Ordinance 039VILLAGE OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA ORDINANCE NO. 39 AN ORDINANCE ESTABLISHING A HUMAN RIGHTS COMMISSION FOR THE VILLAGE OF CHANHASSEN. THE COUNCIL OF THE VILLAGE OF CHANHASSEN ORDAINS: SECTION 1. INTERPRETATION AND SCOPE. It is hereby declared that it is the policy of the Village of Chanhassen to fulfill its responsibility as a partner of the State Department of Human Rights to insure for all persons equal opportunity in housing,employment, public accommodations, services and education. SECTION 2. ESTABLISHMENT OF COMMISSION. . There is hereby established a Human Rights Commission within the Village of Chanhassen. The Commission shall be the advisory agency on human rights to the Village Council. As used in this Ordinance the term "Commission" shall mean the Human Rights Commission and "Council" shall mean the Village Council of Chanhassen. SECTION 3. PURPOSE. The purpose of the Commission is to insure for all persons equal opportunity in employment, housing, public accommodations, services and education; to assist the State Department of Human Rights in implementing the Minnesota State Act Against Discrimi- nation; and to advise the Council on long range human rights programs. 40 • • SECTION 4. COMMISSION COMPOSITION, TERM AND VACANCIES. 4.01 Composition. The Commission shall consist of fifteen (15) members. The members shall be appointed by majority vote of the Council and may be removed by not less than a four-fifths vote of the Council. 4.02 Terms and Vacancies. As of the effective date of this Ordinance, the Council shall appoint fifteen (15) members to the Commission for a term ending January 1, 1970. At its first meeting in January 1970, the Council shall appoint five (5) members to serve for a term of one year, five (5) 2. for a term of two years, and five (5) for a term of three years, and thereafter terms shall be for three years. Both original and successive appointees shall hold their offices until their successors are appointed and -qualified. Vacancies during the term shall be filled by the Council for the unexpired portion of the term. Before entering upon the discharge of his duties every member shall take an oath that he will faithfully discharge the duties of his office. All members shall serve without compensation. SECTION 5. OFFICERS. 5.01 Within thirty (30) days after initial appointment the members of the Commission shall meet in regular session and organize by electing from their members a Chairman to serve for a term of one year. The Commission may create and fill such other offices as it may determine. SECTION 6. DUTIES OF THE CHAIRMAN. 6.01 It shall be the duty of the Chairman to preside over all meetings of the Commission. SECTION 7. RULES AND PROCEDURE. 7.01 The Commission shall adopt a set of rules to govern its own meetings and procedures. The rules may be amended from time to time, but only upon written notice to all members that proposed amendments are to be acted upon at a specified meeting. A majority vote.of the Commission shall be required for the approval of the proposed amendment. .gPrTTnM R MPPMTMaQ 8.01 Regular Meetings. The Commission shall not meet less than once every three months at the Chanhassen Village Hall, time and date to be decided by the Commission. 8.02 Special Meetings. The Chairman or any three • members of the Commission shall have the authority to call special meetings of the Commission. Twenty-four (24) hour notification by telephone shall be sufficient. 3. 8.03 Open Meetings. All meetings of the Commission shall be open to the public. SECTION 9. ABSENCE OF MEMBERS. 9.01 Absence from three consecutive regular meetings without the formal consent of the Commission shall be deemed to constitute a resignation of a member; and the vacancy thus created shall be filled thereafter as provided in Section 4 herein. SECTION 10. POWERS AND DUTIES. 10.01 The Commission shall draft a memorandum of agreement with the State Department of Human Rights for the . purpose of determining regulatory and enforcement procedures. 0 10.02 The Commission shall enlist the cooperation of agencies, organizations and individuals in the community in an active program directed toward the creation of equal opportunity and the elimination of discrimination and inequality. 4. 10.03 The Commission shall formulate a human relations program for the Village of Chanhassen to give continued effective- ness and direction to the work of all individuals and agencies addressing themselves to planning, policy making and educational programming in the area of civil and human rights. 10.04 The Commission shall advise the Mayor, the Village Council, and other agencies of the government on human relations • and civil rights problems. The Commission shall act in an advisory capacity with respect to planning or operation of any village department on issues of civil and human rights and shall recommend the adoption of such specific policies or actions as are needed to provide for full equal opportunity in the community. 10.05 The Commission shall develop in cooperation with the State Department of Human Rights such programs of formal and informal education as will assist in the implementation of the Minnesota State Act Against Discrimination and shall provide for the commission's assumption of leadership in recognizing and resolving potential problem areas in the community. SECTION 11. VILLAGE OFFICIALS TO COOPERATE. 11.01 All Village Officials, department heads, employees and appointees shall cooperate with the Commission and render all reasonable assistance to the Commission. • C SECTION 12. ANNUAL REPORT. 12.01 The Commission shall render annually a full report of its work to the Council. SECTION 13. EFFECTIVE DATE. 13.01 This Ordinance becomes effective from and after its passage and publication.
