AN ORDINANCE FOR THE MANAGEMENT OF SHORELAND AREAS OF THE
CITY OF CHANHASSEN
ORDINANCE NO. 65-A
THE COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
Section 1. Statutory Authorization. This Shoreland Management
Ordinance is adopted pursuant to the authorization contained in
M.S. §105.485, Subd. 6, as an interim ordinance pending the develop-
ment and adoption of a final ordinance and official control
ordinance to regulate the development of shoreland areas of the
City.
Section 2. Operative Provisions.
2.01. Regulation of Shoreland Development.
Chapter Six NR 82-84, Standards and Criteria For
the Management of Municipal Shoreland Areas of
Minnesota, as filed with the Minnesota Secretary of
State and the Minnesota Commissioner of
Administration on March 15, 1976, is hereby adopted,
incorporated by reference herein, and made a part of
this ordinance as if fully set forth herein, as an
ordinance for the management of shoreland areas of
this City. As herein incorporated, said regulation
NR 82-84 shall have the force of law and as such be
fully enforceable.
2.02. Relationship to Existing Ordinances.
The standards set forth in said regulations NR 82-84
shall apply to all shorelands of all public waters,
as those terms are defined in said regulations,
within the City of Chanhassen. Where the standards
of other ordinances of the City are more restrictive
than the requirements set forth in said regulations
NR 82-84, then the more restrictive standards shall
apply.
Section 3. Classification of Lakes. The lakes of the City of
Chanhassen are hereby classified into the following classifica-
tions for purposes of this ordinance and the aforesaid
regulations:
a. Natural Environment Lakes:
Rice Marsh Lake
Harrison
St. Joe
Rice
Silver

b. Recreational Development Lakes:
Riley
Lucy
Ann
Minnewashta
Susan
Christmas
Lotus
Violation.
4.01. Penalties.
Any person, firm, or corporation who shall violate
any of the provisions hereof shall be guilty of a
misdemeanor and upon conviction thereof, shall be
punished by a fine not to exceed $300.00 or by impri-
sonment not to exceed ninety (90) days. Each day
that a violation continues shall constitute a
separate offense.
4.02. Enforcment .
In the event any building or structure is erected,
constructed, altered, repaired, used, converted,
maintained, or any shoreland is altered or used in
violation of this ordinance, the Zoning Administrator
of the city may institute any proper action or pro-
ceeding in the name of the City (as) to prevent such
unlawful erection, construction, alteration, repair,
conversion, maintenance or use; or (b) to restrain or
abate such violation; or (c) to prevent the use or
occupancy of any such building, structure, or land.
Section 5. Repeal. Ordinance No. 65 adopted by the City Council
on July 18, 1977 is hereby repealed in its entirety.
Section 6. Effective Date. This -ordinance shall be in full
force and effect from and after its passage and publication.

THE CHANHASSEN CITY COUNCIL ORDAINS:
SECTION 1. AMENDMENT.
1.01. Section 3(b) of Ordinance No. 65 is hereby
amended by adding Lotus Lake to the HA of those
lakes classified as Recreational Development Lakes.
1.02. Section 3(c) is hereby deleted in its entirety.
SECTION 2. EFF 0m,71 DATE. This ordinance
shall be in full force and became effective from. and
after its passage and publication.

all the time herein stated has been the publisher and printer of the newspaper known as the Carver County Herald and
has full knowledge of the facts stated as follows: (1) Said newspaper is printed in the English language in newspaper for-
mat and in column and sheet form equivalent in printed space to at least 1,200 square inches. (2) Said newspaper is a
weekly and is distributed at least once each week for 50 weeks each year. (3) In at least half of its issues each year has no
more than 75 percent of its printed space comprised of advertising material and paid legal notices; and in all of its issues
each year, has 50 percent of its news columns devoted to news of local interest to the community which it purports to
serve, and not more than 25 percent of its total nonadvertising column inches in any issues wholly duplicates any other
publication unless the duplicated material is from recognized general news services. (4) Said newspaper is circulated in
and near Chaska and has at least 500 copies regularly delivered to paying subscribers and has entry as second-class mat-
ter at the Chaska Post Office. (5) Said newspaper has its known office of issue established in Carver County in which lies
the City of Chaska. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said
newspaper is available at single or subscription prices to any person, corporation, partnership or other incorporated
association requesting the newspaper and making applicable payment. (8) Said newspaper has complied with all the
foregoing conditions of this subdivision for at least one year last past. (9) Said newspaper has filed with the Secretary of
State of Minnesota prior to January 1, 1976 and each January 1 thereafter an affidavit in the form prescribed by the
Secretary of State and signed by the managing officer of said newspaper and sworn to before a notary public stating that
the newspaper is a legal newspaper.
