CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION May 4, 1981 MOTION BY COUNCILMAN: Horn RESOLUTION NO: 81-09A DATE: SECONDED BY COUNCILMAN: Geving_ WHEREAS, the City of Chanhassen has entered into a joint powers agreement with other cities and townships in Carver County to conduct a Step I facility planning for areas within their jurisdictions to identify on-site sewage treatment practices to comply with local, state and federal standards; and WHEREAS, the Needs Determination phase of the facility planning process identified thirteen on-site sewage treatment system failures; in an area of Section 25 of T116N, R23W, known as Bandimere Heights, within the boundaries of the City of Chanhassen, thereby establishing a need for some form of corrective action in the study area; and, WHEREAS, the alternatives evaluation phase of the facility planning process evaluated several alternative corrective actions with regard to environmental compatability and cost effectiveness; and, WHEREAS, the City of Chanhassen has in the course of the facility planning process solicited public participation and input as to which corrective action was the most socially acceptable to the citizens of the study area; and, WHEREAS, the City of Chanhassen after careful consideration selected the corrective action which proposed: That the homes along West 96th Street within the corporate limits of the City of Chanhassen, in Section 25 of T116N, R23W be connected to the Chanhassen sewer system and on- site upgrade be proposed for the three houses on Pioneer Trail as the alternative best suited to providing a long- term solution to the on-site sewage treatment problems in the study area; and WHEREAS, the City of Chanhassen now finds that the Minnesota Pollution Control Agency and the Environmental Protection Agency will no longer allocate grant funds for a conventional collection system; and, WHEREAS, the alternative proposal for corrective action which provides for a community drainfield system for the homes along West 96th Street within the corporate limits of the City of Chanhassen, in Section 25 of Tl16N R23W and on on-site upgrade for the three homes on prioneer Trail is also cost effective under federal guide- lines and is an alternative that will be suited to providing a long term solution to the on-site sewage treatment problems in the study area. ~ e e e NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Chanhassen, Minnesota, as follows: 1. The resolution adopted October 20, 1980 selecting a conventional collection system for the W. 96th Street study area is hereby recinded. 2. That the alternative proposal for a community wastewater facility for the homes along W. 96th Street and an on-site upgrade for the three homes along Pioneer Trail be imple- mented to meet the long-term sewage treatment needs of the area and implementation of this alternative be contingent upon the availability of state and federal funds for Step II and Step III of the Construction Grants Program. 3. The Carver County Joint Communities Facilities Plan is hereby amended to substitute this resolution adopted May 4, 1981 for the resolution dated October 20, 1980 and found on the page entitled "Exhibit 8.8B.l Plan Section."
