SECONDED BY:

A RESOLUTION URGING THE LEGISLATURE NOT TO ENACT REGULATIONS
REGARDING THE SALE OF CIGARETTES FROM VENDING MACHINES
WHEREAS, the City of Chanhassen considers tobacco vending
machines within the City to be its responsibility as part of their
basic authority to enact health and safety ordinances for its
citizens.
WHEREAS, House File 2042 and Senate File 1923 currently being
considered by the Minnesota Legislature contains a clause that
would pre-empt local government from controlling the placement of
tobacco vending machines.
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City
Council urges the legislature to reject a pre-emption clause and
allow the city to join many other cities currently considering
restrictions and the location of tobacco vending machines to reduce
the illegal sale of tobacco to minors.
Passed and adopted by the Chanhassen City Council this 26th
day of February, 1990.
