Ordinance 089CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA ORDINANCE NO. 89 AN ORDINANCE REGULATING THE PARKING OF BOAT TRAILERS ON SOUTH SHORE DRIVE, SOUTH SHORE COURT, AND HILL STREET The City Council of the City of Chanhassen ordains: SECTION 1. DEFINITIONS. 1.01 The following words, terms and phrases, when used in this section shall have the meanings ascribed to them in this section: A. Boat Trailer means any device used to transport any watercraft when pulled behind any motor vehicle. B. Watercraft means any contrivance used or designed for navigation on water other than a seaplane. SECTION 2. RESTRICTIONS. 2.01 No person shall park a boat trailer on South Shore Drive, South Shore Court, or Hill Street. The City Engineer shall mark by appropriate signs each afore- mentioned street. SECTION 3. PRIMA FACIE VIOLATION. 3.01 The presence of any boat trailer parked on South Shore Drive, South Shore Court or Hill Street is prima facie evidence that the registered owner of the boat trailer committed or authorized the commission of the violation. SECTION 4. PENALTY. 4.01 Any person violating this Ordinance shall be guilty of a misdemeanor. The minimum penalty for violation of this Ordinance shall be a $50 fine. The maximum penalty for violation of this Ordinance shall be the maximum penalty as set by State Legislature for mis- demeanors. SECTION 5. IMPOUNDMENT. 5.01 Any police officer may remove or cause to be removed an empty boat trailer with or without the motor vehicle it is attached to from the street to a garage • or other place of safety when a vehicle is parked in violation of this Ordinance. Such trailer and/or vehicle shall not be released until the fees for towing and storage are paid in addition to any fine imposed for violation of this Ordinance. 9 SECTION 6. EFFECTIVE DATE. • 6.01 This Ordinance shall become effective from and after its passage and publication. Passed and adopted by the CitCouncil of the City of Chanhassen this 9th day of I , 1988.
