fee of 100% of the applicable permit fee; and the payment of such additional fee shall not relieve such person, firm or corporation from other penalties prescribed in this Code. Section 6. ADMINISTRATION. The Council may delegate responsibility for the administration of this ordinance to a qualified plumbing inspector. Section 7. INSPECTIONS and TESTS. 7.01 Renotification. The fee for renotification and reinspection as provided in Subsection (c) of Section 157 of Article XIV of the Minnesota Plumbing Code is hereby established to be $10.00. Section 8. VIOLATIONS. In addition to the penalties for violations of this ordinance as set forth in Sections 4 and 5 hereof, any person, firm or corporation • violating or failing to comply with any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not to exceed $100.00 or by imprisonment for not to exceed 90 days for each offense. Each day that a violation • • i is permitted to exist shall constitute a separate offense. Section 9. TITLE. This ordinance including all portions hereof hereby adopted by incorporation and reference is hereby entitled and shall be cited as "The Chanhassen Plumbing Code." Section 10. EFFECTIVE DATE.
