VACATION OF A UTILITY AND DRAINAGE EASEMENT
LOT 1, BLOCK 1, ORCHARD HILLS
WHEREAS, The City has received a petition for vacation of a
portion of a drainage and utility easement as platted on L-t 1,
Block 1 of Orchard Hills, more particularly described in "Exhibit
A", attached hereto and made a part of; and
WHEREAS, a public hearing was held on said petition on April
1, 1985; and
WHEREAS, said public hearing was preceded by two weeks
published and posted notice as required by Section 412.851 of
Minnesota Statutes; and
WHEREAS, there is no public interest to be served by the con-
tinued public ownership of that portion of the above described
easement vacation.
e NOW, THEREFORE, BE IT RESOLVED, that the Chanhassen City
Council hereby vacates the above described drainage and utility
easement.

"EXHIBIT A"
That part of the East 70.00 feet of the existing drainage and
utility easement over Lot 1, Block 1, Orchard Hills according to
the plat on file and of record in the office of the Registrar
of Titles, Carver County, Minnesota lying westerly of the line
described as follows: Beginning at a point on the south line of
said Block 1, distant 200.00 feet westerly of the Southeast
corner of said Block 1 as measured along said south line; thence
northeasterly to a point in the southwesterly line of said Lot 1,
Block 1, said point being the intersection of said Southwesterly
and a line parallel with and distant 70.0 feet westerly of the
east line of said Lot 1, Block 1, as measured at right angles to
said east line; thence continue northeasterly from said point
along the extension of the last described line to the
northeasterly line of said Lot 1, Block 1 and there terminating.
Except the northeasterly 10.0 feet of said Lot 1, Block 1 and the
Southwesterly 6.00 feet of said Lot 1, Block 1.
