Ordinance 033cCITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA ORDINANCE NO. 33-C AN ORDINANCE AMENDING SECTIONS 4 AND 7.03(e) OF ORDINANCE NO. 33, THE CHANHASSEN SUBDIVISION ORDINANCE. THE CITY COUNCIL OF CHANHASSEN ORDAINS: Section 1. Section 4, Definitions, of Ordinance No. 33, entitled the "Chanhassen Subdivision Ordinance," adopted February 17, 1969, is hereby amended as follows: a. DELETE therefrom the definitions of "OPEN SPACE" and "PARKS AND PLAYGROUNDS." b. ADD thereto the following definition: ACTIVE RECREATIONAL AREAS are areas within a plat dedicated for public use as parks, playgrounds, trails, beaches, and other areas for active recreational pursuits, and may include such areas as the subdivider has pro- vided for the exclusive use of the residents of the subdivision. Active recreational areas shall not include soil and water conservation areas. C. ADD thereto the following definition: SOIL AND WATER CONSERVATION AREAS are areas within a plat dedicated for public use for the control of drainage, erosion and siltation within and contiguous to a plat, and may include storm water holding areas and ponds, wetlands, water courses and drainageways and other site development practices and techniques for the control of drainage, erosion, and siltation. Soil and water conservation areas may include other public uses without active recreational area land credit being given therefor if, in the opinion of the City Engineer, the soil and water conservation areas are necessary for said purposes, regardless of other uses. d. ADD thereto the following definition: PRESERVATION AREAS are areas within a plat dedicated to the public use for the preservation of forest and areas of aquatic vegetation and similar amenities which, if preserved, will add attractiveness and stability to the plat and • contiguous lands. Preservation areas may include soil and water conservation areas, but shall not include active recreational areas. • -1- r Section 2. Subsection (e) of Section 7.03 of Ordinance No. 33, entitled the "Chanhassen Subdivision Ordinance," adopted February 17, 1969, is hereby amended to read as follows: e. Areas other than streets, pedestrian ways, and utility easements, intended to be dedicated to the public for active recreational areas, soil and water conservation • areas, and preservation areas, including the size of such areas. Section 3. Effective Date. This ordinance shall become effective from and after its passage and publication.
