85-25 e e e CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE: June 3, 1985 85-25 RESOLUTION NO: MOTION BY: Horn SECONDED BY: Watson A RESOLUTION ESTABLISHING THE FAIR MARKET VALUE AND AUTHORIZATION TO MAKE OFFER TO PURCHASE BLOOMBERG PARCEL WHEREAS, the Chanhassen City Council has the responsibility to carry out the goals of the Downtown Land Acquisition Project of the Community Development Block Grant (CDBG) Program (Years IX, X, and XI) which includes the acquisition of real property; and WHEREAS, the City intends to purchase fee simple title from its owner Herbert N. Bloomberg of 1.76 acres irregular shape vacant parcel of land adjacent to the old Instant Web building south of County Road 16, the legal description which is attached as Exhibit A; and WHEREAS, the property to be acquired has been appraised by an independent professional Real Estate Appraiser, who has completed a written document setting forth the fair market value; and WHEREAS, another qualified appraiser has reviewed the appraisal report and concurs in the established Fair Market Value and has set forth that finding in a written statement to the City; and WHEREAS, the work of the appraiser and review appraiser has been determined by the City's Acquisition Consultant to be in compliance with State law, generally accepted appraisal stan- dards, the Uniform Relocation Assistance and Real Property Acquisition policies Act of 1970 and other applicable Rules and Regulations of the Department of Housing and Urban Development. NOW, THEREFORE, BE IT RESOLVED THAT: 1. The Fair Market value of $150,000.00 ($1.95/square foot) set forth in the appraisal and review appraisal report is hereby adopted as just compensation. 2. The City's staff and its attorney are hereby authorized to acquire the subject property by purchase, or donation, for an amount not to exceed the amount of just compen- sation or by proceedings in Eminent Domain, if necessary. .. ~ e - e ...
