ORDINANCE NO. 69
AN ORDINANCE PROVIDING FOR THE COLLECTION OF CHARGES FOR PERFORMANCE
OF SERVICES RELATING TO SIDEWALKS, WEED ELIMINATION, REMOVAL OF
PUBLIC HEALTH OR SAFETY HAZARDS, WATER SERVICE LINES, DUST TREATMENT
OF STREETS, TREE CARE AND REMOVAL, AND STREET LIGHTING
THE COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
Section 1. Short Title and Purpose. This ordinance shall be
known as the "Service Charge Ordinance of the City of Chanhassen",
and is enacted, as authorized by Minnesota Statutes, Section 429.101,
for the purpose of providing for the performance by the City of
certain services as hereinafter enumerated in Section 2 of this
ordinance,and to provide for the collection of unpaid charges for the
performance of said services by the City.
Sectinn 2_ Services.
2.01 Authorization of Services by Resolution. In addition
to any other method authorized by law, the City Council, pursuant
to Minnesota Statutes, Section 429.101, may from time to time by
resolution, order the performance of any of the following services:
a. Snow, ice or rubbish removal from sidewalks.
b. Weed elimination from streets or private property.
C. Removal or elimination of public health or safety
hazards from private property, excluding any structure
included under the provisions of Minnesota Statutes
Sections 463.15 to 463.26 (Hazardous Buildings).
d. Installation or repair of water service lines.
e. Street sprinkling or other dust treatment of streets.
f. The trimming and care of '.trees and the removal
of unsound trees from any street.
g. The treatment and removal of insect infested
or diseased trees on private property.
h. The repair of sidewalks and alleys.
i. The operation of a street lighting system.

2.02 Procedure. Upon the adoption of a resolution ordering
the performance of any of the services enumerated in Section 2.01
hereof, the City Clerk shall transmit copies thereof to the City
Engineer who shall then proceed with such work under the direction
of the Council by purchasing the necessary materials and employing
day labor, or by entering into contracts for such work. The City
Engineer shall keep an accurate record of the cost of performing
any of said services, and shall report such information to the
City Clerk.
2.03 Insurance of Obligations. Whenever the Council has by
resolution ordered work in accordance with Section 2.01 hereof and
such work has been commenced or a contract or contracts therefor
awarded, the Council may issue obligations to defray the expense
thereof in accordance with and subject to the limitations of
Minnesota Statutes, Section 429.101,Sudivision 3.
Section 3. Special Assessments.
3.01 Special Benefit. As provided by Minnesota Statutes,
Section 429.101, the performance by the City of any of the foregoing
services shall constitute a special benefit for which a special
assessment for the collection of the cost thereof may be levied
against the property benefited.
3.02 Special Assessment Procedure. On or before
August lst of each year the City Clerk shall prepare
an assessment roll assessing all costs of such work reported to him
against each separate lot or parcel of land upon which such work was
performed or abutting on the streets whereon such work was done, in
proportion to the special benefits conferred upon suchlots or parcels
of land. The Council shall thereupon examine such
assessment roll submitted by the City Clerk, and if satisfactory,
shall call a public hearing and levy special assessments for the cost
of such work in accordance with Minnesota Statutes, Section 429.061.
Any special assessment levied hereunder shall be payable in a single
installment, or by up to ten equal annual installments as the Council
may provide.
Section 4. Repeal. Ordinance No. 1-J entitled "An Ordinance
Relating to the Dust Treatment of Streets" enacted June 1, 1967 is
hereby repealed.
Section 5. Effective Date. This ordinance shall become effective
from and after its passage and publication.

AN ORDINANCE PROVIDING FOR THE COL-

THE COUNCIL OF THE CITY OF
-CHANHASSEN ORDAINS:
Section 1. Short Title and Purpose. This or-
dinance shall be known as the "Service Charge Or-
dinance of the City of Chanhassen", and is enacted,

which said newspaper is printed. (6) Said newspaper files a copy of each issue immediately with the State Historical
Society. (7) Said newspaper has complied with all the foregoing conditions for at least one year preceding the day or dates
of publication mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1,
1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the
managing officer of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
