RESOLUTION APPROVING REGISTERED LAND SURVEY

WHEREAS, Merwyn E. Parks and Elizabeth R. Parks (herein-
after the "Parks"), are the fee owners of the tracts of land which
are more particularly described on Exhibit A attached hereto and
made a part hereof, (hereinafter the "Subject Property"), and
WHEREAS, Partnership Investments of Minnesota, Inc., a
Minnesota corporation, (hereinafter "PIM") is the vendee under a
contract for deed to purchase the Subject Property, and
WHEREAS, PIM has agreed to assign all of its interest in
a portion of the Subject Property to The Jockey Club, Inc., a
Delaware corp::>ration, (hereinafter "Jockey Club"), and
WHEREAS, all of the Subject Property is located within
the corporate boundaries of the City of Chanhassen, Minnesota,
(hereinafter the "City"), and
WHEREAS, PIM and Jockey Club have acknowledged to t~e
City that the Subject Property is presently zoned R-1A Agricultural
Residence District under the Chanhassen Zoning Ordinance, which
provides that properties so zoned may be used only for single
family dwelling purposes or agriculture purposes, and
WHEREAS, Jockey Club and PIM, with the knowledge and
consent of the aforementioned fee owners, have filed an application
with the City for approval of a proposed Registered Land Survey
which would subdivide the Subject Property into two parcels of land,
Tract A and Tract B, respectively, as depicted on that certain
document which is on file in the office of the Chanhassen Zoning
Administrator, described as follows:
"Proposed Registered Land Survey
for David A. Kirscht Assoc., Inc.,"
prepared by Schoell & Madson, Inc.,
dated October, 1981, and stamped as
"Received October 30, 1981, Community
Development Department", and

WHEREAS, the City, by adoption of Ordinance 45, has
officially established the policy that the subdivision of lands in
those areas of the City, which are not served by municipal sewer,
is prohibited, except upon the issuance of a variance to said
Ordinance 45, and
WHEREAS, said Ordinance 45 prohibits the issuance of
building permits as to any tract of land, which was created
subsequent to March 15, 1971, and which is not served by the City
Sanitary Sewer System, and
WHEREAS, proposed Tract A and Tract B are not served by
the City Sanitary Sewer System and are being created subsequent
to March 15, 1971, and
WHEREAS, Ordinance 45 is of force and effect as to
division of land to the extent authorized by Minnesota Statutes,
~462.358, and
WHEREAS, the purpose of said Ordinance 45 is to avoid
the environmental degradation which accompanies land development
and the increased usage of inherently unreliable on-site septic
systems, and

WHEREAS, the aforementioned application was not filed
with the City for the purpose of constructing additional dwelling
units or commercial structures or industrial structures on the
Subject Property, but rather for the purpose of allowing PIM and
Jockey Club to finance their business activities by borrowing money
against their interests in the Subject Property, and
WHEREAS, Jockey Club and PIM desire to accomplish the
aforementioned subdivision of the Subject Property by means of
a Registered Land Survey, and
WHEREAS, Section 462.358(4b) of Minnesota Statutes allows
the recording of certain subdivision deeds without municipal
approval, provided that all parcels resulting from the subdivision
are at least 20 acres in area and 500 feet in width, and
WHEREAS, both proposed Tract A and proposed Tract Bare
at least 20 acres in area and 500 feet in width, and
WHEREAS, the approval of the proposed subdivision of
the Subject Property would not violate the purpose, spirit or
intent of Ordinance 45 or Minnesota Statutes, Section 462.358(4b),
and would in fact be advantageous to the City for zoning
administration purposes and tax administration purposes in that
the present metes and bounds description of the Subject Property
would be replaced with a registered land survey,

NOW, THEREFORE, BE IT RESOLVED:
1.
That the subdivision of the Subject Property, by
registered land survey, into two parcels of land,
Tract A and Tract B, respectively, is hereby
approved provided that each of said tracts is at
least 20 acres in area and SOO feet in width,

2.
That a copy of this Resolution shall be recorded
with the Carver County, Minnesota, Registrar of
Titles for the purpose of putting future owners and
encumbrancers of the Subject Property on notice of
the applicable Ordinances of the City of Chanhassen.
Passed and adopted by the Council of the City of
Chanhassen, this 4th day of January , 19 82
