Ordinance 036eY • CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA ORDINANCE NO. 36-E AN ORDINANCE AMENDING SECTIONS 3.13 AND 5.01 OF ORDINANCE NO. 36, AS AMENDED HERETOFORE, AND ENTITLED "AN ORDINANCE REGULATING AND PROVIDING FOR THE LICENSING OF SIGNS". THE CITY COUNCIL OF CHANHASSEN ORDAINS: SECTION 1. Section 3.13 of Ordinance No. 36, as adopted and amended heretofore, is hereby amended to read as follows: Section 3.13. Temporary Real Estate Signs which advertise the sale, rental, or lease of real estate shall be permitted without a building permit subject to the following specifications: a) On -premise real estate signs advertising the sale, rental or lease of the premises upon which the sign is located: 1) One nonilluminated sign is permitted per street frontage. 2) Sign Display Area shall not exceed six (6) square feet in single-family residential districts, eighteen (18) square feet in multi -family resi- dential districts, and thirty-two (32) square feet in commercial and industrial districts. 3) Such signs shall not be placed closer than ten (10) feet from any street right-of-way line and shall be firmly anchored to the ground. 4) Such signs shall be removed within seven (7) days following the lease or sale of the property. b) Off -premise real estate signs advertising the sale, rental or lease of commercial and industrial buildings when such signs are located off the prem- ises of the property being advertised: 1) One nonilluminated off -premise sign shall be permitted per building. 2) Such signs shall only be permitted in commercial and industrial districts and on property located within the same subdivision as the building being advertised. 3) Such signs shall not be located closer than two hundred (200) feet from any other such sign located on the same side of the street. 4) Sign Display Area shall not exceed thirty-two (32) square feet, and the height of such signs shall not exceed fifteen (15) feet. 5) Such signs shall not be located closer than twenty-five (25) feet from any street right-of- way line, and shall be firmly anchored to the ground. 6) Such signs shall be removed within seven (7) days following the lease or sale of eighty percent (80%) • of the building floor space which it is advertising, or within twelve (12) months from the date a permit is issued, whichever comes first. 40 SECTION 2. Section 5.01 of Ordinance No. 36, as adopted and amended heretofore, is hereby amended to read as follows: Section 5.01. Permit Required: Except as herein exempted, no person, firm, or corporation shall erect, install, relo- cate, or alter any sign without first obtaining a building permit for such work from the Building and Zoning Official of the City of Chanhassen. No permit shall be issued until the Community Development Department determines that such work is in accordance with the requirements contained in this Ordinance and in the Chanhassen Building Code. SECTION 3. This ordinance shall become effective from and after the date of its passage and official publication. Passed and adopted by the day of May , 1983.
