CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA e RESOLUTION Dated: September 7, 1982 Motion by Councilmember Horn Resolution No. 82-54 Seconded by Councilmember Hamilton RESOLUTION ESTABLISHING PROCEDURE FOR THE PROCESSING OF STREET VACATION AND EASEMENT VACATION PETITIONS WHEREAS, Sections 412.851 and 462.358(7) of Minnesota Statutes, empower the City Council to vacate streets, alleys, public grounds, public ways, utility easements, boulevard reserves, sewer easements, drainage easements, electric easements, telephone easements, telegraph easements, gas easements, and steam easements, either on its own motion or upon the petition of a majority of the owners of the land abutting on the area to be vacated; and WHEREAS, all such vacation proceedings, must be pro- ceeded by a public hearing, published notice of such hearing, and posted notice of such hearing; and e WHEREAS, the Council desires to consider on its merits each petition for any such vacation coming before it provided that said petition meets the standards set forth below. NOW, THEREFORE, BE IT RESOLVED: A. That the City Manager is hereby authorized and directed to schedule on the Council's meeting agenda the requisite public hearing on each such vacation petition which is filed with his office, 1. Provided that such petition sets forth with clarity the location of the area to be vacated, and 2. Provided further that said petition has been signed by at least one owner of property abutting on the area to be vacated, and 3. Provided further that th~ petitioner shall have fully paid the petition fee and costs deposit as set forth in Ordinance No. 71, or its successor ordinance, if any. e , e . e . -. -' B. That the Council will consider any vacation petition meeting the standards set forth in subsection "A" above; any petition not meeting said standards will be considered only after the Council, by specific resolution or motion, has ordered a public hearing on the same. C. In the case of any petition meeting the standards set forth in suchsection "A" above, the City Manager shall give posted notice and published notice of the public hearing as required by law. D.
