ORDINANCE NO. 157
AN ORDINANCE AMENDING CHAPTER 20 OF THE
CHANHASSEN CITY CODE, THE CITY'S ZONING ORDINANCE,
BY REZONING CERTAIN PROPERTY
THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
Section 1. Chapter 20 of the Chanhassen City Code, the City's
zoning ordinance, is hereby amended by rezoning all property within
the following plat from A-2, Agricultural Estate and RR, Rural
Residential to PUD-R,,Planned Unit Development -Residential:
All of ERSBO ADDITION, according to the recorded plat
thereof. ALSO
East Half of the West Half of Northeast Quarter of Southwest
Quarter and the West Half of the East Half of the Northeast
Quarter of Southwest Quarter and South Half of East Quarter of
Northeast Quarter of Southwest Quarter, all in Section 2,
Township 116, Range 23, County of Carver, State of Minnesota.
Section 2. The rezoning of this property is subject to the
following conditions:
1. The applicant (Lundgren Bros.) shall enter into a Planned Unit
Development Agreement containing all of the conditions of
approval for this project and shall submit all required
financial guarantees. The PUD Agreement shall be recorded
against the property.
2. Compliance with setback standards established in the
Compliance Table in the staff report dated October 22, 1991.
3. The applicant (Lundgren Bros.) shall meet all conditions of
the Subdivision #91-9 and Wetland Alteration Permit #91-4.
Section 3. The zoning map of the City of Chanhassen shall not
be republished to show the aforesaid zoning, but the Clerk shall
appropriately mark the zoning map on file in the Clerk's Office for
the purpose of indicating the rezoning hereinabove provided for in
this ordinance, and all of the notations, references, and other
information shown thereon are hereby incorporated by reference and
made a part of this ordinance.
Section 4. This ordinance shall be effective immediately upon
its passage and publication.
PASSED AND ADOPTED by the Chanhassen City Council this 28th
