Ordinance 033a•r • • VILLAGE OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA ORDINANCE NO. 33-A a AN ORDINANCE AMENDING SECTIONS 6.01(k) , 7.02 (f) , 7.02 (h) , 8.03 (h) , 8.04(a) , 8.05(b) , and 18, OF THE SUBDIVISION ORDINANCE OF THE VILLAGE OF CHANHASSEN AND ADDING THERETO SECTIONS 7.02 (k) , 7.03(i) and 7.04(h). THE VILLAGE COUNCIL OF CHANHASSEN ORDAINS: SECTION 1. Sections 6.01(k) , 7.02 (f) , 7.02 (h) , 8.03 (h) , 8.04 (a) , 8.05(b) and 18 of Ordinance No. 33 entitled, "The Subdivision Ordinance of the Village of Chanhassen", adopted February 17, 1969, are hereby amended to read as follows: Section 6.01 Procedure. k. The Village Council shall act to approve or dis- approve the preliminary plat within 60 days after the conclusion of the public hearing required by subsection (e) hereof. If the report of the Planning Commission has not been received within said period the Council shall act without such report. Section 7.02 Existing Conditions. f. Location and width of existing streets including type of surfacing, railroads, sanitary sewers, water mains, storm sewers, culverts, grades , invert elevations and locations of catch basins, manholes and hydrants and any underground facilities within the plat and to a distance of 100 feet beyond shall be shown. h. Topographic data within the tract and 100 feet beyond its boundaries, including contours at vertical intervals of not more than two feet, except that where the horizontal contour interval is 100 feet or more, a one foot vertical interval shall be shown. Water • courses , lakes , marshes , wooded areas , rock outcrops and other significant physical features shall be shown. U. S. geodetic survey . data shall be used for all topographic mapping. • Section 8. 03 Streets. h. Service Streets. In those instances where a sub- division abuts or contains an existing or planned thoroughfare or a railroad right-of-way, the Planning Commission may require a • service street approximately parallel to and on each side of such right-of-way in order to provide for park use of the intervening land in residential districts, or may provide for commercial or industrial use of the intervening land in commercial or industrial districts. The requirements of approach grades and future grade separations shall be considered in establishing the separation distance between said service streets and the thoroughfare or railroad right-of-way. • • n Section 8.04 Easements. a. Utility. Easements at least 12 feet wide, centered on rear and side lot lines of abutting lots shall be provided for utilities where necessary. In those instances where a side or rear lot line abuts unplatted land, said easements shall be at least feet wide. Utility easements shall have continuity of alignment from block to block and lot to lot. Easements may be required along lot lines to rights-of-way so as to provide for street lighting. ection 8.05 Blocks. b. Off-street areas. Lots intended for commercial, industrial, or uses other than single family dwellings shall be so designed to provide adequate off-street areas for parking, loading, and such other facilities as shall be required by the Zoning Ordinance of the Village. Section 18. Violation and Penalty. 18.01 Violation and Penalty. Any person, firm or corporation who shall violate any of the provisions hereof, or who shall make any false statement in any document required to be submitted under the provisions hereof, shall be guilty of a misdemeanor and, upon con- viction thereof, shall be punished by a fine not to exceed $300 or by imprisonment not to exceed 90 days. Each day that a violation continues shall constitute a separate offense. 4b 18.02 Enforcement. The platting, replatting, subdividing or conveyance of land in violation of the requirements of this ordinance may be restrained, enjoined or abated by any appropriate remedy in any court of competent jurisdiction. -2- 0 N • • • SECTION 2. Sections 7.02 , 7.03 and 7.04 of Ordinance No. 33, entitled the "Subdivision Ordinance of the Village of Chanhassen", adopted February 17, 1969, are hereby amended by adding thereto the following sub- sections to read as follows: Section 7.02 Existing Conditions. k. A copy of the soil survey map covering the proposed plat issued by the Soil Conservation Service of the United States Department of Agriculture in November 1968, and as thereafter amended. Section 7.03 Design Features. i. Proposed method of controlling soil erosion and sedimentation within and beyond the limits of the plat during all phases of construction and thereafter. • Section 7.04 Additional Information to be Furnished. h. In areas in which soil limitations for the proposed land use are indicated by the soil survey map, furnish proposals cov- ering the details of the soil conservation practices to be employed to overcome all such soil limitations.
