ANVASS ELECTION RESULTS OF SPECIAL REFERENDUMr FEBRUARY 24r 1988:
eneral discussion occurred regarding the results of the elec-
ion. Questions asked and responses are shown:
uestion - Can the City recount the ballots given the closeness

esponse - No. The City Attorney has verified this statement

nd State statutes. The Legislature was specific in ensuring
hat no persons would be allowed to remove the seals from the

istrict Court recount procedures. The Manager stated that he
ould have the City Attorney call Councilman Boyt directly to
~spond to the question of the cost of District Court and whether
hat process would require that all referendum items recounted.

)NSIDER PROPOSED COURT STIPULATION SETTLEMENT~ NATURAL GREEN~
ITY ATTORNEY: The City Manager noted that the proposed
]reement was to have been presented by the City Attorney. In
is absence, the Manager would respond to any questions. In
~sence, the proposed stipulation agreement is a finalization of
~e first settlement agreement entered into between the City and
=. Luse in 1983. The essence of the settlement agreement was to
~ase operations on the site as early as possible allowing the
~operty owner some time under which he would amortize his costs
~ establishing the business. Mr. Luse would be in a position to
)ye his operation to Chaska and thereby cease all operations on
he site. The move would involve consolidating the office use at
~e Chanhassen location (requires a temporary trailer on the pro-
~rty through the end of 1989). All plant materials would be
~moved in 1988 with the final restoration of the site occurring
~ 1989 with the final movement of the offices to Chaska.
~e City Council generally concurred with the recommendation of
~e City Attorney. As council members'had not seen all packet
terials, the decision was to authorize the Mayor and Manager to
gn the stipulation agreement contingent upon no council member
otesting such within the next seven day period.

DISTRIBUTION OF CONCEPT PLANr CITY HALL ADDITION (NON-ACTION
ITEM): The City Manager noted that copies of the proposed con-
cept plan were being distributed with this packet. Thi~ would
give council members an opportunity to review this document in
advance of its appearance onto the agenda of March 14, 1988. As
the architects are presently moving ahead with design detail, the
Manager asked that council members call if questions arose
regarding the proposed concept plan. It was the Manager's belief
that the plan had been modified to include the various modifica-
tions requested by the Council approximately two months ago.
ADJOURNMENT: The meeting was adjourned at 6:45 p.m.
