84-31 e e e " w CITY OF CHANHASSEN CARVER AND HENNEPIN mlJNTIES, MINNESOTA DATE: Jrme 25, 1984 84-31 MOTION BY RESOLUTION NO: COUNCILMAN: Horn SEmNDED BY mUNCIlMAN: SWenson RESOLUTION OF THE CITY OF CHANHASSEN AUTHORIZING FILING OF APPLICATION AND EXECUTION OF GRANT PROJECT AGREEMENT 'ID rnVELOP OPEN SPACE UNrnR THE PROVISION OF THE FEDERAL LAND AND WATER CONSERVATION FUND ACT AND THE STATE NATURAL RESaJRCE FUND. WHEREAS, the Land and Water Conservation Fund Act and the State Natural Resources Fund provides for the making of grants to assist local public bodies in the acquisition and development of outdoor recreation projects, and WHEREAS, the City of Chanhassen desires to develop certain land known as South Lotus Lake Park, which land is to be held and used for pennanent open space, and WHEREAS, in order for the proI.X>sed project to be eligible for approval, there must be proof that it is part of a comprehensive outdoor recreation plan and 5-year action program (capital improvement), and WHEREAS, the City of Chanhassen has an original (or revised) 5-year action program which includes South Lotus Lake Park, and WHEREAS, it is estimated that the cost of developing said interest (s) shall be $115,000.00, and WHEREAS, upon project approval the City of Chanhassen must enter into fonnal grant project agreements with the state for the specific purpose of developing South Lotus Lake Park. NQ1;\T, THEREFORE, BE IT RESOLVED BY THE CITY mUNCIL of the CITY OF CHANHASSEN: 1. That an application be made to the State of Minnesota, Department of Energy and EConomic Developrrent, Parks and Recreation Grants Unit for a grant from the Land and Water Conservation Fund of 1965 as amended for an amount presently estimated to be $57,500.00 and the applicant will pay the balance of cost from other funds available to it. 2. That an application be made to the State of Minnesota, Department of Energy and Econanic Developrrent, Parks and Recreation Grants unit for a grant fran the Natural Resources Fund (Minnesota Laws, 1983, Chapter 301, Section 31, Subdivision 5, paragraph (b) for an amount presently estimated at $28,750,00 and the applicant will pay the balance of the cost from other funds available to it. -- - e " 3. That the Mayor of the City of Chanhassen has authorization to execute and file A) such application and B) the 5-year action program with the State of Minnesota, D3partment of Energy and Econernic Developrrent, Parks and Recreation Grants Unit, and to provide additional information and furnish such documents as may be required by said Department, and C) to act as the authorized correspondent of the applicant. 4. That the proposed development is in accordance with plans for the allocation of larrl for open space uses, and that should said grant be made, the applicant will develop and retain said land for use (s) designated in said application arrl approved by the D3partment of Energy and Economic Development and the National Park Service (NPS). 5. That the United states of America and the State of Minnesota be, and they hereby are, assured of full compliance by the applicant with the regulations of the Department of Interior, effectuating Title VI of the Civil Rights Act of 1964. 6. That the City of Chanhassen enter into an agreement with the State of Minnesota, Department of Energy and Economic D3velopment, Parks and Recreation Grants Unit to provide such grants as are specified in numbered paragraphs 1 and 2, above, for the year (s) 1984-1985. 7. That the Mayor of the City of Chanhassen is authorized and directed to execute such agreement and any supplemental agreements thereof.
