Cl1anhaSsenCity Council lias conducted a hearing preceded by two (2)
weeks published and posted notice to consider the vacation of the
following described easement:
That part of the south 6.00 feet of Lot 3, Block 2, LOTUS LAKE
ESTATES, lying east of the west 10.00 feet thereof and lying west
of the east 10.00 feet thereof, Carver County, Minnesota;
and

WHEREAS, it appears that it is in the public interest to
vacate the easement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chanhassen:
1. The above described easement is hereby vacated.
2. The City Clerk is directed to file a certified copy of
this resolution with the County Auditor and County
Recorder.
ADOPTED this 14th

GRANT OF PERMANENT EASEMENT
ELWOOD J. CAMPBELL and LEONA V. CAMPBELL, husband and wife,
hereinafter referred to as "Grantors", in consideration of One Dollar
($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, do hereby grant unto the
CITY OF CHANHASSEN, a municipal corporation organized under the laws
of the state of Minnesota, the Grantee, hereinafter referred to as
the "City", its successors and assigns, forever, a permanent easement
for public drainage and utility purposes over, across, on, under and
through land situated within the County of Carver and state of
Minnesota legally described as follows:
That part of the south 4.00 feet of the north 10.00 feet of Lot
2, Block 2, LOTUS LAKE ESTATES, lying east of the west 10.00
feet thereof and lying west of the east 10.00 feet thereof.
INCLUDING the rights of the City, its contractors, agents,
servants and assigns, to enter upon the easement premises at all
reasonable times to construct, reconstruct, inspect, repair and
maintain said public drainage and utility systems over, across, on,
under and through the easement premises, together with the right to
grade, level, fill, drain, pave and excavate the easement premises,
and the further right to remove trees, bushes, undergrowth and other
obstructions interfering with the location, construction and
maintenance of said public drainage and utility systems.
The above named Grantors, for themselves, their successors,
heirs and assigns do covenant with the City, its successors and
assigns, they are well seized in fee title of the above described

CENTURION FLEET MORTGAGE CORPORATION, which holds a mortgage on
all or part of the property more particularly described as that part
of the south 4.00 feet of the north 10.00 feet of Lot 2, Block 2,
LOTUS LAKE ESTATES, lying east of the west 10.00. feet thereof and
lying west of the east 10.00 feet thereof, which mortgage is dated
November 27, 1990, and filed December 6, 1990, as Document No.
119998, with the office of County Recorder for Carver County,
Minnesota, pursuant to an assignment dated November 27, 1990, and
filed December 6, 1990, as Document No. 119999, with the office of
