A RESOLUTION WAIVING COMPLIANCE WITH SUBDIVISION REGULATIONS
WHEREAS, James Curry is the owner of the following described
parcels:
(See attached Exhibits A and B for description>
WHEREAS, the City previously approved a final development
plan for the above described property referred to as "Lake Susan
Planned Unit Development"; and
WHEREAS, the following described parcels of land were
excluded from the proposed PUD by being listed as Outlots:
Outlots Band C

WHEREAS, James Curry desires to convey the above two
described 20.9 and 7.1 acre parcels without completing a plat of
the 200 acre parcel described above.
NOW, THEREFORE, be it resolved that the Chanhassen City
Council finds and determines:
1. Requiring compliance with the City's Subdivision regula-
tions to separate and sell the above described 20.9 and 7.l acre
parcels will create an unnecessary hardship;
2. Failure to require compliance with the City's Subdivision
regulations in connection with the separation of the above
described 20.9 and 7.1 acre parcels does not interfere with the
purpose of the subdivision regulations~ and
3. Brian Klingelhutz and Neil Klingelhutz may record a deed
for the above described 20.9 and 7.l acre parcels without
complying with the City's subdivision regulations.
